Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The Yates Mill County Park is located at 4620 Lake Wheeler Road, Raleigh, NC in central Wake County. The park is a partnership of Wake County Parks & Recreation, NC State University, and the non-profit group Yates Mill Associates, with the State of North Carolina owning the property Mile Wake County operates and maintains the park. Yates Mill Associates operates and maintains the mill. The 157 acre park parcel consists of a 20-acre millpond, forest and managed open space. Existing site amenities include a visitor's center, an environmental research wing, paved parking area, a floating dock, boardwalks, wood deck, canoe launch, historic Yates Mill, storage sheds and trails. The park opened to the public in May 2006. Yates Mill Park is located on FEMA regulated Yates Branch (Basin 20, Stream 13) in Wake County. 4b. Explain the purpose of the proposed project:* The proposed improvements of the Aquatic Propagation Facility project consist of renovating the existing Research Wing of the A.E. Finley Center and providing the additional improvements necessary for the purposes of creating a new Propagation Lab operated by N.C. State University. This is a collaborative project involving NCDOT, US Fish & Wildlife Service, NCSU and Wake County for an aquatic species propagation facility to meet NCDOT mitigation requirements for the 1-540 highway project. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* Wake County Facilities and Design's proposed building renovations will be contained to the existing Research wing of the A.E Finley Visitor's Center and the existing maintenance drive/area of the center where a new pump house will be constructed. Site work includes utility improvements for the renovated Research Wing, existing service drive access improvements, installation of two floating dock upweller research modules, wood canoe launch, granite screenings path, two canoe storage racks and 8x10 shed for canoeing supplies. The proposed park improvements for the renovation of the existing Research Wing will impact only a small portion of the site consisting of approximately 0.5 acres that will be disturbed during construction. The two investigated areas were located between the existing visitor's center building and the millpond (see attached Yates Mill County Park Summary Letter - Shoreline Delineation and Protected Species Survey). It was determined that no jurisdictional wetlands are situated within the investigation areas. The path to the canoe launch and the canoe launch fall within zone 2 and zone 1 of the buffers and are needed to provide connectivity and access for the park's educational programming needs and water borne activities. The canoe launch will be constructed of 6x6 wooden timbers laid horizontally on the ground with stone infill between the timbers, allowing for easier canoe launching within a stable confined area of the existing shore. The installation of the wood canoe launch area will result in less than 10 cubic yards below the plane of the ordinary high water mark. The proposed layout of the path and canoe launch was taken into consideration to minimize the site impacts with minimal grading needed to meet ADA compliance. At the most a small skid steer may be needed. The storage shed and canoe racks Will be stick built on site with no equipment needed for construction beyond pourer tools. 4j. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The proposed layout of the path and canoe launch was taken into consideration to minimize any site impacts. Grading for the path will be minimal and completed only as necessary for ADA compliance. The shed and canoe racks are immediately adjacent to the existing park center building to minimize site impacts. Disturbance (0.033 acre) within the buffers is minimized and installation does not result in removal of buffer vegetation or compromises the health of the existing vegetation. Any disturbed areas from the path installation and improvements will be stabilized. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: As much as is practicable the install of the path and canoe launch will be constructed with minimal machinery and any equipment will be limited to a narrow corridor. The shed and canoe racks will be stick built on the site. The removal of existing vegetation will be minimized during construction as protecting the natural amenities of the project site is a priority of the park. 2. (Axiom) investigation at the above-mentioned site. Figures 1 and 2 depict our two investigation areas that are based on locations of proposed improvements. Axiom biologists conducted a field visit on August 19, 2020. We accomplished the following tasks within the investigation areas: a general environmental review, a Section 404 jurisdictional area delineation, a riparian buffer determination, and a federally protected species survey. General Environmental Features The investigation areas include some hard-surface access areas and a mesic pine/mixed hardwood forest between the park offices and the mill pond. The access areas include a road and deck associated with a canoe launch area in the north and walking paths in the south. The forest is characterized by a mature, closed canopy, an open sub-canopy, sparse shrub and herb components and dense vines. The canopy is composed of yellow poplar (Liriodendron tulipifera), river birch (Betula nigra), black gum (Nyssa sylvatica), sweetgum (Liquidambar styraciflua), red maple (Acer rubrum), sycamore (Platanus occidentalis), willow oak (Quercus phellos), and loblolly pine (Pinus taeda). Sub-canopy species include flowering dogwood (Cornus florida), black gum, sweet bay (Magnolia virginica), and sourwood (Oxydendron arboreum). Shrubs are limited to saplings of canopy species, highbush blueberry (Vaccinium corymbosum), and beauty-berry (Callicarpa americana). Herbs and vines include lizard-tail (Saururus cernuus), netted chain-fern (Woodwardia areolata), soft rush (Juncus effusus), Japanese stilt-grass (Microstegium vimineum), spotted touch- me-not (Impatiens capensis), muscadine (Muscadinia rotundifolia), poison ivy (Toxicodendron radicans), and common greenbriar (Smilax rotundifolia). Mr. Eric Staehle August 21, 2020 Page 2 Section 404 Jurisdictional Area Delineation Results Open Water Yates Mill Pond is the only jurisdictional open water within the investigation areas. The ordinary high-water mark of this feature was delineated with enumerated solid blue and solid orange flagging. Flag numbers begin at the south end with “Pond-01” and extend north to flag “Pond-12.1.” This flagged line is depicted on Figure 2. Streams No streams were identified within the investigation areas. Wetlands Portions of the pond shoreline supported wetland vegetation, but a lack of hydric soils resulted in a determination that no jurisdictional wetlands are situated within the investigation areas. Riparian Buffers Any surface water depicted on either the most recent version of the NRCS county soil survey or the most recent version of the USGS 7.5-minute quadrangle is subject to the Neuse River riparian buffer rules. Yates Mill Pond is depicted on both the soil survey and the Lake Wheeler, NC 7.5-minute USGS quad (Figure 1) and therefore is subject to the buffer rules. The buffer extends 50 feet landward and perpendicular to the delineated shoreline, which is depicted in blue on Figure 2. Federally Threatened and Protected Species Based on the most recently updated county-by-county database of federally listed species in North Carolina as posted by the U.S. Fish and Wildlife Service (USFWS) and updated July 17, 2020, the bald eagle and six federally protected species are listed for Wake County. A field investigation of these trees, and trees within 1.0 mile of the pond found no eagle nests. However, during our visit on August 19, 2020, three immature bald eagles were observed flying over Yates Mill Pond. The N.C. Natural Heritage Program (NCNHP) has documentation of bald eagle within 1.0 mile of the study area from 1989, and anecdotal information on the internet claims sightings through 2020. The proposed impacts will occur in areas of limited size and are not expected to remove potential roosting trees. A proposed dock will be built beside an existing dock and is not anticipated to disrupt foraging areas. The proposed project will not disrupt any known flight path of eagles between nesting/roosting areas and foraging areas. Due to the minimal impact anticipated, this project May Affect, but is Not Likely to Adversely Affect this species. Cape Fear Shiner Study area water resources are not within the upper Cape Fear River basin. The NCNHP has no documented occurrences of Cape Fear shiner within 1.0 mile of the study area. The proposed project will have No Effect on the Cape Fear Shiner. Axiom Environmental, Inc. Mr. Eric Staehle August 21, 2020 Page 4 Red-cockaded Woodpecker The investigation areas are fringed by a mature forest of primarily hardwood species with scattered, mature loblolly pine. The dominance of hardwoods in the canopy and dense understory results in unsuitable nesting and foraging habitat for red-cockaded woodpeckers. An investigation of the investigation areas found no evidence of red-cockaded woodpecker nesting/roosting. The NCNHP has no documented occurrences of this species within 1.0 mile of the study area. The proposed project will have No Effect on red-cockaded woodpecker. Dwarf Wedgemussel Suitable habitat for dwarf wedgemussel does not occur within the study area, and the NCNHP has no documentation of this species within 1.0 mile of the study area. Therefore, the proposed project will have No Effect on dwarf wedgemussel. Yellow Lance Suitable habitat for yellow lance does not occur within the study area, and the NCNHP has no documentation of this species within 1.0 mile of the study area. Therefore, the proposed project will have No Effect on yellow lance. Michaux’s Sumac Suitable habitat for Michaux’s sumac occurs along the margins of roads and trails and along woodland edges. Systematic surveys within suitable habitat found no evidence of this species during our field investigation. In addition, the NCNHP has no documentation of Michaux’s sumac within 1.0 mile of the study area; therefore, the proposed project will have No Effect on Michaux’s sumac.
