VU U NIAY 5 2010 DENR - WATER OUAUTY WETLANDS AND STORMWATER BRANCH Enclosed please find a completed after-the-fact PCN for a Nationwide 42 permit and NC DWQ General Water Quality Certification at Lake Norman State Park, in Iredell County. This PCN submittal is being simultaneously submitted to DWQ and is in response to the discovery by North Carolina Division of Parks and Recreation (DPR) staff of two filled stream crossings along a small unnamed tributary to Lake Norman. These crossings are on a 4.7 mile hiking and mountain bike trail that was designed and constructed by local trails volunteers. DPR staff were unaware of these filled crossings until a walk-through of the completed trail, and a review of the project with trail volunteers revealed that the trail alignment was laid out during extended drought conditions when this stream corridor was dry. In addition, when the trail alignment was reviewed and approved by DPR's trails specialist, no mention of these crossings or of the need for permit review was made to park staff or to DPR's regulatory compliance staff. The trails volunteers and DPR's trails staff assumed that this corridor was another of the erosion gullies that occur across the local landscape, so they never sought consultation on potential permit issues. I have enclosed USGS mapping and photographs of each crossing, as well as a copy of the recently-completed DWQ Stream Identification Form for this site, which assessed this stream as perennial, with a score of 31 points. By this letter and permit submittal, DPR is requesting Corps and DWQ review of this project and direction on whether these crossings should be modified so that they are not in violation of Sections 401/404 of the Clean Water Act. Project Description 3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Project site is located on the east side of Lake Norman State Park along an unnamed tributary to Lake Norman, in Iredell County. The project area and most of the park is forested in second and third growth mixed hardwood-pine stands that have regenerated following intensive logging and agriculture. Dry, eroded gullies - some of considerable width and length - are common throughout this section of the park. The North Carolina Natural Heritage Program has mapped this area as "successional pine-mixed hardwood", and the primary canopy dominants are Virginia pine, loblolly pine, red maple, and mixed oaks and hickories of varying size, up to approximately 14" DBH. American beech, American holly, and sweetgum are scattered throughout. Herbaceous diversity is low, and thickets of Chinese/Japanese privet are scattered across the area at old homesites. There are loblolly pine plantations nearby on state park property, and a small remnant (<10 acres) of Piedmont Monadnock Forest has been documented on park property within .5 mile of the project site. The surrounding landscape outside of the park is primarily residential development and agricultural. The unnamed tributary runs east to west across the park and passes beneath the main park road through a culvert approximately .25 mile upstream. Normal stream flow at this location is shallow (-6"); bank-to-bank width is -3-4 feet; maximum bank height is typically 1-2 feet. Stream flow is intermittent upstream from the project site and is prone to drying up during drought conditions. The project site is well outside the 50-foot buffer area regulated under the Catawba River buffer rules. See attached vicinity map and site photos. 3b. List the total estimated acreage of all existing wetlands on the property: Approximately 2.5 acres of wetlands in this area of the park, measured from NWI GIS mapping. Total wetlands on the entire park estimated at <10 acres. NWI data do not include open waters of Lake Norman. The project site is not near the NWI mapped wetlands. 3c. Describe the overall project in detail, including the type of equipment to be used: This is an after-the-fact permit for two stream crossings on the 4.7 mile long Laurel Loop of the Itusi Trail, which is a multi- phased hiking and mountain bike trail project at Lake Norman State Park. The Laurel Loop includes two crossings of an unnamed tributary to Lake Norman. This is a single track trail, constructed by volunteers using hand tools and small mechanized trail construction equipment, such as a walk-behind earthmover. The stream crossings were estabished by volunteers who filled the stream channel from bank-to-bank and to bank height with large, native stones. Trail design and construction were done by the TTB under the terms of a Memorandum of Agreement (MOA) between the TTB and the NC Division of Parks and Recreation (DPR). This MOA specified that all streams were to be crossed using bridges or other methods that were reviewed and approved by DPR. Park staff were never informed that the volunteers intended to fill these crossings, and the DPR trails specialist who reviewed the alignment prior to the trail's construction failed to note the crossings or to raise any questions about structures or permitting. Consequently, DPR reguilatory compliance staff were never notified, and park staff were unaware of the filled crossings until a walk-through of the completed project with TTB volunteers. We believe that the explanation for this error is that although this drainage was scored as a perennial stream in March 2010 following an unsually long and wet winter, the original trail alignment was made during extended drought conditions when this drainage was dry. The TTB volunteers have always scrupulously complied with MOA and water quality regulations on previous trail segments, and the topography in this area of the park is charcterized by numerous dry gullies and old eroded ditches. Consequently, given the drought conditions prevailing at the time of alignment review, both the volunteers and DPR's trail specialist incorrectly assumed that this was a dry gully and thus did not notify DPR compliance staff about potential permit issues. 3.
