PROJECT SUMMARY: The applicant proposes to install an 8ft. by 8ft. boat lift on the east side of the existing docking facility for a total of 5 boat slips. 11 Point Place, Alex Thorpe Page Two 9. PROJECT DESCRIPTION The project site is located at 11 Point Place, on Motts Channel, in the town of Wrightsville Beach, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and take a right at Live Oak Drive before crossing the bridge over Banks Channel. Travel approximately 0.27 miles through the traffic circle, turn left onto S.Channel Drive, in approximately 125 feet take a right onto Point Place, the property is the second home on the right. Currently, the property has a 4-slip private docking facility and bulkhead. The normal high water (NHW) boundary comes up to the existing bulkhead which is approximately 60 feet in length and ties into existing bulkheads at both the eastern and western neighboring properties. The existing docking facility consists of a 6' by 30' access pier extending waterward to the southwest from the edge of the bulkhead. The 30' pier section terminates at a 16' by 16' (256 sgft) L-head platform. A ramp extends from the 16' by 16' platform to an 8' by 40' floating dock, oriented perpendicular to the shoreline with an existing 13' by 13' boat lift located on the western side with water depths of approximately -7 ft. mean low water (MLW) at the waterward end of the existing structure (see Sheet 1 of 2). A docking facility at this property was authorized on June 1, 1972 by the Town of Wrightsville Beach. The docking facility in the current configuration was permitted under General Permit No. 15779 on January 24, 1996. In 2007 the construction of a new bulkhead waterward of the existing bulkhead was authorized by General Permit No. 51931 on December 4, 2007. Various exemptions to replace/repair docking components have been issued in recent years. Elevation at the site averages approximately 5-8' above normal high water (NHW)The high ground portion of the property contains ornamental grasses and landscaping up to the existing bulkhead that extends directly into open water. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to install an 8ft. by 8ft. boat lift on the east side of the existing docking facility for a total of 5 boat slips. The new boat lift would be installed adjacent to the fixed platform, approximately 38 ft. waterward of the existing bulkhead, within the applicant's riparian corridor (see Sheet 1 of 2). 10. ANTICIPATED IMPACTS As proposed, the new boat lift would result in the incorporation of approximately an additional 64 ft2 of Public Trust Area and Estuarine Waters. The project area consists of open water, and there would be no impact to vegetated wetlands or to the high ground area. The application states that the constructed features encroach approximately three feet into the adjacent 15' riparian corridor setback from the property to the east, 9 Point Place. A waiver was provided by the applicant signed by the property owner of 9 Point Place waiving the 15' setback requirement. No encroachment of the15' riparian set back from the property to the west is anticipated. Additionally, no encroachment beyond established pierhead line is proposed. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction. It was received as complete on September 8, 2020 and appears to be adequate for processing at this time. The projected deadline for making a decision is November 22, 2020. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from September 8, 2020, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
