Dear Mr. Williams & Ms. Homewood:
Please consider this letter our formal request on behalf of the permittee for a modification to Special
Condition No. 5 of the approved Individual Permit No. 2007-03073-201 issued on October 14, 2008 and
modified in December 2008.
Special Condition No. 5 reads as follows;
"5. The permittee shall make payment to the North Carolina Ecosvstem Enhancement Program (NC
EEP) in the amount determined by the NCEEP, sufficient to perform the amount necessary to restore
1.75 acres of riparian wetlands, 1, 0981inear feet of stream channel with important qualityfunction in
the Cape Fear River basin (Cataloging Unit 02020002).
Construction within jurisdictional waters on the property shall begin only after the permitte has made
full payment to the NC EEP and provided a copy of the payment documentation to the Corps, and the
NCEEP has provided written confirmation to the Corps that it agrees to accept responsibilityfor the
mitigation work required, in compliance with the MOU between the North Carolina Department of
Environment and Natural Resources and the United States Army Corps of Engineers, Wilmington
District, dated November 4, 1998.
In good faith effort to follow current mitigation policies, the Permittee has authorized us to contact the
Cripple Creek mitigation bank sponsor, a new mitigation bank that has opened in the watershed, to discuss
options for purchase of their available credits. Agreements have been made with the sponsor of the Cripple
Creek Mitigation Bank and NC EEP as outline in the table below.
