Hi Carrie,
I apologize, I should have clarified when DEMLR asked about changes to crossing locations that we would be mostly
concerned with permanent crossing locations. Since the impacts are less than what was approved and the only
modifications are to S4, temporary crossing location and S7 type of temporary crossing, the Division would not require
modifications to the 401. We do always recommend that Permittees double check with us about design changes as our
approval letter states that it is only valid for the project and plans we reviewed/approved, however for small
modifications such as these we will just put the updated plans on file and not require an 401 modification.

Good afternoon -
I'm emailing you both in reference to the approved permits issued in 2019 for the Middle Fork Greenway Section #4 in
Watauga County. The project has changed in scope since the permits were issued.
The purpose of this email is to glean whether the changes warrant official permit modifications and any re -submittal.
Here are the proposed changes (the table is from the PCN originally submitted for the project):
S1- this crossing has been excluded from the current design.
S2 - this crossing has been excluded from the current design.
S3 - this crossing has been excluded from the current design.
S4 - this crossing remains in the plans but has been shifted — 50' downstream of its originally proposed position. This was
done for two reasons: 1) S5 is no longer proposed and 2) a span bridge is currently proposed at the area previously
proposed for the temporary ford crossing.
S5 - this stabilization has been excluded from the current design.
S6 - this crossing remains the same in impact length and location.
S7 - this temporary crossing remains but has been proposed as a timber mat rather than a stone ford crossing per
NCDEMLR recommendations and shifted from upstream of the proposed span crossing to downstream.
No additional stream or any wetland impacts will occur as a result of design changes; S4, S6, and S7 remain.

In a letter of disapproval dated 10/30/2020, relevant to the revised ESC planset, Ms. Tamera Eplin of NCDEMLR
Winston Salem posed the following question which prompted this email.
The 401 Certification was issued on June 28, 2014 but the scope of the work has clanged_ A
conversation between the RSC plan reviewer and the Water Qwlity Regional Operations
ration (WQP.OS) indicated a modification to the 401 Certification may be necessary if the
crossing locations changed significantly. Please verify with V QROS whether a modification
to the 401 Certification is necessary, in order to review the ESC plan for limitation of stream
and/or wetland impact, clearly label all areas of proposed and/or approved temporary and/or
permanent impact. Please summarize any discussions with the W ROS. (G.S. 113A-57(3),
15A NCAC 4B .0106, 1 SA NCAC 48.01151
A copy of the revised planset is attached to this email as well as the original PCN. Please note - S6 is now referred to as
Stream Crossing #2 and S7 is now referred to as Stream Crossing #1 on Sheet C-2. The S4 temporary crossing impact is
shown on Sheet C-2.1.
Thank you for your review of this matter and your response. Please note we are within the 15 day window for response
which began on 10/30/2020. If you are unable to respond by 11/13, please let me know so that we may alert NCDEMLR.
