DWQ definitely did not want the property and worked to reject it at the time (see attached e-
mail chain). If it hasn't already been done, will your office send a letter to the county
notifying them that the State did not accept the property and to note such rejection in the
margins of the deed that was filed? By separate e-mail, I will update Sue Hyde at the City
of Concord on the status of the property and advise her to work with the City Attorney to
obtain the needed easement to complete the sewer project.

In our letter filed on February 13, 2001, the Division of Water Quality (DWQ) requested an emergency operator for this
sewer utility. This sewer utility served 14 customers for many years before being abandoned by its operator. The existing wastewater
treatment system needs considerable maintenance and repair work and even if this work is conducted, we believe it would be difficult
for a qualified operator to keep this system in compliance with the NPDES permit requirements. We are currently attempting to
obtain municipal sewer service for these customers, which would eliminate the need for a sewer utility. Until the municipal sewer
service is available, please hold DWQ's request for an emergency operator in abeyance. If DWQ determines that an emergency
operator is needed in the future, we will contact you to restart the process of obtaining one.

Thank you for your and the City of Concord's continued attention and effort in seeking to
permanently resolve the problems associated with wastewater treatment at the Poplar Trails
Subdivision. The peculiarities surrounding this matter have made it especially difficult to
establish a responsible party that could be called on to address wastewater treatment deficiencies
at the site. The City's willingness to step forward and become actively involved in seeking a
solution is commendable.
As you know, the Poplar Trails WWTP has been abandoned for approximately five years now.
While flow from the homes it serves can be said to receive some treatment as it passes through
the system, and staff inspections in recent years have observed clear effluent being discharged,
the situation is far from being deemed acceptable. Recent studies of water quality in the area
have shown the Rocky River to be impaired in meeting the standards for its best usage. While
much of the impairment is attributed to urbanization of the region, this particular point source
discharge could be contributing to the waters' decline.
For these reasons, the Division of Water Quality is very supportive of the City of Concord's
efforts to secure funding for a sewer project that will connect the Poplar Trails subdivision to the
City's collection system and facilitate the elimination of this discharge. Such an achievement
could only be seen as a victory for everyone with a stake in the matter: the public health will be
better protected, the users of the system will have more reliable service, and the citizens of the
state will benefit from cleaner surface water. We also hope the City of Concord will see its own
rewards and benefits as this project moves from possibility to reality.

Dear Ms. Sanford:
We have been aware for several months of a sewer utility operating without a Certificate
of Public Convenience and Necessity. This public utility serves fourteen homes in the Poplar
Trails Subdivision in Cabarrus County. The current owner and operator, Mr. Jeffrey Woolard,
has been charging rates for service. This system has been operated as a public utility for many
years and suffers from legal and operational problems.
When these problems were discovered, we began working with Mr. Jay Lucas of the
Public Staff s Water and Sewer Division to develop a solution. Unfortunately, on November 30,
2000, we received a letter from Mr. Woolard stating that he will no longer operate the
wastewater treatment plant. This system has no back-up Operator In Responsible Charge
(ORC).
Please appoint an emergency ORC for this system and establish rates to recover all
expenses. If you have any question, please contact Mr. Rex Gleason or Ms. Linda Love of our
Mooresville Regional Office at [phone].

On December 23, 1999, the Division of Water Quality issued NPDES permit NCO061786
in your name for the discharge of treated wastewater form the Poplar Trails Subdivision WWTP.
The permit was issued to you pursuant to your request following your acquisition of the
wastewater treatment plant from Donna L. Current. An unusual aspect of this reissuance was
that, due to the timing of the change in ownership, the coverage conferred by the permit actually
expired prior to the permit being issued in your name. Within the reissuance transmittal letter,
you were informed of this fact and instructed to submit the proper documents that would have
the permit renewed. To date, the Division has not received your renewal package.
The purpose of this letter is to remind you of your obligation to properly renew the
subject permit. The Division is aware of the problems you face in operating this facility;
however, it is unquestionable that as owner, you are responsible for all aspects of its oversight,
including the need to hold a valid, active permit. Enclosed please find a renewal application for
the subject permit, as well as a checklist for preparation of the renewal package. These items
should be completed and returned to the attention of Ms. Christie Jackson at the letterhead
address within 30 days of their receipt. No fee is required for the processing of the renewal
application.

As owner of the facility, you are also required to pay a $715.00 annual compliance and
monitoring fee associated with the permit. An invoice for this fee was mailed to you on
November 11, 1999, but the fee has not yet been paid. Again, the Division is aware that you
claim paying this fee is a financial burden on you. We would like to point out that payment of
such fees is a requirement of all the State's NPDES permittees. To resolve this matter, the
Division expects payment to be received from you within 30 days of your receipt of this letter.
We have reviewed the minutes of a May 5, 2000 meeting that was attended by various
parties affected by and interested in the Poplar Trails Subdivision's wastewater situation. We are
encouraged by what appears to be a better understanding on behalf of all parties as to the nature
of the problems and their potential solutions. Some of the positive items we noted arising from
this meeting were:
• The willingness of the system users to pay higher fees for their sewer service.
• One time payments to be made by system users that will resolve the matter of the annual
fee.
• Your commitment to continue operating the treatment plant for 12 months.
• Commitments by representatives of both the State and the City of Concord to attempt to
secure funding that would pay for connecting the Poplar Trails system to City of
Concord's collection system.
The points noted above make us feel that progress is being made in this matter. For our
part, the Division will continue to make efforts that hopefully will lead to a permanent solution
for all those involved. In the interim, we will assist you as best we can, but we must insist that
you meet the responsibilities of all NPDES permittees, including proper operation of the plant,
renewal of the permit and payment of required fees. The Division will expedite processing of
the renewal and the fee payment if you will take the initial steps in an expeditious manner.
As you are obviously aware, there are potential liabilities associated with owning a
wastewater treatment plant, as there are with holding a permit for wastewater treatment and
discharge. Unfortunately, we feel obliged to remind you that state law and Division policy
mandate certain consequences for failing to meet permit requirements. Recognizing this is a
complex situation with problems that will not be resolved overnight, we take no pleasure in
making this statement; however, we would also point out that you have the power to ensure that
such steps do not need to be taken. In summary, promptly renew the permit and pay the annual
fee and a significant amount of regulatory liability can be minimized.

On December 23, 1999, the Division of Water Quality issued NPDES permit NCO061786
in your name for the discharge of treated wastewater form the Poplar Trails Subdivision WWTP.
The permit was issued to you pursuant to your request following your acquisition of the
wastewater treatment plant from Donna L. Current. An unusual aspect of this reissuance was
that, due to the timing of the change in ownership, the coverage conferred by the permit actually
expired prior to the permit being issued in your name. Within the reissuance transmittal letter,
you were informed of this fact and instructed to submit the proper documents that would have
the permit renewed. To date, the Division has not received your renewal package.
The purpose of this letter is to remind you of your obligation to properly renew the
subject permit. The Division is aware of the problems you face in operating this facility;
however, it is unquestionable that as owner, you are responsible for all aspects of its oversight,
including the need to hold a valid, active permit. Enclosed please find a renewal application for
the subject permit, as well as a checklist for preparation of the renewal package. These items
should be completed and returned to the attention of Ms. Christie Jackson at the letterhead
address within 30 days of their receipt. No fee is required for the processing of the renewal
application.

As owner of the facility, you are also required to pay a $715.00 annual compliance and
monitoring fee associated with the permit. An invoice for this fee was mailed to you on
November 11, 1999, but the fee has not yet been paid. Again, the Division is aware that you
claim paying this fee is a financial burden on you. We would like to point out that payment of
such fees is a requirement of all the State's NPDES permittees. To resolve this matter, the

regarding the Poplar Trails Subdivision permit. The subject permit expired on September 30, 1999.
As of the date of the phone conversation there had been no request for renewal of the permit, and
the annual permit fee of $715.00 had not been paid. It is the recommendation of this Office that the
subject facility be issued a Notice of Violation and Recommendation for Enforcement for operating
a wastewater treatment facility without the proper NPDES permit.
It is acknowledged that the subject facility is experiencing problems with the owner/operator.
This Office has directed the permittee to the Technical Assistance and Certification Unit for help,
but that does not absolve the permittee of his/her permit responsibilities.

provide sewer service to many others in the area.

The operator of the wastewater treatment plant that serves your home has indicated that
he may abandon the plant and discontinue its operation. He has also indicated that he is willing
to transfer the plant to anyone who will take it. The plant is in need of repair and its discharge
permit has expired but will still be in effect. This situation is serious because wastewater from
your home may be improperly treated before being illegally discharged into the stream beside
Blackberry Trail. Proper wastewater treatment and disposal is essential to protect human health
and the environment. The current situation cannot continue.
Fourteen homes in your neighborhood depend on this system for wastewater treatment
and disposal. Several alternatives exist to remedy this situation and are as follows:
1. The homeowners can form an association and transfer the assets and permits to the
homeowner's association, which would have to hire a plant operator. All
homeowners using the plant must join the association, which would then qualify for
deregulation by the Utilities Commission.
2. The operator can transfer the assets and the discharge permit to a utility company for
operation and maintenance. The utility company will have to recover its costs
through the sewer user fees.

3. The Utilities Commission or the Division of Water Quality can appoint an emergency
operator and set sewer rates to pay for the required improvements and services.
I am currently in discussion with the City of Concord on the possibility of extending their
sewer collection system to your area.

Enclosed please find a copy of the Compliance Evaluation Inspection Report for the
inspection conducted at the subject facility on October 18, 2000 by Ms. Linda Love of this
Office. It is important that you thoroughly read the report and, especially, this cover letter,
which not only summarizes violations of the subject permit, regulations, and state law, but
discusses needed actions and some options available to you. If you do not understand this
letter, or otherwise have questions, please do not hesitate to contact either Ms. Love,
Richard Bridgeman, or me at 704/663-1699.
As you are well aware, the subject permit and the operation and maintenance of the
wastewater treatment facility have been under close examination for several months. Although
the transaction had occurred several months earlier, the subject permit was officially transferred
to you on December 23, 1999, with a notification that the permit had expired on September 30,
1999. Enclosed with the permit modification for the ownership change was a renewal
application and a checklist for preparation of the permit renewal package. To date, no renewal
application has been received by the Division.
On October 5, 2000, you were assessed a civil penalty of $3,500.00 (LR 00-008) for
failure to submit the April, May, June, and July 2000 discharge monitoring reports. You were

required to within thirty days of receipt of the civil penalty notice to either: 1) submit payment of
the penalty, 2) submit a written request for remission or mitigation, or 3) submit a written request
for an administrative hearing. It is our understanding that you failed to exercise any of these
options. Please be aware that the Division will refer the matter to the Attorney General's Office,
with a request to initiate a civil action to collect the penalty. You should also be aware, based on
your review of Case LR 00-008, that the civil penalty assessment for each subsequent month's
failure to submit the discharge monitoring report may be double the assessment of the previous
month. If the required monitoring, or any portion of the required monitoring, was conducted for
the months since March 2000, it would be in your best interest to immediately contact the
Division with your intent to submit the missing discharge monitoring reports.
It is our understanding that you, as the owner/permittee of the subject facility, have failed
to properly designate an Operator in Responsible Charge (ORC) and a Back-up ORC. This
failure is a violation of T15A NCAC 8A .0202(a)(1) and the subject permit. We are aware that
you are functioning as the ORC for this facility.
In addition to designating an ORC and Back-up ORC, as the permittee you are required to
insure the wastewater treatment facility is properly operated and maintained at all times. For this
facility, the ORC is required to visit a minimum of once per week, but as often as necessary to
insure the proper operation of the facility. The permit also includes minimum monitoring
requirements. The enclosed report documents that the facility is not receiving the necessary
operation and maintenance. We have to assume that the minimum required effluent and stream
monitoring is not being conducted, since the required self -monitoring reports are not being
submitted.
We understand and appreciate the situation in which you find yourself. As a certified
operator, you must be aware of the disciplinary actions at the disposal of the Water Pollution
Control System Operators Certification Commission. As the permittee, you need to be aware of
the civil and criminal enforcement procedures included in the North Carolina General Statutes.
You have already been assessed a civil penalty; other enforcement actions are probable.
The probability of continued enforcement actions is why it is essential that you
communicate with us, by responding in writing to this report, by giving us a telephone number at
which you can be reached, and by responding to our telephone calls and letters immediately. The
situation can only be resolved with your full cooperation and participation. Following are some
actions which you need to immediately take:
■ You need to immediately and appropriately respond to the civil penalty assessment (Case
No. LR 00-008); we can assure you that, while there is a chance for a settlement, you
should not allow the Division to refer the matter of collection to the Attorney General's
Office.

■ If self -monitoring since March 2000 was conducted, you need to submit completed
DMR's.
■ You need to immediately submit a completed NPDES permit renewal application.
■ You need to immediately address the invoice for the annual compliance and monitoring
fee ($715.00). We are aware that the Poplar Trails Subdivision homeowners gave you
money specifically to pay this fee on May 5, 2000.
■ You need to contact this Office and advise us of the frequency of your visits to the facility
and of your self -monitoring and operation and maintenance activities.
■ You need to complete and submit the enclosed Water Pollution Control System
Designation Form.
■ Although you made certain commitments at the referenced May 5, 2000 meeting, based
on your stated desire to sell or otherwise transfer ownership of the wastewater treatment
plant and NPDES permit to someone, it is recommended that you contact area utility
companies, such as Heater Utilities, Carolina Water Service, AquaSource, or even the
Cabamis County Water and Sewer Authority.
It is very important that you realize the seriousness of your situation. You need to
establish and maintain contact with us. It is requested that a written response be submitted to this
Office by December 1, 2000, addressing the deficiencies noted in this cover letter and the
attached Compliance Evaluation Inspection Report. In responding, please address your
comments to the attention of Mr. Richard Bridgeman. Again, should you have questions, please

Poplar Trails WWTP

The facility was last inspected by Mr. Roberto Scheller of this Office on July 27, 1999.
The current inspector made several attempts to contact the permittee/ORC prior to the inspection.
PERMIT
The permitted facility is a 0.0056 MGD wastewater treatment plant consisting of a septic
tank, surface sand filter, chlorine contact chamber with tablet disinfection, dechlorination, and
cascade aeration.
The current permit became effective on December 8, 1998 and expired on September 30,
1999. A permit modification to reflect an ownership change was issued on December 23,1999.
No permit renewal package has been submitted; therefore the facility -is currently operating
without a permit.
RECORDS AND REPORTS
No records and reports were available during the inspection. Records and reports
reviewed in the office include monthly self -monitoring reports, chain -of -custody forms, and
laboratory forms. No self -monitoring reports have been submitted since the one for March 2000.
FACILITY SITE REVIEW/OPERATIONS & MAINTENANCE
All processes/units of the treatment plant were inspected, with the exception of the
chlorine contact chamber, which is located in a locked fenced area. The plant appeared to be
marginally maintained. The wall around the filter bed was cracked. Numerous distribution lines
were unlevel and broken in the filter bed allowing inadequate distribution and treatment of the
wastewater. No tablets were observed in the dechlorinator. These deficiencies have been noted
numerous times in past inspection reports. The vegetation growing on the filter bed, and brush
and trees growing around the filter bed (mentioned in previous reports) are no longer present due
to the adjoining property owner's efforts to mow and keep the vegetation out of the filter bed.
According to the NPDES permit, Part II, Section C, the permittee shall at all times
properly operate and maintain all facilities and systems of treatment and control (and
related appurtenances) which are installed or used by the permittee to achieve compliance
with the conditions of the permit.
The facility is owned and operated by a Grade II operator (the Operator -in -Responsible
Charge). No back-up ORC has been officially designated nor has an ORC change form been
submitted for the facility since 1996. The ORC was not available during the inspection.

FLOW MEASUREMENT
It is unknown what method is used to measure effluent flow.
LABORATORY
The contract laboratory for the subject facility is Water Tech Labs in Granite Falls, North
Carolina. The laboratory was not evaluated during this inspection.
EFFLUENT/RECEIVING WATERS
The effluent appeared clear with no visible solids or foam on the -day of inspection. The
receiving stream, an unnamed tributary to Rocky River (a Class C water), which is part of the
Yadkin -Pee Dee River Basin, was not evaluated.
SELF -MONITORING PROGRAM
Self -monitoring reports (DMRs) were reviewed for the period June 1999 through March
2000. Monthly monitoring reports have not been submitted since March 2000. A civil penalty
has been assessed for the failure to submit self -monitoring reports. Monthly monitoring reports
are not completed correctly, as follows:
The back of the Effluent form had not been submitted with the July, October and
November 1999, and January, February, and March 2000 DMRs. The compliant box was
checked when the facility was actually in non-compliance. Total Residual Chlorine
values were reported as zero; the values should have been reported as "less than" the
lowest detection level.
Monitoring violations are as follows:
BOD, TSR, Ammonia Nitrogen, and Fecal Coliform results were not reported in July.
Upstream and downstream sampling was not done weekly in March 2000.
Limit violations reported during the review period are as follows:

Please be advised that pursuant to Part II, Section E of your NPDES permit, and North
Carolina Administrative Code (NCAC) 15A 2B .0506 (a)(2), any failure of a collection system,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the central office or the appropriate regional office
(Mooresville Regional Office 704-663-1699) as soon as possible but no later than 24 hours from
the time the permittee became aware of the -bypass. A written report shall also be provided within
five (5) days of the time of the incident. The written report shall contain a description of the
bypass, and its cause; the period of the bypass, including exact dates and times, and if the bypass
has not been corrected, the anticipated time it is expected to continue; and steps taken (or
planned) to reduce, eliminate, and prevent recurrence of similar events.
Any spill that reaches surface waters (i.e. any spill that reaches any water already present
in a conveyance, stream, ditch, etc...) or any spill greater than 1,000 gallons on the ground that
does not reach surface waters must be reported.
An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if a fish
kill occurred. The evaluation should also include the collection of upstream dissolved oxygen
and pH measurements for background information and dissolved oxygen and pH measurements
at multiple points downstream of the entry point to document any negative impact. Failure to
report the bypass of a collection system, pumping station or treatment facility subjects violators
to penalties of up to $25,000 per day per violation.

Attached is a suggested letter to the North Carolina Utilities Commission regarding
emergency operation for the Poplar Trails Subdivision WWTP. The MRO received a letter on
November 30, 2000 from the ORC/Owner-Permittee (Jeffrey S. Woolard) stating that he would
no longer operate the wastewater treatment plant. Linda Love contacted Mr. Woolard in
December and he stated that he had sent the title for the property, via the Register of Deeds, to
the North Carolina DENR. It is our belief that the WWTP (septic tank, sandfilter, chlorine
disinfection unit, and dechlorination unit) has not been operated since the beginning of October
2000.
The attached letter was prepared by Jay Lucas with the NC Utilities Public Staff. Mr.
Lucas recommends our agency submit this letter (or a similar one) to the NC Utilities
Commission, which will then establish rates and appoint an emergency ORC for the system.
The following is a partial history of the facility:
• The facility was owned by the subdivision developer, who passed it on to his son (Wilfred O.
Hawes), when he died. There are 14 homes on the facility (all other homes in the
development are on individual septic systems).
• The son contracted with an ORC, Glenn Current, who didn't operate the facility correctly,
resulting in several enforcement actions. As a result of the enforcement actions, the son
transferred ownership of the WWTP/property to Donna Current. Glenn Current remained the
ORC.
• Glenn Current was convicted of falsifying data and lost his ORC certification. He in turn
gave the title to Mr. Woolard, who is also a certified operator.

• A modified (to reflect the ownership change) permit was issued to Mr. Woolard on December
23,1999. The permit cover letter indicated that the permit had expired on September 30,
1999 and indicated what Mr. Woolard needed to do toward renewal of the permit. Mr.
Woolard operated under an expired permit until October 2000, when he went to the Register
of Deeds office and signed the title over to the NCDENR and sent it to Raleigh. To our
knowledge no one has seen this title. Mr. Woolard has been very difficult to contact.
The facility needs maintenance and operation. The utilities commission will appoint a
temporary ORC and set up a fee schedule for the homeowners. What do you advise us to do at
the Regional Office level? The facility has an expired permit with limits that will be difficult to
meet and apparently no responsible person to request a permit renewal or an SOC.

We have been aware for several months of a sewer utility operating without a Certificate
of Public Convenience and Necessity. This public utility serves fourteen homes in the Poplar
Trails Subdivision in Cabarrus County. The current owner and operator, Mr. Jeffrey Woolard,
has been charging rates for service. This system has been operated as a public utility for many
years and suffers from legal and operational problems.
When these problems were discovered, we began working with Mr. Jay Lucas of the
Public Staff s Water & Sewer Division to develop a solution. Unfortunately, on November 30,
2000, we received a letter from Mr. Woolard stating that he will no longer operate the
wastewater treatment plant. This system has no back-up Operator-In-Resposible Charge (ORC).
Please appoint an emergency ORC for this system and establish rates to recover all

Thanks. We sent Mr. Woolard a $3,500 civil penalty last Friday for failing
to submit DMRs. We'd resisted taking the action for a while because we were
trying to coax Mr. Woolard into staying on at the WWTP and not abandoning
it. Now we just can't tell what's going on and the penalty was hoped to
spur some action. If it runs him off, some folks are of the opinion, "so be
it."
I'm glad you're visiting the site. If you can, I'd appreciate a quick note
regarding what you see. If there's action that needs to be taken, I'll try
to coordinate with you so we can move quickly on the matter.

Mr. Weaver, I am resident of Poplar Trails Subdivision, and connected to
the Waste treatment facility thereof. In June we were advised that Jeff
Woolard had not applied for the permit to continue operating the facility,
and the possibility of the plant being closed done. The 14 residents on this
system gave him the money needed to pay for the permit. In Aug we were told
he still had not applied for the permit. Could you please let me know if
this has been taken care of. We are all very concerned about the lack of

Poplar Trails Subdivision
Cabarrus County
The subject permit expires on September 30, 1999. North Carolina General Stature 143.215.1(c) requires that an
application for permit renewal be filed at least 180 days prior to the expiration date.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later than April 3,
1999. Failure to request renewal by April 3, 1999 will result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after September 30, 1999 (or if continuation of the permit is desired), the
permit must not be allowed to expire. Operation of waste treatment works or continuation of a discharge after
September 30, 1999 would violate NCGS 143-215.1 and could result in assessment of civil penalties of up to $10,000
per day.
If all wastewater discharge has ceased at the subject facility and you wish to rescind this permit. contact Robert
Farmer of the Division's Compliance Enforcement unit at [phone], extension 531. You may also contact the
Mooresville Regional Office at [phone] to begin the rescission process.
Use the enclosed checklist to complete your renewal package. The checklist identifies the items which you must
submit when applying for renewal of the subject permit.

The following items are REQUIRED for all renewal packages:
❑A cover letter requesting the renewal and documenting any changes at the facility
since issuance of the last permit. Submit one signed original and two copies.
❑The completed application form (copy attached), signed by the permittee or an
Authorized Representative. Submit one signed original and two copies.
❑If an Authorized Representative is preparing the renewal package, documentation
must be provided from the permittee defining the person or company preparing the
renewal package as an Authorized Representative (see Part II.B.11.b. of the
current NPDES permit).
❑A narrative description of the sludge management plan at the subject facility. If
your facility has no sludge management plan, explain the reason for this in your
cover letter. Submit one original and two copies.
The following item applies ONLY to Industrial facilities which discharge process
wastewater
❑ Industrial facilities classified as Primary Industries (listed in Appendix A of Title 40
of the Code of Federal Regulations, Part 122) must submit a Priority Pollutant
Analysis (PPA) in accordance with 40 CFR Part 122.21.
The PPA requirement does NOT apply to municipal or non -industrial facilities.

Changes to the NPDES permit fee schedule took efffect on January 1, 1999.

SUBJECT: Decertification of Wastewater Operation Licence
On July 27, 1999, a Compliance Evaluation Inspection was conducted by Mr. Roberto L.
Scheller at the Popular Trails Subdivision wastewater treatment facility. During the inspection it was
discovered that monthly discharge monitoring reports (DMRs), for the months of May and June
1999, had been falsified. Attached to this memo is a copy of the memo and information packet that
was submitted to Ms. Coleen Sullins on September 13, 1999, regarding the DMRs in question.
During the time that we suspected falsification was occurring Mr. Glenn Current was the
Operator in Responsible Charge (ORC). Since submittal of the memo and information packet to
Coleen, Mr. Current has been charged with and entered a guilty plea in Cabarrus County Superior
Court (July 10, 2000) to two (2) counts of falsification of records. It is therefore, the
recommendation of this Office that Mr. Glenn Current's Grade II operators certification
(Certification No. 9427) be revoked. Please note that the trial date for Mr. Current has been moved
from July 10, 2000, to August 7, 2000.

Per your request I'm forwarding a copy of proof of employment with Test America(
4-24-99 to 4-30-99 )_My duties with them were to collect samples at the customer's
required locations, fill out a COC, then deliver them to the lab in Charlotte NC., within
the allotted hold times.
At I to time Was I required to do any state required sampling for Test America or
Glen Current. I was asked by an employee of Test America to pull samples at Poplar
Trails between 4-22-99 & 4-28-99. Please find copies of this also enclosed. This was
the only agreement made between myself, Test America, or Glen Current to my
knowledge, and no other Test America sampling was done at this site after 4-28-99. To
my knowledge no arrangements were made for sampling beyond this date.

normal TOT is 5-7 days and therefore our clients have their data in

This facility was last inspected by Mr. Wes Bell of this Office on January 7, 1999.
The permit was issued September 7, 1994, and became effective on October 1, 1994. The
subject permit expires on September 30, 1999.
FACILITY SITE REVIEW/OPERATIONS AND MAINTENANCE:
1. The wastewater treatment system (0.0056 MGD permitted flow) consists of a septic tank,
surface sand filter, chlorine contact chamber with tablet disinfection, and cascade aeration.
3. The WWTP discharges into an unnamed tributary to Rocky River which is classified as Class
C waters in the Yadkin -Pee Dee River Basin.
3. The subject facility appeared to be poorly maintained and the following deficiencies were
noted at the time of the inspection.
Deficiencies:
■ Vegetation was growing on the filter bed.
■ Under brush and trees were arowina around filter bed.
■ The wall around the filter bed was cracked with broken blocks.
uLateral distribution lines were not level thereby inhibiting flow along the entire length of
the distribution lines.
■One of the distribution lines was broken on the outside of the filter bed allowing flow to
bypass the treatment unit.
Regulatory Requirement: According to the NPDES permit, Part II, Section C, the
perm ittee shall at all times properly operate and maintain all facilities and systems
of treatment and control (and related appurtenances) which are installed or used by
the permute-- to achieve compliance with the conditions of the permit.

The daily logs and records were reviewed for the subject facility. The operator maintains an
operator's log to record monitoring requirements and daily visits to the treatment facility. The
operator initials the log after each visit as required.
Deficien cv:
■T"nermometer used formeasuring temperature is not being documented as being checked
annually with a NIST traceable certified thermometer.
Regulatory Requirement: Pursuant to Title 15A NCAC 2H. 0805 (a)(7)(0), all
thermometers must meet National Institute of Standards (MIST) specifications for
accuracy or be checked against a NIST traceable thermometer and proper corrections
made. Documentation of the thermometer check and temperature carrection should
be maintained.
SELF -MONITORING PROGRAMS:
1. Self -monitoring reports were reviewed for the period April 1998 through March 1999,
inclusive. It was noted during the file review that the April and May 1999 Discharge Monitoring
Reports (DMRs) have not been received by Central Files. A civil penalty (Case LR 99-009) has
been assessed against the previous owners/operators of the facility.

i. The laboratory utilized by the subject facility is Statesville Analytical (Certification #440)
in Statesville, North Carolina. Samples appear to be shipped on ice and are meeting the required
holding times.
2. The laboratory was not evaluated during this inspection.
FLOW MEASUREMENT:
Flow is being measured with a bucket and stop watch "in accordance with permit
requirements.
EFFLUENT/RECEiVING STREAM:
1. Evaluation of effluent quality at the time of inspection revealed the following:
- The effluent was clear with few visible suss_ ended solids.
- Temperature 25.7 ° Celsius
- pH 7.27 s.u.
- D.O. 0.32 mJl
- Total Residual Chlorine (TRC) 1.30 mJl
Deficiency:
sThe TRC at the time of inspection was found to be high (1.30 mg/1). The permitted limit
for this facility is 17 ug/l. Please make the necessary modifications to keep TRC
concentrations as low as possible, while still complying with the Fecal Coliform limits.
2. The receiving stream did not appear to be negatively impacted by the discharge. Grab
samples were collected at the time of the inspection and analysis will be forwarded under separate
cover.
SLUDGE DISPOSAL:
1. Septage is removed annually by Massey Septic Tank Service and is disposed/treated at the
Rocky River WWTP in Concord.
