Stipulations:
The City of Albemarl e has requested SO C WQ S1 9-007 for its Long Creek WWTP, a 12.0 MGD WWTP
th at discharges treated wastewater to the Long Creek, via Outfall 00 1, Class C in the Yadkin-Pee Dee River
Basin. The County is unable to consistently comply with the final effluent limits, including Biochemical
Oxygen Demand (BOD), Ammonia Nitrogen, and Total Suspended Solids (TSS), and with operational
requirements as set forth in NPDES Permit NC0024244 due to high levels of inflow and infiltration entering
the City’s sewer lines, and the WWTP’s inability to handle low influent concentrations of BOD. The City
also holds North C arolina Collection System Permit WQCS00016 for operation of an existing wastewater collection system, but is unable to consistently comply with Condition 1.2 regarding sa nitary sewer
o verflows (SSOs) as set forth in Collection System Permit WQCS00016. Compliance will require
preparation of plans and specifications for collection system upgrades including, but not limited to, pump
station upgrades/improvements and se wer lin e (force main) rehabilitation to be conducted in three phases.
Fu nding:
The City submitted the proposed project improvements to NCDEQ DWI for September 30, 2019 application
cycle.

Civil Penalties to be held in abeyance as stated in the SOC paragraph 3(a) and 3(b):
Th e City has outstanding civil penalty assessmen ts that total $60,054.33. As settlement of all alleged
violations of NPDE permit number NC0024244 p rior to entering into this Special Order by Consent, the
City agrees to pay an upfront penalty amount of $1,679.33 , with the remaining amount of $5 8,375 .00 to
be held in abeyance until the successful completion of this SOC.
NOTE: Payment of upfront penalty was received.
At the successful conclusion of this Special Order by Consent, the penalty amount held in abeyance
($58,375 .00) will be remitted. Should th e Special o f by Consent not reach a successful concl usion, the full remaining penalty amount of $58,375.00 will be due immediately b y check payable to the North
Carolina Department of Environmental Quality and forwarded to the Director.
Additional Flow Allocation:
No addition flow will be allocated for this SOC.

The Long Creek WWTP improvements will include implementation and/or construction of the following items:

• Perform electrical upgrades to the electrical grid at the WWTP to ensure reliability of WWTP in
accordance with 15A NCAC 2H .0124.
• Conduct engineering study of hydraulic loading to individua l waste treatment trains to operate
aeration basin and secondary clarifier train independently of other treatment trains to accommodate f luctuating f lows into WWTP.
• Perform necessary construction, piping, and valving to operate each treatment train independently of
each other.
