Salisbury Street Raleigh, NC 27604 Re: Beverly Subdivision Request for GC 4139 SAW-2017-01300 Sage Project #2017.33 On behalf of GHD-Beverly, LLC (applicant and owner), please find attached a complete application and supplemental information requesting written concurrence from the NC Division of Water Resources (NCDWR) that the activities associated with the proposed development of the Beverly Subdivision (Project) may proceed under General Certification 4139 (GC 4139) and 15A NCAC 02B .0233. Please note that an application requesting the use of Nationwide Permit (NWP) 29 was submitted to the USACE under a separate cover on October 20, 2020. This application does not seek to replace the previous application to the USCE. Project Purpose and Location The proposed Project is a single-family residential subdivision being constructed to meet the demand for housing in this area. The Project is located east of Old Barbour Road and west of Reedy Creek Road in Four Oaks, Johnston County, NC. Johnston County lists the parcel PIN as 164300-16-2772. The approximate center of the property is located at Latitude: 35.4985°N; Longitude: 78.5239°W. Project Detail The proposed single-family residential subdivision will include construction of roadways, amenities, and utilities. Access to the development will be provided by two connections to Reedy Creek Road. Water and wastewater services for the homes will be provided by onsite wells and individual septic. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull -dozers, etc.) will be utilized. According to the NCNHP Report updated October 16, 2020, no threatened or endangered species are present on the Site or within 1.0 mile of the Site. No historic structures or historic districts are identified as being present on the Site itself or immediately adjacent to the Site. A cemetery with unmarked graves is located in the southeastern portion of the property which is currently surrounded by an agricultural field. The cemetery will remain in a separate undeveloped area within the subdivision. Beverly Subdivision Page 1 of 3 Project History The Site has historically been utilized for agriculture and silviculture. Forested areas surround the drainages. A portion of the Site has been cleared for construction, but no work in Waters of the US has been initiated. Land use in the vicinity consists of undeveloped, forested land, agricultural land, and rural residential properties. Mr. David Gainey and Mr. Sean Clark of Sage Ecological Services, Inc. (Sage) completed a wetland, stream, and riparian delineation on the majority of the Project area in 2017. A PJD request was submitted to Sam Dailey of the USACE on June 22, 2017 for the initial Project area and a PJD request was submitted to Ross Sullivan of the USACE in 2018 for the southeastern portion of the Project that was later added on. Mr. Ross Sullivan of USACE performed a preliminary jurisdictional determination site meeting on November 9, 2018 for the additional parcel. An NWP 29 application was submitted on July 8, 2019 (SAW-2017-01300) for the entire Project by another party. The application was not approved as proposed, and this application is intended as a revision and update to the previous submittal. Construction has occurred in some upland areas but has not extended to jurisdictional areas so no impacts have occurred. Avoidance and Minimization The proposed homes and roads were realigned from the initial plans so as to minimize impacts to wetlands, streams, and riparian buffers. Road crossings were designed to cross perpendicular to jurisdictional features in a further effort to minimize impacts. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to provide additional protection from runoff. Project Impacts Proposed permanent wetland impacts total 0.131 acre due to fill from roadway crossings. Temporary wetland impacts total 0.01 acre due to septic line installation. Areas of temporary wetland impact will be returned to original grade and the native topsoil from those area reused to provide a seed source for revegetation. Proposed permanent stream impacts total 91 linear feet (LF) of which 51 LF will result from culverting for a roadway crossing. A total of 40 LF of permanent, no loss stream impact results from a riprap dissipator pad in the stream downstream of the culvert outlet. The culvert bottom will be buried to provide aquatic life passage as required by the conditions of the permit and general condition. The riprap within the stream and on the banks will be keyed into the soil material so that the resulting elevation of the riprap material will be the same as the existing, which will allow for aquatic life passage. Proposed permanent riparian buffer impacts to Zone 1 total 3,582 sf for a road crossing and 1,185 sf for stream bank stabilization associated with the road crossing. Permanent Zone 2 impacts total 2,419 sf due to a road crossing. Total buffer impacts associated with the road crossing total 0.17acre. No other impacts are proposed. Mitigation Permanent wetland impacts are 0.131 acre; therefore, the purchase of wetland mitigation credits at a 2:1 ratio from a bank is proposed. The Statement of Availability Letter from the Neu -Con Wetland & Stream Umbrella Mitigation Bank - Meadow Spring Site for 0.27 riparian wetland credits is attached. Permanent stream impacts are less than 150 LF and construction efforts are proposed to lessen the impact and beveny bubdivision Nage z or j maintain aquatic life passage; therefore, no stream mitigation is proposed. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The initial site plan proposed roads and lots much further west which would have resulted in larger wetland impacts. The site plan has been redrawn a few times in an effort to reduce and avoid impacts. The currently proposed lots and roads were aligned so as to minimize impacts to wetlands, streams, and riparian buffers. Road crossings were designed to cross perpendicular to jurisdictional features. Lot fill has been avoided completely. The road crossing in the vicinity of Impact 2 was repositioned so as to avoid impacting the large wetland area within the drained pond to the east however the result was the impacts to the upper end of two drainages as well as the drainage below the drained pond but still created less impacts than if the drained pond was crossed. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to provide additional protection from runoff. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The project will be constructed in phases as opposed to mass grading all at once. This will decrease the potential for sediment runoff into the wetlands and streams and overall keep the site more stable. General techniques include the use of construction fencing to define the construction corridor and prevent any accidental additional impacts.
