PROJECT SUMMARY: The applicant proposes expand an existing community docking facility to serve the 3 lot, Ariel Cove Subdivision. David B. Sims Jr./Ariel Cove Community Docking Facility Paae 2 9. PROJECT DESCRIPTION The project site is located at 2516 Shandy Lane, adjacent to the south side of Bradley Creek, approximately 1/2 mile upstream from the creek's confluence with Masonboro Sound, in New Hanover County. The 2.29 acre tract was subdivided into three (3) lots, creating Areil Cove Subdivision. There is an access road from Shandy Lane, and the applicant has constructed his private residence on Lot 2. The highground property has an average elevation of approximately fifteen feet (15) above normal high water. The highground area has been maintained in a mowed condition, remaining vegetation is primarily Live Oak, Pine and Red Cedar. The applicant's personal property (Lot 2) exhibits lawn grass and ornamental shrubs. The triangularly shaped tract slopes to coastal marsh along its northwest shoreline. The three lots have a combined shoreline length of approximately 650 linear feet. The project site is a proposed common area, approximately 60 feet wide and 55 feet deep, located in the northeast corner of the property, and accessed by a common area pathway (8' wide) from the access road along the subdivision's eastern property line (Lot 3). There is an abandoned well (concrete slab and well casing) on the proposed common area. The transition between uplands and marsh exhibits Grounsel- bush (Baccharus halimifolia), Marsh-elder (Iva frutescens), Wax Myrtle (Myrica cerifera) and Yaupon (Ilex vomitoria) shrubs. A narrow border of Sea Oxeye (Borrichia frutescens) and high coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), and Salt Meadow Grass (Spartina patens) transitions to a broad expanse of Smooth Cordgrass saltmarsh (Spartina alterniflora), approximately 450 feet wide to the open water area of Bradley Creek. The applicant received State Permit #49-02 on April 23, 2002 for the construction of a private community docking facility and boat basin to accommodate the existing subdivision. The existing pier extends from the common area 480 feet in length and 6 feet wide, terminating in a T-head platform (18 ft. X 12 ft.). The pier is elevated in the mud flat area to provide for small boat navigation during high water. The elevated section is approximately 40 feet long and provides a clearance of 6-8 feet above MHW and a clear span of 14-16 feet between pilings in the most navigable area of the mud flat. Waterward of the T-head platform, the pier leads onto a floating dock that runs parallel to the channel, measuring 92 feet long and 8 feet wide. There are three (3) perpendicular finger piers, 15 feet long and 3 feet wide, and seven (7) mooring pilings installed that currently accommodates five (5) boat slips. Including the mooring pilings, total length of the facility is approximately 540 feet. The applicant was also authorized to excavate a small boat basin to provide adequate water depths around the existing docks, which measures 90 feet long and 90 feet wide, to a depth of -5 feet at mean low water (MLW). The waters of Bradley Creek are Classified "SC#" by the NC Division of Water Quality. The estuary to the south of the maintained Bradley Creek channel is designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The applicant's existing boat basin and docking structure are located just outside (north) of the PNA designation. Bradley Creek is closed to the harvesting of shellfish. The applicant is proposing to expand the existing community docking facility to provide water access for the three (3) lot owners of the existing Ariel Cove subdivision. A new floating dock would extend off the existing floating dock, measuring 20 feet in length by 6 feet in width towards the east. A new finger pier, measuring 30 feet in length by 4 feet in width would extend from this floating dock. The applicant is proposing to excavate a small boat basin to provide adequate water depths around the proposed docks. The dimensions of the proposed basin would be 45 feet long and 15 feet wide, to a depth of -5 feet at mean low water (MLW). The dredging would be completed by a barge mounted excavator and would generate approximately 750 cubic yards of spoil material. The applicant has received permission from the property owner to deposit the material on an existing spoil disposal island at the confluence of the AIWW and Motts Channel; however, the majority of the spoil island appears to be located within of the US Army Corps of Engineers' easement, on the east side of the AIWW, approximately 1.1 miles northeast of the project. It appears that there is a portion of the spoil island on the southeastern section that is not located within the easement; however, the established access to the spoil island is located within the easement. 10. ANTICIPATED IMPACTS The proposed floating docks and mooring pilings would incorporate 688 square feet of Estuarine Waters and Public Trust Area. The proposed dredging would result in the excavation of approximately 675 square feet of shallow bottom. Short term increases in turbidity can be expected during dredging and piling installation. Approximately 5,000 square feet of highground disturbance would occur during placement of dredged material at the disposal site. The proposed floating dock extension would encroach into the riparian corridor 15 foot setback requirement; however, the applicant has received a waiver from the 15 foot setback requirement from the adjacent riparian property owner to the east.
