Project setting
Derrick Stetter with Baldwin and Associates, on behalf of Bath Bridgewater South,
LLC (C/O John Baldwin), has requested the attached application be processed under the
Express Permit Review Program, fora 63-lot subdivision underthe name of Bridgewater
South.
The project site is located on SR 1339 within the ETJ of the Town of Bath on Bath
Creek, Adams Creek and an unnamed tributary of Bath Creek in Beaufort County, North
Carolina. The proposed project site comprises ±49.922 acres with ±4,125' of shoreline, is
currently undeveloped, and the upland portion of the site was in active agriculture last year.
The property forms a peninsula with Adams Creek to the south, an unnamed tributary of
Bath Creek to the north, and Bath Creek along the east side of the site. The property
abuts SR 1339 to the west.
As indicated above, the majority of the site was in active agriculture last year. The
open field area is vegetated with upland grasses and is being actively mowed. The
perimeter of the site is vegetated with mixed hardwoods, pines and an undergrowth of
vines and herbaceous shrubs. The upland wooded area transitions to wooded wetland that
has been delineated as Section 404 wetlands by Scott Jones and Tracey Wheeler of the
US Army Corps of Engineers. The 404-wetland areas parallel Adams Creek as well as the
unnamed tributary to Bath Creek and are also present along Bath Creek at the northern
and southern ends of the site. The areas immediately adjacent to Adams Creek and the
unnamed tributary have been delineated as Coastal Wetlands by Mike Thomas of the
Division of Coastal Management. These Coastal Wetland areas are vegetated with
Spartina alterniflora, S. cynosuroides, Juncus roemerianus, and Cladium iamaicense.
The property on the south side of Adams Creek is a large tract of land in private
ownership and is vegetated similar to the applicant's. Development on this property is
limited to a single family dwelling with several large barns with a corral, and a pier into
Adams Creek. This property is currently used for agriculture and as horse pasture.
The property on the north side of the unnamed tributary is a mix of developed
single-family lots as well as undeveloped lots. Vegetation adjacent the creek is similar to
the applicant's and two access boardwalks overthe wetland areas with platforms overthe
creek are present on this side of the creek.
Bath Creek and the unnamed tributary are classified as SB-NSW by the
Environmental Management Commission, and Adams Creek is classified as SC-NSW by
the Environmental Management Commission. The Wildlife Resources Commission has
designated this area as a Primary Nursery Area and all of Bath Creek is closed to shell
fishing. The site ranges from 0' to ±14' above the normal water level (NWL). Bath Creek
is ±1,500' wide at the project location and the water depth at 150' offshore is ±3.5' below
the NWL. Adams Creek and the unnamed tributary are narrow creeks with less than 2' of
water depth at NWL.

Stormwater Permit No. SW7060928 was issued on 10 October 2006 for the
development and the Division of Land Resources approved a Sedimentation and Erosion
Control Plan (BEAUF 2007-004) for the site on 16 October 2006 (attached). Utility
construction within the NCDOT R/W was approved by encroachment agreement on 18
October 2006 (attached).
Project description
The applicant proposes to subdivide the property into 63 residential building lots.
The lots will average 0.79 acres in size. A ±3,900' long asphalt loop road is proposed to
provide access to the lots and is currently under construction. The road will have a 60'
wide right-of--way and a 20' wide paved surface. The open "field" area will be graded
during road construction with a total disturbance of 1,229,918 ft2 (28.3 acres).
Septic systems are proposed for all 63 lots and approval from Beaufort County has
been obtained (copies provided upon request). Water will be provided by the County
Water system and a Public Water System (NC0407035) was authorized by the Division of
Environmental Health on 20 October 2006 (see attached agreement).
The applicant proposes to construct a total of 13 piers on the project site. On Bath
Creek the applicant proposes:
1. Lot 26 A 6' wide by 150' long pier including a 20' by 20' T-head
platform, and a 6' by ±50' boardwalk over wetlands is
proposed. All boardwalks over wetlands will be elevated a
minimum of 36 inches measured from the wetland substrate to
the bottom of the decking.
2. Lot 22 A 6' wide by 150' long pier and a 6' by ±50' boardwalk with 2
tie pilings on either side of the pier creating 2 - ±10' by ±12'
wet slips. The water depth in the slip location is ±3.5' below
the NWL. All boardwalks over wetlands will be .elevated a
minimum of 36 inches measured from the wetland substrate to
the bottom of the decking.
On Adams Creek, the applicant proposes access boardwalks over the wetlands with
observation piers on lots 29, 31, 33, 35, 37, 39, 41, and 42. All boardwalks over wetlands
will be elevated a minimum of 36 inches measured from the wetland substrate to the
bottom of the decking. The structures size as proposed is described below:

On the unnamed tributary, the applicant proposes access boardwalks over the
wetlands with observation piers on lots 14, 16, and 18. All boardwalks over wetlands will
be elevated a minimum of 36 inches measured from the wetland substrate to the bottom of
the decking. The structures size as proposed is described below:

In no case shall the piers project more than'/ the width of the waterbody. Railings
are proposed around the ends of the access piers on Adams Creek and the unnamed
tributary to Bath Creek to establish the pier access as observation only with- no suitable
area for mooring boats.
Anticipated impacts
The construction of the piers will result in the shading of ±3,160 ft2 of creek bottom.
The 11 boardwalks constructed in the wetland areas will result in the shading of±6,570 ftz
of section 404 delineated wetlands including some Coastal Wetlands. The road
construction and upland fill activities will result in the disturbance of ±1,229,918 ft2 of high
ground. The project as proposed will result in localized turbidity as a result of the
construction activities.

CAMA NARRARATIVE
FOR
BRIDGEWATER SOUTH
This project is located off NCSR 1339 about .25 miles North of the NC HWY 92
NCSR 1339 intersection. The current site is an exiting agricultural field with a
sparsely wooded perimeter. The trees are a combination of deciduous and
evergreens. The current zoning classification is R-1.
The current project is to build 63 single family homes on this 49.922 acre tract of
land. The building sites range in size from 20,416 SQ. FT. (.47 Acres) to 83,133
SQ. FT. (1.91 Acres). The site also boasts a 17,721 SQ. FT. (.41 Acres)
common area.
The proposed project is the construction and installation of 13 piers with
adjoining boardwalks. The lots that the piers are being proposed fro are lots: 14,
16, 18, 22, 26, 29, 31, 33, 35, 37, 39, 41, and 43. The zone 1 coverage for the
boardwalks is 4,740 SF (.11 acres). The zone 2 coverage for the boardwalks is
1,740 SF (.04 acres).
The piers and boardwalks are to be installed on lots that have single family
homes to allow the homeowners private access to the water. The piers will vary
in length and width. The smallest pier will be 4'-0" wide and 8'-0" long and will be
located on lot 39. The piers located on lots 43, 41, 37, 35, 33 ,31,16, and 14 will
be 6'-0" wide and 12'-0" long. The piers on lots 18 and 29 will be 6'-0" wide and
20'-0" long. The two longest piers will be on lots 22 and 26. Both piers will be 6'-
0" wide and 150'-0" long. The pier on lot 26 however will have a 20'-0"x 20'-0"
platform at the end. This platform is included in the overall length. None of these
piers will extend more than'/ of the distance from shoreline to shoreline nor will
they exceed 150 feet in length or 6 foot in width. All of these piers will have
adjoining boardwalks to provide access over the wetland areas. These
boardwalks will be a minimum of 3'-0" above the coastal wetland substrate to the
bottom of the decking. The piers and boardwalks will be constructed using
treated lumber.

BRIDGEWATER SOUTH
BEAUFORT COUNTY, NORTH CAROLINA
Narrative
This project site consists of 49.92 acres, of which 31.11 acres will be collected in
a proposed storm drainage system consisting of grass lined swales before it is
eventually discharged into the existing natural drainage system. Runoff from this
site eventually drains to Bath Creek and then to Pamlico River in the Tar-Pamlico
River Basin. The property is bounded by Creek Road (SR 1339) to the West,
agricultural property and Bath Creek to the North, Bath Creek to the East, and
Spring Branch to the South.
The completed project will consist of one drainage area. This drainage area will
drain into the proposed grass lined swales and eventually into the existing storm
drainage features located on site. The watershed breakdown is as follows:

Application for Bridgewater South on September 27, 2006. Staff review of the plans
and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding

construction, operation and maintenance of a low density subdivision in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules' and
the approved stormwater management plans and specifications, and other supporting data
as attached and on file with and approved by the Division of Water Quality and considered
a part of this permit.
The Permit- shall be effective from the date of issuance until rescinded and shall be subject
to the following specific conditions and limitations:
1. DESIGN STANDARDS
1. Each of the 63 lots is limited to the maximum of 5,035 square feet of built-upon
urea as indicated in the application and on the approved plans. CAMA regulations
may reduce the allowable built-upon area for those lots within the AEC.
2. The overall tract built-upon area percentage or lot sizes for the project must be
maintained at 30% per the requirements of Section .1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
4. ProJ'ects covered by this permit will maintain a minimum 50 foot wide vegetative
buffer between all impervious areas and surface waters.
5. The only runoff conveyance systems allowed will be vegetated conveyances such
as swales with minimum side slopes of 3:1 (H:u) as defined in the stormwater rules
and approved by the Division.
6. All roof drains must terminate at least 50 feet from the mean high water mark.
II. SCHEDULE OF COMP-LIANCE
Swales and other vegetated conveyances shall be constructed in their entirety.

2. During construction,. erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary
to operate the permitted stormwater management systems at optimum efficiency to
include:
a. Inspections
b. Sediment removal.
c. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to any of the items shown on the approved plans, including the
stormwater management system,- design concept, built-upori area, details.
etc.
b. Project name change..
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area or to the
drainage area.
e. Further subdivision, acquisition, or selling of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the
approved- plan.
5. The Director may determine that other revisions to the project should require a
modification to the permit.
6. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
7. No piping shall be allowed except thaf minimum amount necessary to direct runoff
beneath an impervious surface such as a road and that minimum amount needed
under driveways to provide access to lots.
8. Unless specified elsewhere, permanent seeding requirements for the swales must
follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.
9. The permittee is responsible for verifying that the proposed built-upon area does
not exceed the allowable built-upon area. Once the lot transfer is complete, the
built-upon area may not be revised without approval from the Division of Water
Quality, and responsibility for meeting the built-upon area limit is transferred to the
individual property owner, provided that the permittee complies with the
requirements of Section 11.11 of this permit.
10. Within 30 days of completion of the project, the permittee must certify in writing that
the project's stormwater controls, and impervious surfaces have been constructed
within substantial intent of the approved plans and specifications. Any deviation
from the approved plans must be noted on the Certification.

11. Deed restrictions are incorporated into this permit by reference and must be
recorded with the Office of the Register of Deeds prior to the sale of any lot.
Recorded deed restrictions must include, as a minimum, the following statements
related to stormwater management:
a. The following covenants are intended to ensure onggoing compliance with
State Stormwater Management Permit Number SW7060928 as issued by
the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
c. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertairnng to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division of
Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
lace without the concurrence of the Division of Water Quality.
f. The maximum built-upon area per lot is 5,035 square feet. This allotted
amount includes any built-upon area constructed within the lot property
boundaries, and-that portion of the right-of--way between the front lot line and
the edge of the pavement. Built upon area includes, but is not limited to,
structures, asphalt, concrete, gravel, brick, stone, slate, and coquina: but
does not include- raised, open wood decking, or the water surface of
swimming pools..
g. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the development except for average driveway .crossings, is
strictly prohibited by any persons.
h. Each lot will maintain a 50 feet wide vegetated buffer between all impervious
areas. and surface waters.
i. All roof drains shall terminate at least 50 feet from the mean high water
mark.
12. The permittee shall submit a copy of the recorded deed restrictions which
indicates the approved built-upon area per lot within 30 days of the date of
recording.
13. If the permittee sets up an Architectural Review Committee (ARC) to review plans
for compliance with the restrictions, the plans reviewed must include al! proposed
built-upon area (BUA). Any approvals given by the ARC do not relieve the lot owner
of the responsibility to maintain compliance with the permitted BUA limit.
14. The Director-may notify the permittee when the permitted site does not meet one or
-more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide
copies of revised plans and certification in writing to the Director that the changes
have been made.
15. Stormwater conveyances will be located in either dedicated right-of-way (public or
. private), recorded common areas or recorded drairta~e easements. The final plats
for the project will be recorded showing all such required easements, in accordance
with the approved plans.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.

2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
reissuance of the permit to change the name and incorporate such other
requirements as may be necessary.. A formal permit request must be submitted to
the Division of Water Quality accompanied by the appropriate fee, documentation
from both parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits, and may or may not
be approved.
6. ..The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the permit transfer request: Transfers to third parties
by the permittee where the required documentation has not been submitted to the
Division does not relieve the permittee of responsibility for transferring the permit.
7. .The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state and federal) which have~urisdiction. If any
of those permits result in revisions to the plans, a permit modification must be
submitted.
8. The permittee .grants permission to DENR Staff to enter the property during
business hours for the purposes of inspecting the stormwater management system
and it's components.
9. The penmittee shall notify the Division of Water Quality of any name.
ownership or mailing address changes within 30 days.

requirements, unannounced periodic inspections will be made. If it is determined that the
implemented plan is inadequate, this office may require the installation of additional measures
and/or that the plan be revised to comply with state law. (Note: Revisions to the scope of this
project without prior approval of the plan showing the changes can be considered a violation).
Failure to comply with any part of the approved plan or with any requirements of this program
could result in the taking of appropriate legal action (civil or criminal) against the financially
responsible party (Bath Bridgewater South, LLC). Some options are Stop Work Orders and the
assessing of a civil penalty of up to $5000 for the initial violation plus up to $5000 per day for
each day .the site is out of compliance.
In recognizing the desirability of early coordination of sedimentation control, we believe
it would be beneficial for you and your contractor to arrange a preconstruction conference to
discuss the requirements of the approved erosion -and sedimentation control plan. Prior to

Please be advised that a rule to protect and maintain existing buffers along watercourses
in the Taz-Pamlico River Basin became effective on January 1, 2000. The Taz-Pamlico River
Riparian Area Protection and Maintenance Rule (15A NCAC 2B.0259) applies to a 50 (horizontal)
foot wide. zone along all perennial and intermittent streams, lakes, ponds and estuaries in the Taz-
Pamlico River basin with forest vegetation on the adjacent land or "riparian area". In riparian
areas, the rule prohibits all land disturbance, new development and fertilizer use in the first 30
(horizontal) feet directly adjacent to the stream and/or coastal wetland vegetation. With the
exception of clearing, seeding and aone--time fertilizer use to establish the grass, the rule prohibits
new development in the zone 20 feet landwazd of the fast 30 feet of riparian area. For more
information about. the riparian area rule, please contact the Division of Water Quality's
Wetland/441 Unit at 919-733-1786.
Please be advised that all land-disturbing activities affecting 1 or more acres are required
to have a (Federal) NPDES permit. Enclosed is the Construction Activities General NPDES
Permit - NCGO10000 for this project. The responsibility for understanding and complying -with
this permit rests with you, the financially re~onsible party. Be aware that failure to comply with

Attached hereto, for your files, is a copy of the Right of Way Encroachment Contract, which has
been properly executed. The contract covers the following: construction of 8" waterline, valves
and appurtenances along SR 1339 (Creek Road) iri Beaufort County as shown on attached plans.
APPROVED SUBJECT TO SPECIAL PROVISIONS:
General Requirements:
1) The encroaching party shall notify the District Engineer's office at (252) 946-3689
prior to beginning construction and upon completion of construction.
2) An executed copy. of this encroachment agreement, contract, and plans shall be present
at the construction site at all times during construction. If safety or traffic conditions
warrant such action, NCDOT reserves the right to further limit, .restrict, or suspend
.operations within the right of way.
3) The encroaching party is required to contact the appropriate Utility Companies involved
and make satisfactory arrangements to adjust the utilities in conflict with the proposed
work prior to beginning construction.
4) Trenching, bore pits and/or other excavations shall not be left open or unsafe overnight.
The Contractor shall comply with all OSHA requirements and provide a competent
person on site to supervise excavation at all times.
5) All fill areas/backfill shall be compacted to 95% density in accordance with AASHTO
T99 as modified by the NCDOT. All material to a depth of 8 inches below the finished
surface of the subgrade shall be compacted to a density equal to 100% of that obtained by

compacting a sample of the material in accordance with AASHTO T99 as modified by
the Department. The Contractor shall dry or add moisture to the subgrade when required
to provide a uniformly compacted and acceptable subgrade. All material placed in a
maximum of 6" lifts.
6) All earth areas disturbed shall be graded, dressed, seeded, mulched, and tacked with
liquid asphalt or other approved means within 10 days of completion of work in any area.
7) All workmanship and materials shall conform to North Carolina Department of
-- Transportation Standards and Specifications manual.
8) The encroaching party shall comply with all applicable federal, state and local
environmental regulations, and shall obtain all necessary federal, state and local
environmental permits, including but not limited to, those related to sediment control,
storm water, wetland, streams, endangered species and historical sites.
9) - All existing structures, pavement, drainage or otherwise, located inside the Right of Way
that are affected by this. work .shall be restored to meet the NCDOT Standards and
Specifications as directed by the District Engineer.
10) Ingress and egress shall be maintained to all businesses and dwellings affected by the
project.
11) Traffic Control Devices shall be in accordance with the manual on Uniform Traffic
Control Devices and amendments or supplements thereto. Proper traffic control devices,
signs, etc., shall be installed to insure public safety.
12) During non-working hours, equipment shall be parked as close to right of way lines as
possible and be properly barricaded in order to not have any equipment obstruction
within the Clear Recovery Area.
13) All roadway signs that .are removed due to construction shall be reinstalled as soon as
possible, but at least by the end of the same workday.
14) Excavation material shall not be placed on pavement. Drainage structures shall not be
blocked with excavation materials.
15) All soils located inside the Right of Way shall be considered a type "C" soil. All
trenching, shoring and excavation shall follow the OSHA guidelines for this type of soil.
16) Crossing by bore only no open cuts will be permitted.
17) All roadway crossings that exceed 6" shall be encased.

18} All roadway crossings by dry bore method shall be a minimum of 3 feet below the
elevation of the existing roadway and 2 feet below the existing ditch.
19) Pipe encasements shall extend from ditch line to ditch line in cut sections, and 5 (five)
feet beyond toe of slope in fill sections, and 3 (three) feet behind curb sections.
20) All utilities shall be placed in accordance with the manual on Policies and Procedures for
Accommodating Utilities on the Highway Rights of Way.
21) All splice boxes, manholes, and other appurtenances within the NCDOT right of way
shall be located at/outside the right of way line. Manholes and/or vaults shall not be
placed in the ditch line, side slopes of the ditches, or in the pavement.
22) Any drop off greater than 2" from the edge of pavement shall be made safe by using a 6:1
slope or flatter or a width. of 6 feet

This letter is to confirm that a complete Engineer's Report and a Water System Management Plan have been
received, and that engineering plans and specifications have been approved by the Department for
BRIDGEWATER SOUTH, DEH Serial No. 06-01699.
The Authorization to Construct is valid for 24 months from the date of this letter. Authorization to Construct
may be extended if the Rules Governing Public Water Supplies and site conditions have not changed. The
Authorization to Construct and the engineering plans and specifications approval letter, shall be posted at the
primary entrance of the job site before and during construction.
Approval must be secured from the Department before any construction or installation if:
• Deviation from the approved engineering plans and specifications is necessary; or
• There are changes in site conditions affecting capacity, hydraulic conditions, operating units, the function
of water treatment processes, the quality of water to be delivered, or conditions imposed by the
Department in any approval letters.
Upon completion of the construction or modification and in accordance with Rule .0303, the applicant shall
submit a certification statement directly to SIRAJ CHOHAN of this office. This statement must be signed and
sealed by a registered professional engineer stating that construction was completed in accordance with approved
engineering plans and specifications, including any provisions stipulated in the Department's engineering plan and
specification approval letter. Prior to Final Approval, the applicant shall submit a signed certification stating that
the requirements in 15A NCAC 18C .0307 (d) and (e) have been satisfied and if applicable, a completed
application for an Operating Permit and fee. Once the certification statements and operating permit application
and fee, if applicable, are received and determined adequate, the Department will grant Final Approval in
accordance with Rule .0309 (a). Therefore, no construction, alteration, or expansion of a water system shall be
placed into service until Final Approval has been issued by the Department.

Enclosed please find one copy of the "Application for Approval:.." together with one copy of the referenced plans and
specifications bearing the Division of Environmental Health stamp of approval for the referenced project. These plans and
specifications are approved under Division of Environmental Health serial number 06-01699, dated October 19, 2006.
Plans and specifications prepared by J. Stephens Janowski, P.E:, call for the installation of approximately 3,179 feet
of 8-inch water main, valves, hydrants and other appurtenances along Peninsula Mooring Drive and Maritime Loop to provide
service to Bridgewater South Subdivision. The proposed 8-inch water main will tie to an existing 8-inch waterline on
SR 1339 (Creek Road).
Please note that an "Authorization to Construct" requires both this approval of Engineering Plans and Specifications and
submittal of a complete Water System Management Plan. No construction shall be undertaken, and no contract for construction,
alteration, or installations shall be entered into until the Department issues an Authorization to Construct letter in accordance
with 15A NCAC 18C .0305(a).
These plans and specifications in the foregoing application are approved insofar as the protection of public health is
concerned as provided in the rules, standards and criteria adopted under the authority of Chapter 130A-317 of the General
Statutes. This approval does not constitute a warranty of the design, construction or future operation of the water system.
One copy of each enclosed document is being forwarded to our Washington Regional Office. The third copy is being
retained in our permanent files.

Location description An 88.966 acre parcel located on either side of Archibell Creek Road (NCSR 1339) immediatley
north of Adams Creek and fronting Bath Creek near the Town of Bath in Beaufort County, North Carolina.

A. Preliminary Determination
_ Based on preliminary information, there maybe wetlands on the above described property. We strongly suggest you have
this property inspected to determine the extent of Department of the Army (DA) jurisdiction. To be considered final, a
jurisdictional determination must be verified by the Corps. This preliminary determination is not an appealable action
under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331).
B. Approved Determination
_ There are Navigable Waters of the United States within the above described properly subject to the permit requirements of
Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or
.our published regulations, this determination maybe relied upon for a period not to exceed five years from the date of this
notification.
X There are wetlands on the above described property subject to the permit requirements of Section 404 of the Clean Water
Act (CWA)(33 USC § 1344). Unless there is a change in the law or our published regulations, this determination maybe
relied upon for a period not to exceed five years from the date of this notification.
_ We strongly suggest you have the wetlands on your property delineated. Due to the size of your property and/or our
present workload, the Corps may not be able to accomplish this wetland delineation in a timely manner. For a more timely
delineation, you may wish to obtain a consultant. To be considered final, any delineation must be verified by the Corps.
_ The wetland on your property have been delineated and the delineation has been verified by the Corps. We strongly
suggest you have this delineation surveyed. Upon completion, this survey should be reviewed and verified by the Corps.
Once verified, this survey will provide an accurate depiction of all areas subject to CWA jurisdiction on your property
which, provided there is no change in the law or our published regulations, may be relied upon for a period not to exceed
five years.
X The wetlands have been delineated and surveyed and are accurately depicted on the plat signed by the Corps
Regulatory Official identified below on 8/29/2006. Unless there is a change in the law or our published regulations, this

_ Please be advised that a Prior Converted Cropland (PC) determination made by the Natural Resource Conservation Service
(MRCS) remains valid as long as the area is devoted to an agricultural use. If the land changes to a nonagricultural use,
the PC determination is no longer applicable and a new wetland determination is required for Clean Water Act purposes.
_ There are no waters of the U.S., to include wetlands, present on the above described property which are subject to the
permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law or our
