USACE Permit Action ID No. SAW-2007-02903-292, issued April 22, 2008. NCDWQ Major 401 WQC Project No. 20071470 ver. 1, issued March 17, 2008. The North Carolina Turnpike Authority (NCTA) is constructing a 12.6-mile long, new location roadway (Western Wake Freeway) in Wake County, North Carolina. The NCTA submitted an Individual Section 404 (of the Clean Water Act) Permit Application to the U.S. Army Corps of Engineers (USACE) for the subject project on August 27, 2007. On April 22, 2008, the Section 404 Permit was issued by the USACE (Action ID No. SAW- 2007-02903-292). The Section 401 Water Quality Certification (WQC) was issued by the North Carolina Division of Water Quality (NCDWQ) on March 17, 2008 (NCDWQ Project No. 2007-71470, ver. 1). The NCTA requested a permit modification in April 2010 under two separate submittals - one submittal included only Section C and the other submittal included both Section A and Section B. Since the submittal of this information, it has been noted that the impact data in the cover letters of the permit modification requests is inconsistent with the impact data in the permit summary sheets. The tables in the cover letters have been updated so that they correspond with the permit summary sheet totals for each section of the project. This letter transmits the corrected data. A ditch has been added to the drainage plans from station 589+50 to 593+50 (left). This change in the location of the drainage ditch has no additional impacts to our permit modification request. To assist you in locating the corrected data, updated tables have been included with values that have changed noted with both italics and underline. Section C information changes It has been noted that project impacts in Table 2 from the Section C permit modification letter were incorrect. This affected Tables 1 and 2. Here is a brief summary of the changes in Tables 1 and 2: • In Table 1, the numbers for "Modified Permanent Wetland Impacts" and "Change in Permanent Wetland Impacts for Wetlands" have been changed; • In Table 2, data from the permit summary sheet for Site 13 and the "(Modification) Permanent Impacts to Wetlands" was incorrectly transferred to the cover letter from the Section C permit summary sheet. The total for "(Modification) Permanent Impacts to Wetlands" decreased for this site along with the "Change in Permanent Wetland Impacts" for this site; • Site 14 and the wetland impacts from Mechanized Clearing were not included in Table 2. This information was included in the permit summary sheet for the modification request. This information has now been added to Table 2; and, • The total columns for "(Modification) Permanent Impacts to Wetlands" and "Change in Permanent Wetland Impacts" were updated to reflect the noted changes in Site 13 and 14. The updated Tables 1 and 2 from the Section C permit modification letter are provided below. Table 1. Site 1 in Section A was inadvertently included in the modification request as requiring mitigation in Table 13. This impact does not require mitigation as it was not included in the original permit application as requiring mitigation. This site has been removed from Table 13, and this removal also affects Table 12. Additionally, Site 2 was inadvertently not included in Table 13 for the modification request. This impact does require mitigation as it was included in the original permit application as requiring mitigation. Therefore, this change affects Tables 12 and 13 in the Section A and B permit modification request. 3 Table 12. A rounding error was noted for the total, overall impacts in HU 03030004 in the cover letter for the permit modification request. The permit summary spreadsheets do not use significant digits to the hundredths as reported in the cover letter. The adjustment was made such that Tables 2 and 4 in the cover letter correspond to the permit summary sheet totals. The overall wetland impacts were increased by 0.01 to 4.06 total permanent wetland impacts in Section B, HUC 03030004. This accounts for the rounding that occurs in the permit summary sheet calculations. Table 2. Drilled shaft impacts were not included in Table 5 for Sites 27 and 28 in HUC 03030002. This information was presented in the permit summary sheet, but it was not included in Table 5. This increased overall wetland impacts by 0.05 acre. An updated Table 5 is provided. Table S. Based on the changes noted previously, Tables 9 and 10 have been updated accordingly. These tables are presented below. Table 9. The following paragraph, located on Page 10 of the Section A and B permit modification request, has also been updated: For wetland impacts within HUC 03030002 (i.e., those impacts within Section B), there is a need of additional wetland mitigation. The original permit required mitigation for 2.24 acres of wetland and the modification request impacts for 2.52 acres of wetlands, an increase of 0.28 of wetland impacts. 6 Overall Proiect Mitigation Requirements The following tables summarize the mitigation requirements for Western Wake Freeway for each section of the project per impacts in the two hydrologic units that the project crosses. We have received the EEP mitigation acceptance letter noting the new wetland and stream mitigation needs. EEP commits to implementing sufficient compensatory stream and riparian wetland mitigation credits to offset the final permitted impacts associated with this project by the end of the MOA Year in which this project is permitted, in accordance with Section X of the Amendment No. 2 to the Memorandum of Agreement between the North Carolina Department of Environment and Natural Resources, the North Carolina Department of Transportation, and the U. S. Army Corps of Engineers, fully executed on Much 8, 2007. If the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from EEP.
