The Division of Water Resources(the Division)received your application on March 2,2015 (dated
February 22)requesting certificate of coverage(COC)under the subject General Permit.Pursuant to 15A
NCAC 02H .0107(d),the Division shall issue a COC only when the Director determines that the intended
discharge meets surface water-quality standards.
The Division understands that you propose to construct a new[non-existing] wastewater treatment facility
that would discharge to a roadside ditch,thence to an unnamed tributary(UT)to Ready Creek[segment 13-
17-8] under zero-flow receiving-stream conditions [7Q10 and 30Q2 stream flows=0.0 cfs].Your proposed
discharge does not meet the following requirements under 15A NCAC 02B.0206(d)(2):
"If the 30Q2 and 7Q10 flows are both estimated to be zero, no new or expanded
[additional]discharge of oxygen consuming waste will be allowed. Requirements
for existing discharges to streams where the 30Q2 and 7Q10 flows are both
estimated to be zero will be determined on a case-by-case basis."
The 30Q2 and 7Q10 were estimated by the United States Geological Survey(USGS)to be zero for the
location at Outfall 001 discharging to receiving waters designated as an unnamed tributary to Reedy Creek
[stream segmentl3-17-8], a waterbody currently Classified C within Subbasin 03-07-11 [HUC 03040105]
of the Yadkin-Pee Dee River Basin.
In addition, it appears that treated effluent,in its path to converge with the unnamed tributary,would likely
trespass to adjacent properties because no legal easements have been established for the proposed discharge.
In accordance with 15A NCAC 02H.0112(6),your application for Certificate of Coverage(CO)
NPDES General Permit NCG550000 is hereby denied and returned to you [15A NCAC 2H.0107(d)].
You may contest this decision as provided in Articles 3 and 4 of General Statute 150B by filing a written
petition for an administrative hearing to the Office of Administrative Hearings(OAH)within sixty(60)
calendar days.
