Sullins Dee Freeman Governor Director Secretary May 6, 2010 DWQ Project # 09-1345 Nash County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Gerry Leighton Granville Health System 1010 College Drive Oxford, NC 27565 Subject Property: Granville Medical Center Ut to Jordan Creek [030301, 28-11-5-1, C, NSW] RETURN OF APPLICATION Dear Mr. Leighton: On February 9, 2010, the Division of Water Quality (DWQ) received your revised application dated February 8, 2010, to fill or otherwise impact 85 linear feet of perennial stream and 9,480 square feet of Zone 1 Tar-Pamlico River basin protected riparian buffers and 6,459 square feet of Zone 2 Tar-Pamlico River basin protected riparian buffers to conduct the proposed hospital expansion at the site. On February 9, 2010, and April 1, 2010, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. In the Request for More Information letter that the DWQ sent to you on March 4, 2010, we requested that you provide a completed Supplement Form for each proposed BMP. The letter stated: "Please be sure to include the Required Items Checklist with ALL required items." The following required items were omitted from your submittal that was received by the DWQ on April 1, 2010: 1. The depiction of the flow splitting device and the boundaries of the drainage easement on the plans. 2. The supporting calculations. 3. The soils report does not include a boring that was taken within the proposed footprint of the sand filter. 4. The Operation and Maintenance Agreements are not signed and notarized. 5. The storm drainage system is not depicted in a clear enough manner to verify the size of the drainage area. An Equal opportunity 1 Affirmative Action Employer Granville Health System Page 2 of 2 May 6, 2010 1. A level spreader may not be installed upslope of an area with a 24% slope. A level spreader is not needed at the outlet of the sand filter. It appears that the designer may have been using an outdated version of the BMP Manual. 2. The area of the sand filter shown on the plans does not match the area claimed on the Sand Filter Supplement Form. The DWQ will not approve a sand filter with such unusual geometer. 3. The sand filter must be equipped with a flow spitting device. 4. The sand filter detail that has been cut and pasted from the DWQ BMP Manual is out of date. Also, the detail for a closed sand filter should not be included in the submittal for an open sand filter. 5. Specifications for the sand filter media must be provided. For these reasons your permit application is hereby considered returned. Once you have redesigned your project to address the problems and inadequacies with your application as it was submitted, you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee. Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any work done within waters of the state would be a violation of North Carolina General Statutes and Administrative Code.
