Room 208 Asheville, NC 28801-2714 Subject: Nationwide 14 Permit Application - Modification Request SR 1249, Old Field Gap Road, Graham County --- COE Action ID. SAW-2009-1865, NC DWQ Project No. 091019 State Project. No. 14C.038017 (DWQ Minor Permit Fee $240) Dear Mr. Baker: The North Carolina Department of Transportation (NCDOT) is in the process of widening and paving Old Field Gap Road, SR 1249, in Graham County. The U.S. Army Corps of Engineers issued a Nationwide Permit 14, Action ID. SAW-2009-1865 for this project on November 17, 2009. The North Carolina Division of Water Quality issued a 401 Water Quality Certification, DWQ Project No. 091039 on October 27, 2009. After construction began, it was determined that an extension of one additional culvert would be needed to allow for shoulder construction at a stream crossing. NCDOT is requesting a modification for the original permit to add Site No. 17 & 17A. This consists of the replacement/extension of an existing 40-foot long corrugated metal pipe (CMP) in Puncheon Camp Branch. There would be an additional net impact of 20 feet after the pipe is installed. I am enclosing a detail drawing of proposed work, a USGS topographic map showing the location and photographs of the stream and a revised PCN table listing the impacts for this culvert and the previously permitted impacts. We propose to install the new culvert slightly below the existing streambed elevation where bedrock is not encountered to minimize impacts to aquatic habitat and allow the existing stream gradients to remain as unchanged as is physically possible. The installation will involve a temporary impervious dike and flow diversion until installation of the pipe is complete. The disturbed areas including banks and adjacent areas will be seeded and mulched. Coir fiber matting will be used on the banks. SR 1249 Permit Modification 2 May 7, 2010 The North Carolina Natural Heritage Database was checked for records of federally threatened and endangered species. Records of two federally endangered species. Indiana bat (Myotis sodalis) and Appalachian elktoe (4lasmidonta ravenchana)_ and one federally threatened species, Virginia spiraea (Spiraea virginiana), were found in the database in close proximity of the Cheoah River, which drains the project area. Additionally. in the summer of 2009, the spotfin chub (Erim077ax monachus), a federally threatened species, was reintroduced to the Cheoah River. This project was reviewed previously with a determination of "no effect" for threatened and endangered species. Because this additional culvert is within the previously reviewed area and impacts will be similar to those previously reviewed, we believe this additional culvert will have "no effect" on threatened and endangered species. Impacts to Raters of the United States NCDOT is requesting to replace one CMP in Puncheon Camp Branch (DWQ Class: Q. Puncheon Camp Branch is shown as a perennial stream on the USGS topographic map. The stream has a well-defined channel and the substrate is composed priniaiily of silt, sand and gravel with some cobble. The channel lacks vegetation. Puncheon Camp Branch flows into the Cheoah River approximately 2500 downstream of the culvert site. The Cheoah River then flows into the Little Tennessee River and Calderwood Reservoir approximately 3.8 miles downstream. The Little Tennessee River at Calderwood Reservoir meets the definition of a Traditional Navigable Water. For the reasons stated above, we believe Puncheon Camp Branch is a Relatively Permanent Water under the jurisdiction of the U.S. Army Corps of Engineers. In order to complete the construction of SR 1249, Old Field Gap Road, it will be necessary to impact waters of the United States in the Little Tennessee River Basin. The specific impacts are listed in the table below.
