The undersigned, EBX Neuse 1, LLC the Sponsor of the EBX Neuse Riparian Buffer Umbrella
Mitigation Bank (DWQ Number 08-1473), hereby certifies the following:
1. Elliot Cowey has deposited monies with the Sponsor sufficient to acquire 112.5
Buffer Credits (square feet) from the Bank for use on its Lot 7, Evans Mill
project, City of New Bern, in HUC 03020204 of the Neuse River Watershed.
2. The Elliot Cowey project requires a total of 112.5 Buffer Credits as mitigation.
Of this amount 112.5 Buffer Credits are being provided by the Bank.
The Sponsor has deducted 112.5 Buffer Credits from the Bank's credit ledger for
HUC 03020204 of the Neuse River Watershed.
A copy of the Bank's Credit ledger reflecting the above transaction is attached to this Affidavit.

DDJ Investments, LLC has deposited monies with the Sponsor sufficient to
acquire 731.85 Nutrient Reduction Credits (pounds of Nitrogen) from the Bank
for use on its Jimmies Creek Maxi-Storage project, City of New Bern Permit
Number 86, in HUC 03020204 of the Neuse River Watershed.
2. The Jimmies Creek Maxi-Storage project requires a total of 731.85 Nutrient
Reduction Credits as mitigation. Of this amount 731.85 Nutrient Reduction
Credits are being provided by the Bank.
3. The Sponsor has deducted 731.85 Nutrient Reduction Credits from the Bank's
credit ledger for HUC 03020204 of the Neuse River Watershed.
