Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* Solomon Drive (Sheet W-1) will cross a drainageway impacting 0.098 ac of wetland and 76 LF of stream channel (impact W1 and S1). Two 51.43 LF long 42" RCP culverts will be installed in the stream. One pipe will be buried belowthe stream bed @1.94 % grade, the other pipe will be set above it to receive bankfull flow at 2.92 % grade. A rip rap dissipator will be installed at the outlet end. Wolcott Court (Sheet W-2) will cross a drainageway impacting 0.031 acre of wetland. A 55.36 LF 30" culvert will be installed at 0.9 % grade. Water and sewer utility lines will be concurrently installed in the road right-of-way. The road will be back filled at the culvert, the roadway paved, and side slopes stabilized with vegetative planting. A temporary gravel haul road will cross a wetland behind Lot 22 and is necessary to access a large open space area (OS4) for stockpiling dirt. The temporary road will impact 0.015 ac of wetland. A 38.43 LF 24" HDPE culvert will be installed at 4.42%, and the area will be backfilled for the road bed. When site grading in the subdivision is complete, the fill dirt and culvert will be removed and then the area will be returned to original grade and re -vegetated. 4j. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Lots were configured to ensure they could be developed without wetland impacts. Wetlands and streams were excluded from lots and put in open space. The road format was designed to avoid wetlands, where possible, by using cul-de-sacs and passing between wetland areas. The Solomon Dr and Wolcott Ct were each sited perpendicular to the drainageways to minimize impacts. The culvert at Solomon Dr will be buried to maintain aquatic passage and to maintain passage during drought or low flow conditions. Shoulder slopes at road crossings are 3:1 Utilities were grouped in the road right-of-way to minimize impacts. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Sediment and erosion control measures will be used, such as silt fencing, to protect water quality. Construction limits will be clearly marked through wetlands. No clearing will occur in wetlands outside of the proposed impact area. Construction and fill materials will be stored in upland areas. 2. No Critical Habitats were identified. In addition, the Bald Eagle (Haliaeetus leucocephalus) is federally protected under the Bald and Golden Eagle Protection Act. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website. Based on the information supplied by you in your request to use the DMS, the impacts for which you are requesting compensatory mitigation credit are summarized in the following table.
