APPROVAL OF STORMWA TER MANAGEMENT PLAN (SMP) - MODIFICATION

The Division of Water Quality (DWQ) has reviewed your application dated April 21, 2010 requesting for
modification to the previous SMP approval dated August 7, 2006 and subsequent DWQ approval
modifications dated October 31, 2007, November 3, 2008 and June 30, 2009. The requested
modifications, as shown on the Drainage Area Map and Exhibits (S 1- S3) received by DWQ on April
22, 2010, include:
1. Revised site layout and increase in impervious areas for portions of drainage areas 1 and 3
(draining to wet ponds 1 and 3 respectively);
2. Revised site layout and increase in impervious areas for bypass areas B and F; and
3. Revised site layouts with no change in the amount of impervious area for drainage area 4
(draining to wet pond 4)
The DWQ has determined that the proposed modifications do not require structural modification to any of
the stormwater best management practice (BMP) devices. As a result, the DWQ approves the requested
modifications, and accepts the previously approved SMP and BMP devices to satisfy the stormwater
condition required by the Individual Water Quality Certification issued on May 9, 2006. You are required
to meet the following conditions:
1. The stormwater treatment system, which includes six wet detention ponds, preformed scour
holes, and forested filter strips, and the signed and notarized Operation and Maintenance
Agreements dated October 17, 2008, as approved by this Office, and the drainage patterns
depicted on the plans, must be maintained in perpetuity. No changes to the structural stormwater
practices shall be made without written authorization from the Division of Water Quality. The
stormwater management structures shall have maintenance access and at least 10-foot drainage
easement on each side to allow for the ability to maintain the structures, to perform corrective
actions and shall provide protection of the structures from potential alterations by future property
owners.
2. Stormwater best management practices (BMPs) for future phase developments shall be in
accordance with the most current version of the NCDENR Stormwater Best Management
Practices Manual at the time of the development.

3. Any further increase in the impervious amount of a bypass area beyond that listed in Attachment
A (Briar Chapel Master Impervious Area Summary) will require water quality treatment, and
must be approved by the DWQ.
4. The permittee shall ensure that the maximum built upon (BUA) area per lot tabulated in Exhibit F
of the recorded Declaration of Covenants and Restrictions for Briar Chapel shall be updated to
reflect the most current approved BUA amount in Attachment A.
5. The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing
at the letterhead address within ten (10) days of the commencement of construction.
