Dear Mr. Futrell:

On April 4, 2007, the 401 Oversight/Express Permitting Unit of the Division of Water Quality received a request
from Mr. Todd Preuninger of Withers &Ravenel, regarding a project known as "White Oak Farms" for acceptance
into the Express Review Program. This letter advises you that your project will be accepted into the Express
Review Program once the following items are received:
1) The application fee of $4,200.00 [for 401 Water Quality Certification with major impacts and Stormwater
Management Plan ($2,000) + Riparian Buffer Authorization ($2,000) + one (1) stream determination], made
payable to the North Carolina Division of Water Quality];
2) Five (5) complete and collated copies of the PCN Application Form;
3) One (1) copy of the Addendum to the PCN;
4) Five (5) copies of all site plan information pertaining to this project (please refer to the Addendum

5) Three (3) copies of the stormwater management plan and all required information.
Please note that this Express Review acceptance is a phased acceptance (Phase I -stream determination,
Phase II - 401 + Riparian Buffer Authorization). Due to staff scheduling conflicts, the stream
determination will be accepted no sooner than April 11, 2007. Phase II of the Express Review project will
be accepted on the date that the stream determination letter is written (no later than April 18, 2007). The
clock for this project will not start until receipt of the completed application package and required fee are received.
If the impacts are greater than indicated on the Initial Interest Form and/or the services are different, you may be
required to remit an additional fee.
