A request for riparian buffer compliance is also included in this application. A Nationwide Permit (NWP) 29 and corresponding General Certification (GC) #4139 were issued for this project on April 10, 2020 (USACE SAW-2017-01248) and March 18, 2020 (NCDWR #20-0140). The City of Raleigh is requiring that the energy dissipater located below the proposed road crossing be extended from 20 feet to 50 feet in length. All other proposed impacts are the same as what was previously approved. Project Summary and Purpose The proposed project includes the construction of a residential subdivision with associated roads and utilities which will connect to existing adjacent infrastructure in the area. The +/-22-acre project is located at 3124 Garner Road in Raleigh, Wake County, NC. Wake County lists the parcel PIN as 1702-83-8607. The approximate center of the property is located at Latitude: 35.737907' N; Longitude: 78.633097' W. The purpose of the proposed project is to construct a residential subdivision to meet the demand for housing in this part of Wake County, NC. Project Detail The overall project consists of a single-family residential townhome subdivision. Proposed road construction and culverting will result in permanent stream and riparian buffer impacts. Utilities for the proposed project will connect to those existing on and adjacent to the Site. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull -dozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the Project according to the NC Natural Heritage Program (NHP) Database (January 2020). See attached letter from NHP. Liberty Station Subdivision Page 1 of 2 No historic properties are listed on the Project based on a query of the NCSHPO HPOWEB GIS Service website accessed January 13, 2020. Seven historic properties are listed within 0.25-mile of the Project. Three properties are designated as "Surveyed Only" (WA2462, WA2458, and WA8142) and one property is designated "Surveyed Only — Gone" (WA2459). Site WA4566 is a Surveyed Area north of the Project. Site WA2460 is the Beasley Store & Houses directly across Garner Road from the Project. This site is designated "Blockface" indicating multiple properties were surveyed as a group. To the south, Site WA2461 (former Governor Morehead School for Colored, Blind, and Deaf) is adjacent to the Project. This property is designated as "Study List — Determined Eligible" and is currently the INC Highway Patrol Training Academy. Protect History The Site has been forested since prior to the earliest reviewed orthophotography (1993). A PJD was requested and a field determination site meeting was held on July 11, 2017, with Ms. Tasha Alexander (Corps) and Mr. Sean Clark of Sage Ecological. A PJD was issued on April 10, 2020. A NWP 29 was also issued on April 10, 2020. Additionally, a GC 4139 was issued by NCDWR on March 18, 2020. However, the City of Raleigh has requested for the riprap to be extended downstream of the proposed culvert. Avoidance and Minimization Proposed roads were aligned so as to avoid and minimize impacts to streams and wetlands. Lots were positioned so as to avoid lot fill in streams and adjacent wetlands. Open space was provided around drainages containing jurisdictional streams. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. Project Impacts Proposed permanent stream impacts total 129 Linear Feet (LF) as a result of culverting for a road crossing. Proposed permanent stream impacts due to riprap keyed into the stream channel total 50 LF. Proposed temporary stream impacts total 40 LF as the result of a proposed perpendicular sewer utility crossing. No wetland impacts are proposed. Permanent riparian buffer impacts will result from sewer utility construction, road construction, and a BMP outfall. Total Zone 1 impacts total 11,841 square feet and Zone 2 impacts total 8,497 square feet. Mitigation Permanent stream, no loss impacts have been minimized to less than 150 LF, therefore, no stream mitigation is proposed. No wetland impacts are proposed so no wetland mitigation is proposed. Riparian buffer impacts are "Allowable" per the Table of Uses; therefore, no riparian buffer mitigation is proposed. If you have any questions, please call me at (919) 244-0623. Sincerely, Sean Clark Sage Ecological Services, Inc. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Proposed roads were aligned so as to avoid and minimize impacts to streams Mile connecting to existing stub roads off site and avoiding utilities. Lots were positioned so as to avoid lot fill in streams. Open space was provided around drainages containing jurisdictional streams. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: General techniques include the use of construction fencing to define the construction corridor and prevent any accidental additional impacts. Silt fencing and temporary basins will also be used to prevent sediment runoff into the stream. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State? r Yes r No 2b. If this project DOES NOT require Compensatory Mitigation, explain why: Impacts were minimized and avoided as much as possible. There are no proposed wetland impacts. The 129 LF of permanent stream impacts resulting from the installation of the culvert were minimized as much as possible while maintaining street width requirements and safe fill slopes. The additional permanent stream impact resulting from the riprap dissipater should not be considered a loss to aquatic function because the riprap will be keyed into the bed and bank material so that the post construction elevation is the same as ebsting. A query of the NCNHP database indicates that there are records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. These results are presented in the attached `Documented Occurrences' tables and map. The attached `Potential Occurrences' table summarizes rare species and natural communities that have been documented within a one -mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile radius of the project area, if any, are also included in this report. If a Federally -listed species is documented within the project area or indicated within a one -mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here: httr)s://www.fws.gov/offices/Directory/ListOffices.cfm?statecode=37.
