APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN
Dear Mr. Dienst:
On Apri18, 2003, the Division of Water Quality (DWQ). issued a 40.1 Water Quality
Cer -ificat onto impact 600 linear feet of stream and 0.18 acre: of wetlands in order to construct-
the Catawba Hills Subdivision in Gaston County (this certification replaced the original
certification, which was issued on December 4, 2003). Condition number 4 of the General
Certification required the submission and approval 'of a stormwater management plan for this,: ,, .
proj ect.
On January 10, 2006, the DWQ received a stormwater management plan prepared by.the
consulting engineer, Land Design. Additional information on the stormwater management, plan
was received by the DWQ on March 10, 2006, September 7, 2006, November 15, 2006 and.
March 8 2007. This stormwater plan was approved by the DWQ on March 12, 2007.
On `December 23, 2009, the DWQ received a request from you (dated December 23, 2009) to
modify the approved stormwater management plan. Additional information on the modified
stormwater management plan (dated April 22, 2010) .was received on April 23, 2010. This
revised stormwater management plan has been reviewed and has been found to satisfy the
stormwater management requirements of the 401 Water Quality Certification.
Per the Protocol for 401 Stormwater Management Plan (SMP) Approval and Implementation

9342-7079fe478688&-,roupld=38364), the following requirements apply to your project:
1. The approved SMP must be constructed and operational before any permanent building
or other structure is occupied at the site. If a development is phased, then the approved

SMP for each future phase must be constructed and operational before any permanent
building or other structure associated with that phase is occupied.
2. Within 60 days after a project or project phase is constructed and operational, a
Certificate of Completion (available at:

2009.doc) must be filled out and submitted to the 401 Oversight/Express Unit at 2321
Crabtree Boulevard, Suite 250, Raleigh, NC 27604.
3. The approved SMP as well as drainage patterns must be maintained in perpetuity.
4. The SMP may not be modified without prior written authorization from the certified local
government that approved the SMP or DWQ. The SMP modification must be approved in
accordance with the procedures described above prior to the commencement of the
modifications.
In addition, stormwater easements shall be recorded for a distance of at least 10 feet on each side
of all storm water conveyances on all lots containing, these structures including future access for
maintenance. The stormwater easements shall allow for the ability to maintain the structures,
perform corrective actions as described above and shall provide protection of the structures from
potential alternations by future property owners.
