PANCH We received notification in a letter dated April 12, 2010, that the processing of the permit application for the above referenced property has been placed on hold pending submittal of additional information. The enclosed documents are provided for your use to address the additional information requested. Item 1. Dry Pond 2 may not be placed within the footprint of an existing wetland. This does not meet avoidance and minimization requirements, and it also is likely to dewater the wetland. The DWQ will not allow a dry detention basin adjacent to a natural wetland unless the invert of the dry detention basin is at least 2 feet above the level of the SHWT. Only the fill slope of Dry Pond 2 is located in the wetland (no excavation within the wetland). Since your request for additional information, the outlet of Dry Pond #2 has been redesigned and moved to a location adjacent to the wetland. This modification reduced permanent wetland impacts by 0.01 acre down to 0.02 acre of fill. The overall wetland impact remains at a meager 0.03 acre, with 0.02 acre of permanent impact and 0.01 acre of temporary wetland impact (clearing only) to allow for construction of the retaining wall. The temporary wetland impact area will be restored and planted with a wetland seed mix after construction. Please see the attached letter from the stormwater engineer for justification and other considerations of the Dry Pond location. Item 2. Please provide documentation of the Town of Cary's approval of the stormwater management plan for this project by providing ... a valid approval letter from the Town of Cary indicating that the proposed activity has an approved SMP and one copy of the approved SMP, including full-size plan details. A copy of the Town of Cary approval letter is attached to this letter along with full size plan details. A copy of the SMP (Drainage Report) was previously provided to DWQ in the PCN. Your first continent states that Dry Pond 2 may not be placed within the footprint of an existing wetland. The dry pond is placed at the location shown because there is no feasible alternative given the steep slopes of the property leading to the riparian buffers. The pond is a result of the Town of Cary requirement to reduce peals stormwater runoff from the project to or below pre-development rates. It has the side benefit of providing some additional nitrogen reduction after the stormwater wetland. Such ponds must be placed in the lowest part of their drainage area. The location chosen is to be out of the Neuse River riparian buffer required by state law and the additional 50' buffer added by the Town of Cary. It is also outside of zoning buffers required at the property boundaries (a local requirement). Please note that we have moved the outlet pipe from this dry pond since the last submission so that we do not have the rip-rap in the wetland area. This has reduced the impact to the wetland to approximately 887 square feet. It was necessary to place a stormwater wetland to comply with nitrogen reduction requirements and then place the dry pond within a limited land area to comply with peak storm flow requirements. The pond cannot be reduced in size and still meet the peak flow requirements. It may be noted that retaining walls have been used to obtain the storage volume needed within the land available. Mr. Ian McMillan May 6, 2010 Page Two We have reviewed several possible solutions to this situation in light of local and state requirements. One possibility was the provision of a stormwater wetland alone. NCDENR rules required that the maximum water rise in the water level allowed is one foot. It is not possible to provide enough storage for the peak flow reduction to occur unless a much larger land area was used to keep the rise in water level to less than one foot. The dry pond shown was originally designed as an earth dam with side slopes (3:1 max.). This did not come close to enough storage volume to meet the peak flow requirements. Thus, the currently proposed configuration with vertical walls was adopted. A problem is that land slopes outside of the required riparian buffers are steep. Any movement of the BMP's uphill would require wall heights that would not be practical to build. These wall heights would also cause major maintenance expense on the homeowners association in years to come and significant safety risks. The dry pond would be constructed by fill over the wetland. All of the portion of the wetland to be impacted would have fill placed over it. Your second comment was to provide evidence of Town of Cary approval of this project. The Town of Cary issued a Letter of Notification (LON) on February 15, 2010 indicating that this project was approved subject to a few conditions. A copy of the LON is attached to this letter.
