APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN

On January 5, 2010, the NC Division of Water Quality (DWQ) issued a 401 Water Quality Certification
(WQC) to impact 149 linear feet of unnamed tributary to Buffalo Creek and 0.02 acre of wetlands to
combine existing ponds on the property and removed an existing unstable spillway. On this same date,
the DWQ also issued a Buffer Authorization to impact 2.27 acres of protected Jordan Lake Buffer-to
conduct dam repair and maintenance activities, pond bank stabilization activities and to install a walking
trail for the future Keeley Park Site.
In order to meet Condition 2 of the 401 Water Quality Certification and Buffer Authorization, a diffuse
flow plan, dated February 1, 2010, was received by the DWQ on February 2, 2010. Additional
information was received by the DWQ on February 16, 2010 and March 31, 2010 (dated February 15,
2010 and March 29, 2010, respectively). The DWQ has reviewed this information and has found that it
satisfactorily address Condition 2 of the approvals.
The stormwater conveyance system, which includes two grassed swales, and the signed and notarized
Operation and Maintenance Agreements dated March 25, 2010, as approved by this Office, and the
drainage patterns and dissipater devices depicted on the plan sheets, must be maintained in perpetuity. No
changes to the structural stormwater practices shall be made without written authorization from the
Division of Water Quality. All stormwater conveyances shall have a maintenance access and at least 10-
foot drainage easement on each side to allow for the ability to maintain the structures, to perform
corrective actions and shall provide protection of the structures from potential alterations by future
property owners.
