Dear Mr. Scarbraugh,
This letter and PCN application is in reference to the Notice of Violation for the John
Geewax property located in Ocracoke, Hyde County, North Carolina.
Enclosed is a site plan that shows the existing house and walkway along the bulkhead
which was intended to provide access to piers and boat slips at the east end of the
property without having to create a driveway to this end of the property. The "future"
houses shown on the site plan are only a demonstration of what could be constructed
on the existing lots. If future development occurs Mr. Geewax will apply for the state
and local permits needed prior to any construction activities.
In addition we included an authorization letter and a copy Mr. Geewax's letter
describing in detail his reasons and justification for the construction of the wood
walkway in Tar/Pamlico Buffer.

Dear Mr. Hodge,
I am in receipt of your letter dated January 8, 2010, which I received January mid-month. Let me first
say that it would never be my intention to purposefully violate any of the environmental laws intended
to protect a resource that I feel strongly in protecting. I know my property is a sensitive one, and have
done everything to limit my demands on it. As you may be aware from your inspection, I have just
recently planted over sixty trees along my access drive to try and re-establish some cedars along the
marsh for stabilization. I also installed a cistern for toilet and exterior use, even though I had a
municipal supply for my home. I was also able to establish dune cover on the west side (back) of my
house and the large dune, as these areas are protected from storm surges; unlike the eastern part of my
property near the bulkhead. There lies the crux of the problem - any dune grass seeding I had done
along that part of the bulkhead has been washed away - this has been going on for four years now.. I
believe the Division of Coastal Management can verify this.
In following the outline your letter provides, I would like to take this opportunity to respond to your
request to explain: how this violation occurred, and to get input from you and your colleagues as to
what would be a suitable "detailed restoration and monitoring plan".
1) Please explain when construction occurred at the site, and clearly explain why appropriate
regulations were not followed.
The site includes three contiguous lots, with the middle one further subdivided into three
sound-front lots - all plotted before 1975. We were allowed to dredge two areas for water
dependant structures on these contiguous lots. The first, close to the far eastern side of the
middle lot(s), is for a boat dock. The second is for the far eastern lot, which also has been
dredged for a boathouse. Both of these structures are permitted, and will be built this coming
year. According to the Division of Coastal Management's "Fast Facts: Coastal Shoreline Buffer
Rules", in Zone 1 (the first 30 feet landward from the normal high water level), "Only
structures with water dependant uses may be built in the buffer zone. These include docks,
boat ramps, bulkheads on eroding shorelines, and walkways to the water". The Division of
Water Quality in summarizing the "Table of Uses" (15A NCAC 02B.0259(6)) in their brief
pamphlet entitled "Buying Property and the State's Riparian Buffer Rules" have the example
of a single family driveway crossings of stream that impact less than ...or 2,500 square feet of

riparian buffer. It lists this use as exempt. I assume that crossing a stream/buffer to use the
other part of one's property is very similar to crossing the buffer to use a water dependant
structure. Furthermore, my wooden slotted deck is pervious (by statute definition, although a
permanent impact as per DWQ's clarification), unlike a driveway. When constructed in
September 2009, 1 thought a three foot wide walkway to a permitted water dependant
structure was, by statute, allowable and under your example exempt.
Uses designated as exempt are allowed within the riparian buffer (15A NCAC 026.0259(7)).
Exempt uses shall be designed, constructed, and maintained to minimize soil disturbance, and
to provide the maximum water quality protection practicable (15A NCAC 02B.0259 (7) (a)). I
think I will meet these requirements.
As noted earlier, nothing was growing on that part of the property frorn the day I purchased
it. In its past, the area was used to store dredged sand. My plan was to use the slatted
walkway as a storm/wave surge suppressant, and then create a dune behind it that I would
plant in sea oats/grass (e.g.). I planned on starting on the west side, and to continue in stages
to the east. Stages will be utilized due to irrigation (via drip lines - which have already beer)
purchased) needed to establish the grass. This ultimately will stabilize the area - limiting
future soil disturbance.
As walkways to the water dependant structures are allowed, the current location of the one
walkway not only serves to stabilize the first three feet of buffer to allow grass to be
established behind it, but it also is the least intrusive in total square footage - especially in
light of Buffer interpretation/Clarification #2009-004, which states that only "one access path
is allowable per single family residence". Furthermore, the path to the water dependant
structures is limited in the use of Zone 2 due to septic requirements, normal driveway
requirements, and home placement requirements. The pathway also will allow for normal
maintenance of the water dependant structures without any future disturbance.
2) A Map of the Restoration Site.
I have attached map(s) of the contiguous lots in question with the location of the permitted
water dependant structures. Please not that "Lot 3" in your letter is really lots 3, 4 and 5 of
Trent Woods 2 Subdivision (PC A. SL 178A).
3! Restoration Plan.
As stated before, nothing was growing in Zone 1 where the elevated wooden slatted walkway
was constructed. There was no pre-existing vegetation. The walkway was the start of a plan
to try to establish in this area grass cover. It would serve two purposes: stop storm damage
from not allowing grass to grow in Zone 1, and having the least intrusive allowable water
dependant access from the residence to the structures.

Ailo,,vabie, Allowable with Mitigation, or Prohibited to see if instead of removal/variance, rather another
notification/process would be appropriate; or if the current location is a very logical solution for a
sensitive site and is by statute allowable.

Five single family residential lots. One lot has two story residence with a pier and gazebo. All shoreline has been
bulkheaded and armored with riprap. A X x 550' wood walkway is located on the landward side of the bulkhead.

Construction of a 3 foot wide wood slatted walkway parallel to the bulkhead to provide access to the existing and
permitted piers for the five separate sound front lots. The walkway is providing access to the permitted piers which
provides a deep water connection to Cohcran channel. It is also stabelizing the area behind the bulkhead which
continually washes out material and vegatation that has been planted several times.
