Dear Mr. McMillan:
Thank for your staff's and Lauren Witherspoon's assistance with this project. We
are submitting the additional information requested from the (April 5, 2010 ?) written
correspondence received on May 5, 2010. We are requesting for NC Division of Water
Quality (DWQ) written approval under Section 404, Clean Water Act, 33 USC 1344 and the
Neuse River Buffer Rules. We have addressed your included written comments in the
following paragraphs.
1. The PCN only reflected a total stream impact of 85 linear feet but not
the type of impact, stream name, perennial or intermittent
information.
Our apologies on this discrepancy. It has been corrected and is reflected in the
revised attached PCN.
2. The PCN also shows the Buffer impact box check C 1 a; yet no buffer
impacts are noted in the PCN.

reading of Water Quality Certification 3821 (NW39).
Prior to submittal we consulted with Mrs. Witherspoon. Please refer to the attached
April 14, 2010 email. Disturbances will be limited to the existing rip-rapped riparian buffer
areas. Therefore, we request that the permitting fee be waived for this project.

provided inaccurate information as discussed below. Please provide five (5) copies of the following

3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Site is located near the intersection of NW Maynard Road and Harrison Drive in Cary, NC. Area is comprised of predominately
residential neighborhoods. Cary West Middle School is located to the west of the property. There is an Aldi's supermarket to
the east of the property along with other mostly retail businesses near the intersection.
Existing site conditions include completed townhomes and open space. An unnamed perennial tributary to Crabtree Creek
exists in the southern property area. The majority of this stream is lined with Class II rip-rap aggregate along the right (east)
stream bank. Class II rip-rap aggregate along the left (west) stream bank also existing in the lower stream area. An existing
sewer and telecommunications line and easement also exist along the right stream bank.

This project will further protect the existing townhomes and streambank. areas

This project proposes to protect the existing townhome structures from future flooding. We propose to do the following before
and during low-flow conditions.
1. STA 1+50: Assemble and secure turbidity curtain to both stream banks.
2. STA 0+00 to STA 1+00: Remove existing rip-rap and biofabric from right bank.
3. STA 0+70 to STA 1+25: Remove existing rip-rap from left bank.
4. STA 0+00 to STA 1+00• Prepare and hand-line right stream bank with Class I rip-rap to a depth of 12 to 24-inches
5. STA 1+50: Disassemble turbidity curtain from both stream banks.
6. Seed out any bare or disturbed upland areas.
Equipment to be used includes a trackhoe.

Hope you both are doing well. Attached is the proposed plans and cover letter with photos of the
stream area. We hoping to further stabilize the rip-rapped bank with some larger class 1 and correct
the biofabric and any other structures. We do not expect any in-stream work except for place new
rip-rap along the stream bank. HOA and owners are aware of limitation of 1 CY per running foot of
rip-rap below the plane of the ordinary HWM. A turbidity curtain will be placed downstream during

Creek/Lake. Maybe it's time to give it a name considering its size and
watershed.
