APPROVAL OF STORMWATER MANAGEMENT PLAN (SMP)
Dear Mr. Kepes:
On May 5, 2010, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to you
and Marion Retail Investment, LLC to place fill within or otherwise impact 0.07 acres of wetlands and 80
linear feet of streams for the purpose of constructing the proposed development, Grandview Station /
Wal-Mart Supercenter in McDowell County.
The DWQ has reviewed the stormwater management plan (SUP) dated April 21, 2010 (Engineer's Seal)
that was submitted with your application on April 26, 2010 and subsequent revised plan sheets received
on May 12, 2010. The DWQ approves the SMP to satisfy the stormwater condition #I required by the
401 Water Quality Certification. You are required to meet the following conditions:
1. The SMP consisting of a wet detention basin and all associated appurtenances, stormwater
conveyances, and the grading and drainage patterns depicted on the plans received on April 26,
2010 and May 12, 2010, as approved by this office must be maintained in perpetuity. No changes
to the structural stormwater practices shall be made without written authorization from the
Division of Water Quality. The stormwater management structures shall have maintenance access
and at least a 10-foot drainage easement on each side to allow for the ability to maintain the
structures, and to perform corrective actions. The stormwater easements shall be recorded to
provide protection of the structures from potential alterations by future property owners.
2. All operation and maintenance activities shall be followed as stipulated in the wet detention
operation and maintenance agreement dated April 16, 2010 and received in our office on April
26, 2010.
3. After the stormwater plan is implemented, please fill out a Certificate of Completion (available
at: http://portal.ncdenr.org/web/wg/smT/ws/40 1/certsandnermits/apply/forms) and return it to the
