As we discussed, the owners of Silver Maples Estates have made agreements to connect onto the nearby public sewers operated by the municipal sewer authority. Upon completion of connection to these facilities, operation of the existing Silver Maples Estates WWTP will no longer be necessary. The elimination of the existing discharge is targeted for September, 2016. Upon completion of this connection, the use of the existing package WWTP will cease and the current discharge to surface waters will be eliminated. The owners are aware that, at that time, they must submit a letter to NC DEQ requesting that the NPDES permit be rescinded. When the connection to the municipal sewer is complete and all discharge from the package WWTP has ceased, the owner will immediately begin closure procedures to minimize the potential for any future concerns with the abandoned WWTP. As we discussed, these procedures will include the following: Closure Procedures Steps; The existing effluent discharge pipe will be removed or permanently sealed with concrete. 2. The contents of the WWTP, including all liquids and sludges, will be pumped out by a licensed septage hauler and disposed off site at an approved facility that is permitted to receive these type waste materials (e.g. a municipal WWTP.) The interior of the WWTP will be washed (power washed if necessary) to loosen any stubborn clinging residues. All loose sludges and waste materials must be loosened and removed by the hauler. Care shall be taken to avoid or minimize the potential for any spills or leakages of these materials outside the WWTP. Any such spills or leakages, if they should occur, must be removed by shoveling the materials plus a sufficient upper level of soils to insure complete removal. Any such removed materials shall also be hauled and disposed off site at a licensed disposal facility. The owner shall retain copies of records provided by the hauler to document the dates, amounts and place of disposal for all wastes hauled. At this time, the engineer will inspect the facility to confirm that both Steps 1. and 2. above have been thoroughly and properly completed and direct any additional corrective measures if needed. The engineer shall take pictures for a photographic record to clearly show that Steps 1. and 2. have been properly completed. The engineer shall contact your office by phone or email to advise when Steps 1. and 2. have been completed so that you or your staff may make an inspection within 72 hours, if you so desire. The owner will not proceed to further steps until 72 hours have elapsed, your staff have completed their inspection, or, you have advised that it is acceptable to proceed prior to waiting 72 hours. 3. Upon satisfactory completion of the above, the contractor will remove all superstructure (blowers, grating, handrails, etc.), all air headers, pumps, railings, etc. such that only the basic walls, roof (top) and floor of the abandoned WWTP remain. The contractor shall then knock down, crush or otherwise collapse the roof (top) and walls of the concrete package WWTP such that any portions of the walls protruding above ground, as near as practical to minimize the amounts of fill material that will be required in Step 4. below, to insure that the site is properly covered and to insure that any rainwater, etc. will drain and not accumulate inside the abandoned WWTP. All of the pumps, blowers, etc. removed in this step must either be recycled off site, reused off site or properly disposed at an approved landfill. This shall include the removal of any chemicals, materials, equipment, etc. associated with the WWTP. Any said chemicals, materials, equipment, etc. will be removed off site and must either be reused, recycled or properly disposed in accordance with any applicable rules and regulations. At this time, the engineer will inspect the facility to confirm that Step 3. above has been thoroughly and properly completed and direct any additional corrective measures if needed. The engineer shall take pictures for a photographic record to clearly show that Step 3. has been properly completed. 4. Upon satisfactory completion of the above, the contractor will fill the remaining shell and concrete rubble of the abandoned WWTP with suitable clean fill dirt or concrete and shall compact the fill material to minimize potential for later settling. The contractor will add a minimum 6" deep layer of good, clean topsoil to the top of the completely filled, abandoned WWTP. The fill and topsoil covering shall be added sufficient to be shaped into a mound (or `turtleback") as appropriate to insure proper drainage offsite and minimize any potential for puddles or accumulation of rainwater on the site. The contractor will plant a suitable cover grass such as Fescue, with proper fertilizer, lime, etc. to establish a good, healthy vegetative cover, to insure that any rainwater, etc. will drain and not accumulate inside the abandoned WWTP. PPPPP'P' At this time, the engineer will inspect the facility to confirm that Step 4. above has been thoroughly and properly completed and direct any additional corrective measures if needed. The engineer shall take pictures for a photographic record to clearly show that Step 4. has been properly completed. The engineer shall contact your office by phone or email to advise when Step 4. has been completed so that you or your staff may make an inspection, if you so desire. 5. The engineer will prepare a final report, documenting the closure procedures above detailing the dates each step was completed and providing copies of photos taken at each step, as well as a confirmation that all of the steps of the closure process described above have been completed, to the best of his ability to determine and confirm thru the periodic inspections described above. An original copy of this report will be mailed to you within thirty (30) days of project completion. The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based). EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. • Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electronic Reporting Requirements into NPDES Permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the electronic reporting process supersedes the paper reporting process. According to our files, your NPDES permit became effective after November 2013, and should contain the requirement to electronically report your Discharge Monitoring Reports using NC DWR's eDMR system. In addition to requiring permittees to report information electronically, the rule also requires permittees to identify the initial recipient for the NPDES electronic reporting data [see 40 CFR 122.41(I)(9)].
