If it hasn't already been done, will your office send a letter to the county notifying them that the State did not accept the property and to note such rejection in the margins of the deed that was filed? By separate e-mail, I will update Sue Hyde at the City of Concord on the status of the property and advise her to work with the City Attorney to obtain the needed easement to complete the sewer project. This sewer utility served 14 customers for many years before being abandoned by its operator. The existing wastewater treatment system needs considerable maintenance and repair work and even if this work is conducted, we believe it would be difficult for a qualified operator to keep this system in compliance with the NPDES permit requirements. We are currently attempting to obtain municipal sewer service for these customers, which would eliminate the need for a sewer utility. Until the municipal sewer service is available, please hold DWQ's request for an emergency operator in abeyance. The peculiarities surrounding this matter have made it especially difficult to establish a responsible party that could be called on to address wastewater treatment deficiencies at the site. The City's willingness to step forward and become actively involved in seeking a solution is commendable. As you know, the Poplar Trails WWTP has been abandoned for approximately five years now. While flow from the homes it serves can be said to receive some treatment as it passes through the system, and staff inspections in recent years have observed clear effluent being discharged, the situation is far from being deemed acceptable. Recent studies of water quality in the area have shown the Rocky River to be impaired in meeting the standards for its best usage. While much of the impairment is attributed to urbanization of the region, this particular point source discharge could be contributing to the waters' decline. For these reasons, the Division of Water Quality is very supportive of the City of Concord's efforts to secure funding for a sewer project that will connect the Poplar Trails subdivision to the City's collection system and facilitate the elimination of this discharge. Such an achievement could only be seen as a victory for everyone with a stake in the matter: the public health will be better protected, the users of the system will have more reliable service, and the citizens of the state will benefit from cleaner surface water. When these problems were discovered, we began working with Mr. Jay Lucas of the Public Staff s Water and Sewer Division to develop a solution. The permit was issued to you pursuant to your request following your acquisition of the wastewater treatment plant from Donna L. Current. An unusual aspect of this reissuance was that, due to the timing of the change in ownership, the coverage conferred by the permit actually expired prior to the permit being issued in your name. Within the reissuance transmittal letter, you were informed of this fact and instructed to submit the proper documents that would have the permit renewed. To date, the Division has not received your renewal package. The purpose of this letter is to remind you of your obligation to properly renew the subject permit. The Division is aware of the problems you face in operating this facility; however, it is unquestionable that as owner, you are responsible for all aspects of its oversight, including the need to hold a valid, active permit. Enclosed please find a renewal application for the subject permit, as well as a checklist for preparation of the renewal package. It is important that you thoroughly read the report and, especially, this cover letter, which not only summarizes violations of the subject permit, regulations, and state law, but discusses needed actions and some options available to you. It is our understanding that you failed to exercise any of these options. Please be aware that the Division will refer the matter to the Attorney General's Office, with a request to initiate a civil action to collect the penalty. You should also be aware, based on your review of Case LR 00-008, that the civil penalty assessment for each subsequent month's failure to submit the discharge monitoring report may be double the assessment of the previous month. It is our understanding that you, as the owner/permittee of the subject facility, have failed to properly designate an Operator in Responsible Charge (ORC) and a Back-up ORC. This failure is a violation of T15A NCAC 8A .0202(a)(1) and the subject permit. We are aware that you are functioning as the ORC for this facility. In addition to designating an ORC and Back-up ORC, as the permittee you are required to insure the wastewater treatment facility is properly operated and maintained at all times. For this facility, the ORC is required to visit a minimum of once per week, but as often as necessary to insure the proper operation of the facility. The permit also includes minimum monitoring requirements. The enclosed report documents that the facility is not receiving the necessary operation and maintenance. We have to assume that the minimum required effluent and stream monitoring is not being conducted, since the required self -monitoring reports are not being submitted. We understand and appreciate the situation in which you find yourself. As a certified operator, you must be aware of the disciplinary actions at the disposal of the Water Pollution Control System Operators Certification Commission. As the permittee, you need to be aware of the civil and criminal enforcement procedures included in the North Carolina General Statutes. You have already been assessed a civil penalty; other enforcement actions are probable. The probability of continued enforcement actions is why it is essential that you communicate with us, by responding in writing to this report, by giving us a telephone number at which you can be reached, and by responding to our telephone calls and letters immediately. The situation can only be resolved with your full cooperation and participation. Following are some actions which you need to immediately take: ■ You need to immediately and appropriately respond to the civil penalty assessment (Case No. LR 00-008); we can assure you that, while there is a chance for a settlement, you should not allow the Division to refer the matter of collection to the Attorney General's Office. It is very important that you realize the seriousness of your situation. You need to establish and maintain contact with us. The current inspector made several attempts to contact the permittee/ORC prior to the inspection. PERMIT The permitted facility is a 0.0056 MGD wastewater treatment plant consisting of a septic tank, surface sand filter, chlorine contact chamber with tablet disinfection, dechlorination, and cascade aeration. The current permit became effective on December 8, 1998 and expired on September 30, 1999. A permit modification to reflect an ownership change was issued on December 23,1999. No permit renewal package has been submitted; therefore the facility -is currently operating without a permit. RECORDS AND REPORTS No records and reports were available during the inspection. Records and reports reviewed in the office include monthly self -monitoring reports, chain -of -custody forms, and laboratory forms. No self -monitoring reports have been submitted since the one for March 2000. FACILITY SITE REVIEW/OPERATIONS & MAINTENANCE All processes/units of the treatment plant were inspected, with the exception of the chlorine contact chamber, which is located in a locked fenced area. The plant appeared to be marginally maintained. The wall around the filter bed was cracked. Numerous distribution lines were unlevel and broken in the filter bed allowing inadequate distribution and treatment of the wastewater. No tablets were observed in the dechlorinator. These deficiencies have been noted numerous times in past inspection reports. The vegetation growing on the filter bed, and brush and trees growing around the filter bed (mentioned in previous reports) are no longer present due to the adjoining property owner's efforts to mow and keep the vegetation out of the filter bed. According to the NPDES permit, Part II, Section C, the permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of the permit. The facility is owned and operated by a Grade II operator (the Operator -in -Responsible Charge). No back-up ORC has been officially designated nor has an ORC change form been submitted for the facility since 1996. The ORC was not available during the inspection. Poplar Trails WWTP NPDES Permit No. NCO061786 FLOW MEASUREMENT It is unknown what method is used to measure effluent flow. LABORATORY The contract laboratory for the subject facility is Water Tech Labs in Granite Falls, North Carolina. The laboratory was not evaluated during this inspection. EFFLUENT/RECEIVING WATERS The effluent appeared clear with no visible solids or foam on the -day of inspection. The receiving stream, an unnamed tributary to Rocky River (a Class C water), which is part of the Yadkin -Pee Dee River Basin, was not evaluated. SELF -MONITORING PROGRAM Self -monitoring reports (DMRs) were reviewed for the period June 1999 through March 2000. Monthly monitoring reports have not been submitted since March 2000. A civil penalty has been assessed for the failure to submit self -monitoring reports. Monthly monitoring reports are not completed correctly, as follows: The back of the Effluent form had not been submitted with the July, October and November 1999, and January, February, and March 2000 DMRs. The compliant box was checked when the facility was actually in non-compliance. Total Residual Chlorine values were reported as zero; the values should have been reported as "less than" the lowest detection level. Monitoring violations are as follows: BOD, TSR, Ammonia Nitrogen, and Fecal Coliform results were not reported in July. Upstream and downstream sampling was not done weekly in March 2000. Limit violations reported during the review period are as follows: DO below limit on January 12, 27, & 31, February 9, 17, 23, & 29, and March 10, 12, 23, & 30, 2000 TRC daily maximum limit exceeded on July 27,1999 Ammonia Nitrogen monthly average limit exceeded in December, 1999 Poplar Trails WWTP NPDES Permit No. NCO061786 SLUDGE DISPOSAL It is not known if sludge is being removed from the subject facility or by whom. SEWER OVERFLOW Please be advised that pursuant to Part II, Section E of your NPDES permit, and North Carolina Administrative Code (NCAC) 15A 2B .0506 (a)(2), any failure of a collection system, pumping station or treatment facility resulting in a bypass without treatment of all or any portion of the wastewater shall be reported to the central office or the appropriate regional office (Mooresville Regional Office 704-663-1699) as soon as possible but no later than 24 hours from the time the permittee became aware of the -bypass. A written report shall also be provided within five (5) days of the time of the incident. The written report shall contain a description of the bypass, and its cause; the period of the bypass, including exact dates and times, and if the bypass has not been corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce, eliminate, and prevent recurrence of similar events. Any spill that reaches surface waters (i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc...) or any spill greater than 1,000 gallons on the ground that does not reach surface waters must be reported. An adequate spill response for those spills reaching surface waters should include an evaluation downstream of the point at which the spill entered surface waters to determine if a fish kill occurred. The evaluation should also include the collection of upstream dissolved oxygen and pH measurements for background information and dissolved oxygen and pH measurements at multiple points downstream of the entry point to document any negative impact. The MRO received a letter on November 30, 2000 from the ORC/Owner-Permittee (Jeffrey S. Woolard) stating that he would no longer operate the wastewater treatment plant. Linda Love contacted Mr. Woolard in December and he stated that he had sent the title for the property, via the Register of Deeds, to the North Carolina DENR. It is our belief that the WWTP (septic tank, sandfilter, chlorine disinfection unit, and dechlorination unit) has not been operated since the beginning of October 2000. The attached letter was prepared by Jay Lucas with the NC Utilities Public Staff. Mr. Lucas recommends our agency submit this letter (or a similar one) to the NC Utilities Commission, which will then establish rates and appoint an emergency ORC for the system. The following is a partial history of the facility: • The facility was owned by the subdivision developer, who passed it on to his son (Wilfred O. Hawes), when he died. There are 14 homes on the facility (all other homes in the development are on individual septic systems). • The son contracted with an ORC, Glenn Current, who didn't operate the facility correctly, resulting in several enforcement actions. As a result of the enforcement actions, the son transferred ownership of the WWTP/property to Donna Current. Glenn Current remained the ORC. • Glenn Current was convicted of falsifying data and lost his ORC certification. He in turn gave the title to Mr. Woolard, who is also a certified operator. Poplar Trails WWTP Page Two • A modified (to reflect the ownership change) permit was issued to Mr. Woolard on December 23,1999. The permit cover letter indicated that the permit had expired on September 30, 1999 and indicated what Mr. Woolard needed to do toward renewal of the permit. Mr. Woolard operated under an expired permit until October 2000, when he went to the Register of Deeds office and signed the title over to the NCDENR and sent it to Raleigh. To our knowledge no one has seen this title. Mr. Woolard has been very difficult to contact. The facility needs maintenance and operation. The utilities commission will appoint a temporary ORC and set up a fee schedule for the homeowners. What do you advise us to do at the Regional Office level? Scheller at the Popular Trails Subdivision wastewater treatment facility. During the inspection it was discovered that monthly discharge monitoring reports (DMRs), for the months of May and June 1999, had been falsified. Attached to this memo is a copy of the memo and information packet that was submitted to Ms. Coleen Sullins on September 13, 1999, regarding the DMRs in question. During the time that we suspected falsification was occurring Mr. Glenn Current was the Operator in Responsible Charge (ORC). Since submittal of the memo and information packet to Coleen, Mr. Current has been charged with and entered a guilty plea in Cabarrus County Superior Court (July 10, 2000) to two (2) counts of falsification of records. It is therefore, the recommendation of this Office that Mr. Glenn Current's Grade II operators certification (Certification No. 9427) be revoked. The permit was issued September 7, 1994, and became effective on October 1, 1994. The subject permit expires on September 30, 1999. FACILITY SITE REVIEW/OPERATIONS AND MAINTENANCE: 1. The wastewater treatment system (0.0056 MGD permitted flow) consists of a septic tank, surface sand filter, chlorine contact chamber with tablet disinfection, and cascade aeration. 3. The WWTP discharges into an unnamed tributary to Rocky River which is classified as Class C waters in the Yadkin -Pee Dee River Basin. 3. The subject facility appeared to be poorly maintained and the following deficiencies were noted at the time of the inspection. Deficiencies: ■ Vegetation was growing on the filter bed. ■ Under brush and trees were arowina around filter bed. ■ The wall around the filter bed was cracked with broken blocks. uLateral distribution lines were not level thereby inhibiting flow along the entire length of the distribution lines. ■One of the distribution lines was broken on the outside of the filter bed allowing flow to bypass the treatment unit. Regulatory Requirement: According to the NPDES permit, Part II, Section C, the perm ittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permute-- to achieve compliance with the conditions of the permit. Poplar Trails Subdivision WWTP Page Three The daily logs and records were reviewed for the subject facility. The operator maintains an operator's log to record monitoring requirements and daily visits to the treatment facility. The operator initials the log after each visit as required. Deficien cv: ■T"nermometer used formeasuring temperature is not being documented as being checked annually with a NIST traceable certified thermometer. Regulatory Requirement: Pursuant to Title 15A NCAC 2H. 0805 (a)(7)(0), all thermometers must meet National Institute of Standards (MIST) specifications for accuracy or be checked against a NIST traceable thermometer and proper corrections made. Documentation of the thermometer check and temperature carrection should be maintained. SELF -MONITORING PROGRAMS: 1. Self -monitoring reports were reviewed for the period April 1998 through March 1999, inclusive. It was noted during the file review that the April and May 1999 Discharge Monitoring Reports (DMRs) have not been received by Central Files.
