We have a stormwater management plan that calls for improving the existing zone I which has been used for crops by providing vegetation and stabilization. We have proposed some sub-surface storage in stone and surface storage as dry detention areas within the zones I and II. We feel the intent of the buffer rules is to protect existing grades and vegetation that serve a useful purpose in nutrient removed in the transmissibility zone of the soil. We feel the regulations also recognize that not all buffer areas serve an adequate function for stabilization of nutrient removal. We agree with the position taken by the Division of Water Quality that the zone I protection is of paramount importance as determined by the statutes and that any impact of that zone should be thoroughly reviewed particularly if the zone I is in a natural and functional state. We also feel the zone I areas that do not perform nutrient uptake, allows point source discharge and contributes to slope bank degradation should be constructed to performs the statutes requires. The zones are filter areas by statute and should be allowed under the rules to be created where they do not exist. Paragraph 6 of 15A NCAC 02B.02591ists several exceptions to the zone I requirements including: 1. New ponds to meet buffer rules except dry ponds. This appears to allow dry ponds by exemption. 2. Protection of existing structures, facilities, stream bank is an allowable condition. 3. Stormwater management ponds excluding dry ponds are an allowable use as long as the buffer setbacks are provided. This appears that dry ponds are allowed and exempt from the rules. 4. Streambank stabilization allowed. 5. Planting vegetation to enhance the riparian buffer exempt. Our proposed plan eliminates existing point source discharge, contains the runoff from the ten-year storm, provides for drainage through filter fabric, sod and sand, provide bank stabilization and allows for plantings along the buffer that are not now present. A copy of our plan is provided along with our computations required by the Town of Winterville for their management program. Please advise us of your use of the rules.
