A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A
review of your response will be considered along with any information provided on the submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

The March 2018 Discharge Monitoring Report (DMR) for the subject facility revealed violation(s) for the
quarterly reporting of Total Nitrogen and Total Phosphorus. The failure to quarterly monitor was issued as a Notice
of Violation and Intent to Assess Civil Penalty (Tracking # NOV-2018-MV-0121). The ORC of the subject facility
contacted this Office and reported that sampling and analysis had been conducted for Total Nitrogen and Total
Phosphorus, during the month of January 2018, but data had not been reported on monthly DMR.
A revised Electronic Discharge Monitoring Report (EDMR) has been received with the omitted data; therefore, this
Notice of Violation & Intent to Assess Civil Penalty (NOV-2018-MV-0121) is retracted. Please keep a copy of this

This inspection was conducted as a Compliance Evaluation Inspection (CEI) to insure
compliance with permit requirements and conditions. At the time of inspection deficiencies were
noted with the maintenance and operation of treatment facility as noted in the enclosed
inspection report. We wish to thank you and operating staff for your assistance regarding the
inspection. A copy of this inspection will be forwarded to the facility's Operator -in -Responsible -
Charge (ORC).

This email is intended to follow up our phone call earlier on Monday morning 4/10/17 where in a apprised you that an sewer overflow had
occurred on the facility property at the headwork's. This overflow was observed Friday 4/7/17 at about 1330. At that time I called the Mooresville
office and left word for you through a staff member who's name I did not write down. I called you and later that day was able to give you an
estimated volume spilled of between 10,000 and 15,000 gallons that appeared to be contained to the property.
The spill was due to a large blockage in the influent that was removed on Friday 7th.

Statute (G.S.) 143-215.1 and the facility's NPDES Permit. Pursuant to G.S. 143-215.6A, a civil penalty of not
more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails
to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A

Monitoring Report(s). You will then be notified of any civil penalties that may be assessed regarding the
violations. If no response is received in this Office within the 10-day period, a civil penalty
assessment may be prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E. the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.
Additionally and if you have not already done so, you may wish to consider registering to use the Division's new
e-DMR system for the completion and electronic submittal of monthly Discharge Monitoring Reports (DMRs).

for the noted violations of North Carolina General Statute (G.S.) 143-215.1 and NPDES Permit No.
NC0047091. Pursuant to G.S. 143-215.6A, a civil penalty of not more that twenty-five thousand
dollars ($25,000.00) may be assessed against any person who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-
215.1.
If you wish to provide additional information regarding the noted violations, request technical
assistance, or discuss overall compliance please respond in writing within 10 days of receipt of this
Notice. A review of your response will be considered along with any information provided on the
September 2015 Discharge Monitoring Report (DMR), You will then be notified of any civil
penalties that may be assessed regarding these violations. If no response is received in this Office

This letter is a follow up to our conversation on April 15, 2015. As we discussed, the owners of
Silver Maples Estates have made agreements to connect onto the nearby public sewers operated by
the municipal sewer authority. Upon completion of connection to these facilities, operation of the
existing Silver Maples Estates WWTP will no longer be necessary.
The elimination of the existing discharge is targeted for September, 2016. Upon completion of this
connection, the use of the existing package WWTP will cease and the current discharge to surface
waters will be eliminated. The owners are aware that, at that time, they must submit a letter to NC
DEQ requesting that the NPDES permit be rescinded.
When the connection to the municipal sewer is complete and all discharge from the package WWTP
has ceased, the owner will immediately begin closure procedures to minimize the potential for any
future concerns with the abandoned WWTP. As we discussed, these procedures will include the
following:
Closure Procedures Steps;
The existing effluent discharge pipe will be removed or permanently sealed with
concrete.
2. The contents of the WWTP, including all liquids and sludges, will be pumped out by a
licensed septage hauler and disposed off site at an approved facility that is permitted to
receive these type waste materials (e.g. a municipal WWTP.) The interior of the WWTP
will be washed (power washed if necessary) to loosen any stubborn clinging residues. All
loose sludges and waste materials must be loosened and removed by the hauler. Care
shall be taken to avoid or minimize the potential for any spills or leakages of these
materials outside the WWTP. Any such spills or leakages, if they should occur, must be
removed by shoveling the materials plus a sufficient upper level of soils to insure
complete removal. Any such removed materials shall also be hauled and disposed off site
at a licensed disposal facility.
The owner shall retain copies of records provided by the hauler to document the dates,
amounts and place of disposal for all wastes hauled.
At this time, the engineer will inspect the facility to confirm that both Steps 1. and 2.
above have been thoroughly and properly completed and direct any additional corrective
measures if needed. The engineer shall take pictures for a photographic record to clearly
show that Steps 1. and 2. have been properly completed.
The engineer shall contact your office by phone or email to advise when Steps 1. and 2.
have been completed so that you or your staff may make an inspection within 72 hours,
if you so desire. The owner will not proceed to further steps until 72 hours have elapsed,
your staff have completed their inspection, or, you have advised that it is acceptable to
proceed prior to waiting 72 hours.
3. Upon satisfactory completion of the above, the contractor will remove all superstructure
(blowers, grating, handrails, etc.), all air headers, pumps, railings, etc. such that only the
basic walls, roof (top) and floor of the abandoned WWTP remain. The contractor shall
then knock down, crush or otherwise collapse the roof (top) and walls of the concrete
package WWTP such that any portions of the walls protruding above ground, as near as
practical to minimize the amounts of fill material that will be required in Step 4. below,
to insure that the site is properly covered and to insure that any rainwater, etc. will drain
and not accumulate inside the abandoned WWTP. All of the pumps, blowers, etc.
removed in this step must either be recycled off site, reused off site or properly disposed
at an approved landfill. This shall include the removal of any chemicals, materials,
equipment, etc. associated with the WWTP. Any said chemicals, materials, equipment,
etc. will be removed off site and must either be reused, recycled or properly disposed in
accordance with any applicable rules and regulations.
At this time, the engineer will inspect the facility to confirm that Step 3.
above has been thoroughly and properly completed and direct any additional corrective
measures if needed. The engineer shall take pictures for a photographic record to clearly
show that Step 3. has been properly completed.
4. Upon satisfactory completion of the above, the contractor will fill the remaining shell
and concrete rubble of the abandoned WWTP with suitable clean fill dirt or concrete and
shall compact the fill material to minimize potential for later settling. The contractor will
add a minimum 6" deep layer of good, clean topsoil to the top of the completely filled,
abandoned WWTP. The fill and topsoil covering shall be added sufficient to be shaped
into a mound (or `turtleback") as appropriate to insure proper drainage offsite and
minimize any potential for puddles or accumulation of rainwater on the site. The
contractor will plant a suitable cover grass such as Fescue, with proper fertilizer, lime,
etc. to establish a good, healthy vegetative cover, to insure that any rainwater, etc. will
drain and not accumulate inside the abandoned WWTP.

At this time, the engineer will inspect the facility to confirm that Step 4. above has been
thoroughly and properly completed and direct any additional corrective measures if
needed. The engineer shall take pictures for a photographic record to clearly
show that Step 4. has been properly completed.
The engineer shall contact your office by phone or email to advise when Step 4.
has been completed so that you or your staff may make an inspection, if you so desire.
5. The engineer will prepare a final report, documenting the closure procedures above
detailing the dates each step was completed and providing copies of photos taken at each
step, as well as a confirmation that all of the steps of the closure process described above
have been completed, to the best of his ability to determine and confirm thru the periodic
inspections described above. An original copy of this report will be mailed to you within
thirty (30) days of project completion.
I appreciate the opportunity to have discussed this with you and I hope that this is an accurate
reflection of the procedures we discussed and in keeping with the practices you would like to see

know. As I mentioned earlier, the actual closure of the WWTP is anticipated to be in September but
we wanted to begin making preparations for this to occur.

The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports.
Incorporating Electronic Reporting Requirements into NPDES Permits
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process. According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically
report your Discharge Monitoring Reports using NC DWR's eDMR system.
In addition to requiring permittees to report information electronically, the rule also requires permittees
to identify the initial recipient for the NPDES electronic reporting data [see 40 CFR 122.41(I)(9)]. Initial

recipient of electronic NPDES information from NPDES-regulated facilities (initial recipient) means the
entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity
for receiving electronic NPDES Data [see 40 CFR 127.2(b)]. Permittees are required to electronically
submit the required NPDES information to the appropriate initial recipient, as determined by EPA. By July
18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial
recipients by state and by NPDES data group. Once available, you can use EPA's web site to find out or
determine the initial recipient of your electronic submission.
NC DWR has submitted a request to EPA to be the initial recipient for the following NPDES data groups:
1. Discharge Monitoring Reports;
2. General Permit Reports [Notices of Intent to discharge (NOIs); Notices of Termination (NOTs)];
3. Pretreatment Program Reports; and
4. Sewer Overflow/Bypass Event Reports
EPA's web site will also link to the appropriate electronic reporting tool for each type of electronic
submission for each state. Instructions on how to access and use the appropriate electronic reporting
tool will be available as well.

PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS
1. a. Volume of wastewater and description of wastewater source(s) of each outfall:
Outfal1001— 0.04 MGD. Domestic wastewater is treated by the existing contact
stabilization WWT facility which includes a bar screen, grit/surge tank followed by primary
clarification, aeration, re -aeration, final clarification, chlorination (tablet), dechlorination
(tablet), effluent flow measurement, and an aerated sludge holding tank.
PART III - OTHER PERTINENT INFORMATION
1. Regional sewer system availability: A municipal sewer line (City of Concord) is
approximately 150 — 200 ft. from this facility.
PART IV - EVALUATION AND RECOMMENDATIONS
The facility appeared to be adequately treating the wastewater (clear effluent no floatable
solids/foam) during the site visit. This facility is prone to flooding which has recently occurred. The
blower/motor units and electrical control box have been previously located on an elevated platform
to prevent damage from the previous flooding events; however, the remaining treatment plant
processes continue to be submerged.
The Park Manager (Permittee representative) is in the process of completing all of the City
of Concord's requirements for the connection to the City's sewer line. This process has been
difficult and costly for the Permittee and additional stipulations still need to be completed. No time-
line could be estimated for a completion date.
There has been no changes and/or modifications to this facility since the permit was last
issued. It is recommended that the subject Permit be renewed as requested.

I Staute 143-215.1C requires that the owner or operator of any wastewater collection or
treatment works to issue a press release when an untreated wastewater discharge of 15,000
gallons or more reaches surface waters. Due to the flood conditions of the Rocky River from
several days of hard excessive rains.
In accordance with that regulation, the following news release has been prepared and issued to
media in the affected county of Cabarrus.
The Silver Maples Mobile Estates had a discharge of untreated wastewater on April 20,2015 of
estimated of 15,000 gallons or more at Silver Maples Mobile Estates WWTP.
The untreated wastewater was discharged into the Rocky River in the sub -basin of the Yadkin -
Pee Dee River Basin.
The Division of Water Resources was notified of the event on on April 20,2015 and is reviewing
the matter.

MW (Metwater,lnc) has never been associated with a viol ation/defenciency of this nature and therefore I
respectfully ask that no civil penalties be levied and extension be granted to comply.
We recently discussed the late submitting of DMR's/EDMR's. As I informed you and Mr. Hennessee earlier last
week our tardiness stems from an internal challenge to compensate for a diminished office staff. I have
reprioritized and instituted a more self reliable means of collecting and transposing data for the timely
submittal of the required DMR's/ EDMR's. I apologize for any inconvenience late reporting has caused your
office.
Moreover, I respectfully request an extension be granted to comply with the EDMR requirement. I would like
at least til May 30th as all these clients have to be reached on site and they in return will have to reach
superiors off site, and get back to me. Only then can I execute the required paperwork. Please confirm a date
for extended compliance.
February's "paper" DMR's for all of MW contract facilities are in the mail and on time.

($25,000.00) may be assessed against any person who violates or fails to act in accordance with the
terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.

January 1, 2014. Before I finalize this correction, I need to confirm the owner information is correct. Currently we show
KBI, LLC as the owner and the renewal application submitted also shows this. A search on the Secretary of State's
Corporation website does not list KBI, LLC.
