new boatlifts and gazebo.

9. PROJECT DESCRIPTION:
The project site encompasses approximately 0.05 acres and is located at 414 Loder Ave., adjacent to the
AIWW/Myrtle Grove Sound, in Wilmington, New Hanover County. To locate the property, take
College Road south from Wilmington towards Carolina Beach. Turn left onto Piner road at the
intersection of S. College Road and NC Hwy 421, and follow until you reach a stop sign at Myrtle Grove
Road. Turn right onto Myrtle Grove Road and travel south approximately 0.4 mi. until you reach Loder
Ave., which would be located on the left. Continue traveling east until the road turns to the right onto a
gravel road. The property of interest will then be on the left. The applicant currently maintains an
elevated single-story residence on the property. The 51 linear feet of shoreline is stabilized by a
bulkhead. The highground portion of the property is primarily wild grass. The area waterward of the
existing bulkhead consists of mixed §404 Wetlands type vegetation and Coastal Wetlands, which
includes: Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), Sea Ox-eye (Borrichia
frutescens), and Salt Meadow Grass (Spartina patens). Low marsh consists primarily of Smooth
Cordgrass (Spartina altern~ora), which covers an area approximately 120 feet in width towards the
AIWW.
The applicant received CAMA Minor Permit No. OS-48 for the bulkhead and additional fill material to
raise the elevation of the property to match that of both adjacent riparian property owners. The
applicant also maintains a private pier and floating dock waterward of his residence, which was
authorized under CAMA General Permit No. 41517-D. The access pier extends towards the AIWW for
a distance of approximately 189', by 6' in width. The structure spans approximately 120' of marsh. The
pier then terminates onto a floating dock measuring 40' in length by 6' in width, which runs
perpendicular to the shoreline, and is accessed from a gangway ramp. The existing docking facility
could potentially accommodate up to four vessels, however, the CAMA General Permit only authorizes
up to two vessels. The application states that the water depths at the terminal end of the docking system
range from approximately -3.0' to -4.0' @ Mean Low Water (MLW) (See Sheet 4 of 7). Based on site
visit on March 27, 2007 at 10:00 a.m., water depths were approximately -1.0' to -2.0' @ Normal Low
Water (NLW) at the location of the existing floating dock.
The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation. The waters of
the AIWW in the vicinity of the project site are classified as Outstanding Resource Waters (ORW) by
the NC Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the NC
Division of Marine Fisheries, and is OPEN to the taking of shellfish.

PROPOSED PROJECT:
The applicant proposes to expand an existing private docking facility with new boatlifts and gazebo.
A gazebo, measuring 16.5' in length by 12' in width, would be constructed on the north side of the
existing pier, approximately 16' short of where the pier terminates. The existing section of fixed dock
adjacent to the gazebo would be covered as well. The applicant also requests to convert the existing 40'
slips into four 20' slips. Two boatlifts would be installed on the terminal end of the pier. One boatlift,
measuring 13' in length by 12' in width, would be installed on the waterward side of the proposed
gazebo, and one single pole, rotating boatlift, measuring 13' in length by 12' in width, would be installed
on the southern side of the waterward end of the access pier. The applicant states that stops would be
installed on the boatlifts to prevent the boatlift cradles from resting on the substrate. The applicant also
states the proposed boatlifts would allow for safer access to vessels due to the tidal amplitude and the
frequent wake activity in this area of the AIWW/Myrtle Grove Sound. Furthermore. the applicant states
that the request to allow the existing floating dock to accommodate four vessels would rec~uirc no
structural change and would not restrict facility to allow transient vessels to utilize dock at any given
time. The expansion of the existing docking facility would accommodate a total of six vessels
(See Sheet 2 of 7 and Narrative).
10. ANTICIPATED IMPACTS:
The proposed expansion of the existing docking facility with gazebo and boatlifts would incorporate
approximately 510 sq. ft. of Estuarine Waters and Public Trust Areas. The existing footprint of the
facility would not extend waterward of the existing structure, which extends approximately 10~' into a
waterbody that measures approximately 615' across. This distance would conform to the 1/4 width rule
and would not extend beyond the established pier head length. As proposed, the applicant's proposal
would not encroach into the 80-foot setback from the AIWW. The docking facility as proposed could
potentially provide docking space for up to six (6) vessels.

NARRATIVE
The purpose of this CAMA major application is to install two boat lifts, add gazebo to
existing pier and floating dock, and convert the existing two 40' slips on each side of the
floater to four 20' slips.
Boat lifts applied for will have stops installed to prevent coming into contact with earth ~~~9,Q
and allow preservation of habitat beneath. The floater slips will allow a tie down waiting ~,~ _
area to utilize lift use during high tides, as well as maintain a safe boarding area while

wake activity of frequent boat traffic subsides. Furthermore; splitting each 40' slip to two
20' slips requires no structural changes and will maintain full compliance when two
transient vessels like jetskis are docked on one side of floater. After converting the
existing 40' slips #land #2 to the proposed 20' slips #1 through #4, the addition of the
boat lifts will create boat slips #5 and #6.
The additional lifts and gazebo are intended for personal craft and private residential use.

Provide lifts for personal boats/jetski out of the frequent wake activity from boats on Intercoastal Waterway. The lifts are to
be located to keep existing slips on each side of floating dock as tie down waiting area to utilize high tides for lift use, and
also allow safe boarding while wake activity subsides. The two existing 40' slips are proposed to be spilt into four 20' slips in
order to maintain compliance when docking two transient private watercraft on one side of floater at any time (no structure
changes or additional disturbance is needed to split the 40' slips).

of equipment and where it is to be stored.
Pylons will be hammer driven with minimal water-jet assist, conventional construction for decking and structure, all
equipment on steel barge to be stored on site through duration of project

Propose to install two boat lifts and add gazebo to existing pier and floating dock. The addition of the boat lifts will create
boat slips #5 and #6, after existing 40' slips #1 and #2 are converted to the four 20' slips #1-#4 described in Section b above.
One lift will be a typical 4 piton boat lift, while the other will be a small single piton lift for small craft like jon-boat or jet ski.
Boat lifts applied for will have stops installed to prevent contact with earth and allow preservation of habitat beneath.
Splitting the two existing 40' slips to four 20' slips does not require structure changes.
