The comments are outlined below in italics, with our response below. 1) The proposed project would install roads and utilities to access uplands for the construction of residential dwellings. The need for such access is not disputed, however you have not demonstrated avoidance and minimization to the maximum extent practicable as required by NWP General Conditions 23(a) and (b): a. You propose to place fill in Stream A (Culvert 3000) for a road crossing that does not have a clear purpose and need, as no development is proposed on the adjacent property. Further, the adjacent property has not been evaluated for the occurrence of potential waters of the US. Please re-design the project to abide by NWP General Conditions 23(a) and (b) by removing this crossing, or provide documentation that such avoidance and minimization measures are not practicable (i.e. available and capable of being done after taking into consideration cost, existing technology, and logistics in light of overall project purposes). If development is proposed on the adjacent property, please update the plans accordingly and provide the appropriate information for our review documenting the evaluation of this property for the occurrence of potential waters of the US (including possible on-site verification); This impact has been removed as the Town of Garner has agreed to accept a fee-in-lieu and a road stub which does not overlap with Stream A. It is anticipated that future development of the adjoining property by others may require construction of this crossing. This project and associated impact would be permitted as a separate single and complete project for the adjoining property. b. Could the aerial sewer crossing be designed in a location that does not contain wetlands? Please re-design accordingly, or provide documentation that such avoidance and minimization measures are not practicable; The proposed aerial crossing location was determined to be necessary to provide adequate flow and service for this portion of the site. Relocation of the line is not feasible as it would not allow for proper function of the gravity line. 2) Overall plan sheet comments: a. Label the streams/wetlands/ponds consistently with the field-approved delineation map on the “Existing Conditions”, “Detailed Site Plan”, and “Environmental Impact 1-4 Plan and Profile” plan sheets to avoid confusion; Plans updated accordingly. b. The “Existing Conditions” plan sheets do not differentially label the ponds from the wetlands, and some of the streams are not shown (e.g. Stream N) and/or labeled (e.g. Streams L2 and M2); Plans updated accordingly. c. Please clearly label the proposed crossings on the “Overall Wetland & Stream Impacts” and “Detailed Site Plan” sheets to match the “Environmental Impact Plan and Profile” detail sheets; Plans updated accordingly. d. The “Detailed Site Plan” sheets appear to show greenways or pedestrian trails that would cross streams and wetlands. Please elaborate on any such plans, and provide details to enable evaluation of any direct or indirect impacts to aquatic resources associated with these facilities; The proposed project will include four (4) greenway crossings. The proposed greenway will be an 8-ft wide mulch greenway with 2-ft shoulders. Each crossing is required to accommodate connectivity, and the locations reflect the limited crossing options due to the orientation of on-site streams, wetlands, and property boundaries. Crossings were sited to maximize avoidance of wetland, stream, and buffer impacts, prioritizing areas with the smallest amount (or no) wetland impact, straight sections of stream, and perpendicular orientation. Culverts are proposed at two crossing locations for crossing stability (Impact 5 & 6, Sheet CWI-1.12 and 1.13). The remaining two crossings (Impact 4 and 7, Sheets CWI- 1.11 and 1.14) were proposed as boardwalks due to stream impact limitations. Greenway Crossing Impact 4 was located based on existing lot requirements, wetland size, and stream alignment. The crossing utilizes a boardwalk design to avoid stream and wetland impacts. The feasibility of overlapping the greenway with the sewer corridor was investigated but determined not viable as it poses a safety risk due to the potential for climbing on the sewer line. Greenway Crossing Impacts 5 and 6 were sited at narrow and straight segments of stream with no wetlands. Headwalls were used to limit the necessary stream and buffer impact. Shifting the crossing up or down-stream, and/or continuing the greenway parallel to the stream would result in wetland impact. Greenway Crossing Impact 7 was utilizes a boardwalk and avoids wetland and stream impacts. An additional Greenway Crossing was avoided by keeping the eastern portion of the greenway along the north side of Stream A rather than crossing it a second time. Please see sheets CWI-1.11 through CWI-1.14 for more details. 3) “Environmental Impact 1-4 Plan and Profile” sheet comments: a. Sheet Nos. CWI-1.8, CWI-1.9, and CWI-1.10: i. Since more than one culvert pipe is proposed, and in order to comply with NWP 29 Regional Condition 3.6.2, one pipe should act as the low flow pipe (lined up with the thalweg of the existing stream channel) and the other pipe should act as the high flow culvert (only receiving bank‐full flows). High flow culverts are typically designed by placing its invert at bankfull level, or at least a foot or two above the existing stream bed. Please amend the design accordingly; The project engineers have confirmed the actual inlet and outlet will fall at the lowest portion of the stream. Due to software conflicts, the locations of the profiles at this crossing are off-set approximately 0.5-ft from the actual inlet and outlet locations. ii. Are rip rap dissipater pads proposed at the end of any of the culverts? If so, itemize these impacts for each crossing on the PCN and plans. Also, add the rip rap pads to the profile views of each crossing shown along the proposed culvert. Further, specify whether or not any rip rap in the stream bed will be keyed into the stream bed. The plans have been updated to display riprap dissipator pads, which will be keyed into the stream. The size and location of the dissipator pads was determined through stream flow analysis and resulting coverage needed to prevent erosion. b. Sheet No. CWI-1.8: The profile view along the culvert (Culvert 1000 Profile) on this sheet appears to match the crossing plan view shown on Sheet No. CWI-1.9. Please ensure that all plan, profile, and cross-section views are consistent to one particular proposed crossing on each detail sheet; Plans updated accordingly. c. Sheet No. CWI-1.9: i. The profile view along the culvert (Culvert 2000 Profile) on this sheet appears to match to the crossing plan view shown on Sheet No. CWI-1.8. Please ensure that all plan, profile, and cross-section views are consistent to one particular proposed crossing on each detail sheet; Plans updated accordingly. ii. Given the steep slope (5.95%) of the proposed culvert, we are concerned that this stream would be subject to headcutting above the proposed culvert given the proposed 1 foot invert burial. Please confirm with NCDWR regarding whether or not culvert burial is required/advisable in this situation. If burial of the culvert pipe is not advised, please redesign accordingly and update the PCN and applicable plansheets; Timmons Group contacted Rick Trone of DWR for guidance regarding culvert burial. Mr. Trone obtained guidance from Wildlife Resources and confirmed in this situation it would be advisable not to bury the culvert. The design has been updated accordingly. d. Sheet No. CWI-1.10 (If item 1) a. above can be satisfied): i. The upstream end of the culvert does not align directly with the stream channel and the downstream end of the culvert appears to outlet into a stream bank. It is reasonable to expect severe bank erosion in these areas during high flows. Please re-design the culverts to align with the up and downstream stream bed to avoid indirect impacts of erosion and sediment loading into the streams. N/A, crossing removed. ii. If slight re-alignments of the stream channel are necessary at either end of the culvert, please include proposed cross sections of the stream re-alignment, include the stream impact footprint and the proposed channel alignment on the plans, and itemize the length of stream impacted as a permanent impact (will be considered a functional loss) on the PCN; N/A, crossing removed. e. Sheet No. CWI-1.11: i. Include the location of the wetland boundaries on the profile view; Plans updated accordingly. ii. If item 1)b. above can be satisfied, please provide additional detail regarding the support structures in wetlands; structures other than driven piles may be considered a permanent impact. Further, detail/show the width of the permanently maintained corridor and associated acreage within wetlands, as we may require compensatory mitigation for such permanent conversion of wetland type if the total impacts to wetlands exceeds 0.1 acre; The proposed aerial sewer line will be supported by concrete piers, with a permanent 30-ft wide maintenance corridor. The proposed support piers were determined by the engineer as suitable supports based on subgrade conditions on-site. The piles will require manual installation. 4) The proposed wetland impacts on Sheets CW1-1.8 and CWI-1.9 include fill in the majority of these small wetland units. Given the small size of the wetlands in question, the fact that the drainage area for Wetland E2 would be rerouted due to the proposed grading (Sheet CW1- 1.8), and because site construction activities would heavily impact the remaining areas of Wetland H2 (Sheet CW1-1.9), the Corps would consider the remainder of the wetlands as an indirect loss of wetland function (per NWP General Conditions “District Engineers Decision”). As such, the proposed wetland loss due to direct and indirect impacts would include the entirety of Wetland E2, and the entirety of Wetland H2 on the south side of Stream C and the portion of Wetland H2 whose drainage area is cutoff by the proposed headwall; Wetland impacts were adjusted per additional email correspondence dated October 7th, clarifying the location of indirect loss of function. Based on the agreed upon area, the proposed project is anticipated to result in 215-sq ft of indirect loss of function impact to wetland E2 and 957-sq ft of indirect loss of function impact to wetland H2. The total combined direct permanent impact (0.06-acres), indirect wetland impact (0.03-acres), and temporary impact with wetland type conversion (utility line, 0.07- acres) for the proposed project is 0.16-acres. See Impacts Table on Sheet CWI-1.7. 5) Based on relative aquatic function, the following compensatory mitigation ratios are justified: a. 2:1 for Stream A Per additional email correspondence on October 7th, the following mitigation ratios are proposed based on relative aquatic function: • 2:1 for Stream A, with the exception of the ~75 lf of low quality channel immediately upslope of the existing culvert which is justified at 1:1; • 1:1 for permanent/indirect loss to Stream C and Wetlands E2 and H2, and permanent conversion of Wetland J b. 1:1 for permanent/indirect loss to Stream C and Wetlands E2 and H2, and permanent conversion of Wetland J; The total combined direct permanent wetland impact, indirect wetland impact, and permanent wetland type conversion (utility line) for the proposed project is 0.17-acres. Updated mitigation credit Statements of Availability and DMS Acceptance Letter are attached. Please see Sheet CWI-1.7 for an updated Impacts Table. 6) Given that the proposed project activities occur in the vicinity of resources potentially eligible for the National Register of Historic Places, I have initiated consultation with the State Historic Preservation Office; they require up to 30 days to respond to our coordination request. Please note that I cannot verify the use of any Nationwide Permit until consultation pertaining to Section 106 of the National Historic Preservation Act is complete; No response required. Please let us know if/when comments are received from the State Historic Preservation Office. Please note that this decision does not assure that participation in the DMS in- lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable.
