R. 2459 (Eastfield Road) and S. R. 2475 (Prosperity Church Road) in northeast Mecklenburg County, travel northeast on S. R. 2459 approximately 1.8 miles to the junction with Bob Wallace Road (S. R. 1461) in west Cabarrus County. Turn right (east) and travel on S. R. 1461 approximately 1.4 miles to the end of the road. The proposed site is approximately 0.5 mile southeast of this point. 6. Discharge Point - Latitude: 350 23' 25" Longitude: 800 44' 10" Attach a USGS Map Extract and indicate treatment plant site and discharge point on map. USGS Quad No.: F 16 NW 7. Size (land available for expansion and upgrading): Adequate land area available for the construction and operation of the wastewater treatment plant, and further expansion if necessary. 8. Topography (relationship to flood plain included): Relatively flat with slopes of 0-50. The proposed site appears to be within the 100 year flood plain. The area is low lying, creek bottom land. 9. Type of Treatment (specify whether proposed or existing): The applicant was permitted to construct a 500,000 gpd wastewater treatment plant for a residential development (which is yet to be constructed). Currently, the applicant proposes to construct a 50,000 to 100,000 gpd treatment facility with all necessary features to meet DEM requirements to serve the first phase of the residential development. 5. Sludge Handling and Disposal Scheme: No sludge handling/disposal plan has been submitted. It is requested "that a comprehensive sludge management plan be submitted to the DEM for review and approval prior to the issuance of an Authorization to Construct. 6. Other: N/A Page Three PART IV - EVALUATION AND RECOMMENDATIONS NPDES discharge Permit No. NC 0064572, which expires on February 28, 1991, was issued to Vinson Crown Capital, Ltd. on March 21, 1986 for the construction and operation of a 500,000 gpd wastewater treatment plant to serve a residential development. To date the subject project has never been completed. Currently, the Permittee requests that the subject Permit be renewed for the construction and operation of a 50,000 to 100,000 gpd treatment plant to serve the first phase development of this project. It is anticipated that the Charlotte -Mecklenburg Utility Department (CMUD) will extend sewers to the projected area in the foreseeable future. When this becomes a reality, the proposed discharge will be connected to the Charlotte -Mecklenburg Utility Department system; consequently the wastewater treatment will be removed. It is recommended that the Permit renewal request be approved on condition that the proposed wastewater treatment plant be completed within 24 months from the date the new Permit becomes effective. EIVFDI Eta FEB 151990 PERMITS & ENGINEERING This Preliminary Engineering Report is a portion of the submittal for the renewal of the above NPDES Permit. The Owners of the above NPDES Permit request an extension to the permit in accordance with the policy " _ _ _ no later than 180 days prior to the expiration date." The property for which the proposed WWTP is to be constructed is now under option and is in the planning stages for immediate development. The first phase of development is intended to be serviced with a proposed WWTP of 50,000 GPD or possibly 100,000 GPD. The planning is to extend the CMUD sewer interceptor along Stony Branch to the site. (See copy of CMUD letter attached). At that time a pump station will be installed to pump the wastewater to the CMUD system. The WWTP will then be disconnected. The plant will be furnished with stand-by generator for emergency power at the plant. An automatic switch over will be furnished. Should additional treatment be required if the temporary plant flow reaches plant capacity before the CMUD interceptor reaches the area, a tertiary filter will be installed. Preliminary discussions have been held with a private utility company to operate the plant during the interrun period before CMUD sewers reach the site. See letter attached. The sketches of the original NPDES have been revised and redated for this submittal. Cockinos, P.E. 1 `5 199© Local Government Review Requirements for the Issuance of New Nonmunicipal Domestic Wastewater Discharge Permits General Statute Overview On October 1, 1989, an amendment to North Carolina General Statute 143-215.1, denoted as 143-215.1 (c) (6). became effective. The amendment allows input from local governments in the issuance of NPDES Permits for nonmunicipal domestic wastewater treatment facilities. The new language requires that the Commission (Environmental Management Commission) shall not act on an application for a new nonmunicipal domestic wastewater discharge facility until it has received a written statement from each city and county government having jurisdiction over any part of the lands on which the proposed facility and its appurtenances are to be located. The written statement shall state whether the city or county has In effect a zoning or subdivision ordinance and, if such an ordinance is in effect, whether the proposed facility is consistent with the ordinance. The Commision shall not approve a permit application for any facility which a city or county has determined to be inconsistent with its zoning or subdivision ordinance unless it determines that the approval of such application has statewide significance and is in the best interest of the State. Instructions to the Applicant Prior to submitting an application for a NPDES Permit for a proposed project, the applicant shall request that both the nearby City and county government complete this form. The applicant must submit a copy of the draft permit application and shall make a written request for this form to be completed to the clerk of the city and county by certified mail, return receipt requested. If a (or both) local government(s) fall(s) to mail the completed form, as evidenced by the postmark on the certified mall card(s), within 16 days after receiving and signing for the certified mail, the applicant may submit the application for a discharge permit. As evidence to the Commission that the local government(s) failed to respond within 16 days, the applicant shall submit a copy of the certified mail card along with a notarised letter stating that the local government(s) failed to respond within the 15 day period. Instructions to the Local Government The nearby city or county government which may have or has jurisdiction over any part of the lands on which the proposed facility or its appurtenances are to be located is required to complete and return this form to the applicant within 15 days of receipt. (3) An influent or effluent portion collected continuously over a period of 24 hours at a rate proportional to the flow. g. Grab Sample: A "grab sample" is a single influent or effluent portion which is not a composite sample. The sample(s) shall be collected at the period(s) most representative of the total discharge. 4. Test Procedures Test procedures for the analysis of pollutants shall conform to the EMC regulations published pursuant to N. C. G. S. 143-215.63 et seq, The Water and Air Quality Reporting Act, and to regulations published pursuant to Section 304(g), 33 USC 1314, of the Federal Water Pollution Control Act, As Amended, and Regulation 40 CFR 136. 5. Recording Results For each measurement or sample taken pursuant to the requirements of this permit, the permittee shall record the following information: a. The exact place, date, and time of sampling; b. The dates the analyses were performed; and c. The person(s) who performed the analyses. U4Z PART I Permit No. NC 6. Additional Monitoring by Permittee If the permittee monitors any pollutant at the location(s) designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring shall be included in the calculation and reporting of the values required in the Monthly Monitoring Report Form (DEM No. MR 1.0, 1 . 1 , and 1.4) Such increased frequency shall also be indicated. The DEM may require more frequent monitoring or the monitoring of other pollutants not required in this permit by written notification. 7. Records Retention All records and information resulting from the monitoring activities required by this Permit including all records of analyses performed and calibration and maintenance of instrumentation and recordings from continuous monitoring instrumentation shall be retained for a minimum of three (3) years, or longer if requested by the Division of Environmental Management or the Regional Administrator of the Environmental Protection Agency. PART II Permit No. NC A. MANAGEMENT REQUIREMENTS 1. Change in Discharge All discharges authorized herein shall be consistent with the terms and conditions of this permit. The discharge of any pollutant identified in this permit more frequently than or at a level in excess of that authorized shall constitute a violation of the permit. Any anticipated facility expansions, production increases, or process modifications which will result in new, different, or increased discharges of pollutants must be reported by submission of a new NPDES application or, if such changes will not violate the effluent limitations specified in this permit, by notice to the DEM of such changes. Following such notice, the permit may be modified to specify and limit any pollutants not previously limited. 2. Non compliance Notification If, for any reason, the permittee does not comply with or will be unable to comply with any effluent limitation specified in this permit, the per- mittee shall provide the Division of Environmental Management with the following information, in writing, within five (5) days of becoming aware of such condition: a. A description of the discharge and cause of noncompliance; and b. The period of noncompliance, including exact dates and times; or, if not corrected; the anticipated time the noncompliance is expected to continue, and steps being taken to reduce, eliminate and prevent recurrence of the noncomplying discharge. 3. Facilities Operation The permittee shall at all times maintain in good working order and operate as efficiently as possible all treatment or control facilities or systems installed or used by the permittee to achieve compliance with the terms and conditions of this permit. 4. Adverse Impact The permittee shall take all reasonable steps to minimize any adverse impact to navigable waters resulting from noncompliance with any effluent limitations specified in this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the noncomplying discharge. 5. Bypassing Any diversion from or bypass of facilities necessary to maintain compliance with the terms and conditions of this permit is prohibited, except (i) where U 0 0 T 7 PART II Permit No. NC unavoidable to prevent loss of life or severe property damage, or (ii) where excessive storm drainage or runoff would damage any facilities necessary for compliance with the effluent limitations and prohibitions of this permit. The permittee shall promptly notify the Water Quality Section of DEM in writing of each such diversion or bypass. 6. Removed Substances Solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be disposed of in a manner such as to prevent any pollutant from such materials from entering waters of the State or navigable waters of the United States. 7. Power Failures In order to maintain compliance with the effluent limitations and prohibitions of this permit, the permittee shall either: a. In accordance with the Schedule of Compliance contained in Part I, provide an alternative power source sufficient to operate the waste- water control facilities; or,if such alternative power source is not in existence, and no date for its implementation appears in Part I, b. Halt, reduce or otherwise control production and/or all discharges from wastewater control facilities upon the reduction, loss, or failure of the primary source of power to said wastewater control facilities. 8. Onshore or Offshore Construction This permit does not authorize or approve the construction of any onshore or offshore physical structures or facilities or the undertaking of any work in any navigable waters. Toxic Pollutants Notwithstanding Part II, B-4 above, if a toxic effluent standard or prohibition (including any schedule of compliance specified in such effluent standard or prohibition) is established under Section 307(a) of the Act for a toxic pollutant which is present in the discharge and such standard or prohibition is more stringent than any limitation for such pollutant in this permit, this permit shall be revised or modified in accordance with the toxic effluent standard or prohibition and the permittee so notified. , 6. Civil and Criminal Liability Excepl-. as provided in permit conditions on "Bypassing" (Part II, A-5) and "Power Failures" (Part II, A-7), nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance pursuant to N. V I &i'10 PART II Permit No NC 10. Expiration of Permit Permittee is not authorized to discharge after the expiration date. In order to receive authorization to discharge beyond the expiration date, the permittee shall submit such information, forms, and fees as are required by the agency authorized to issue permits no later than 180 days prior to the expiration date. Any discharge without a permit after the expiration will subject the permittee to enforcement procedures as provided in N. C. G. S. 143-215.6 and 33 USC 1251 et seq.. Part III Permit No. NC A. Previous Permits All previous State water quality permits issued to thin facility, whether for construction or operation or discharge, are hereby revoked by issuance of this permit. The conditions, requirements, terms, and provisions of this permit authorizing discharge under the National Pollutant Discharge Elimination System governs discharges from this facility. B. Construction No construction of wastewater treatment facilities or additions thereto shall be begun until Final Plans and Specifications have been submitted to the Division of Environmental Management and written approval and Authorization to Construct has been issued. If no objections to final plans and specifications have been made by the Division of Environmental Management within 60 days following acknowledgement that a complete set of final plans and specifications has been received, the plans may be considered approved and construction authorized. C. Certified Operator Pursuant to Chapter 90A of North Carolina General Statutes, the permittee shall employ a certified wastewater treatment plant operator in responsible charge of the wastewater treatment facilities. Such operator must hold a certification of the grade equivalent to the classification assigned to the wastewater treatment facilities. D. Groundwater Monitoring The permittee shall, upon written notice from the Director of the Division of Environmental Management, conduct groundwater monitoring as may be required to determine the compliance of this NPDES permitted facility with the current groundwater standards. E. If this facility is built in phases, plans and specifications for the next phase shall be submitted when the flow to the existing units reaches 80 of the design capacity of the facilities on line. At no time may the flow tributary to the facility exceed the design capacity of the existing units. F. The permit was issued in March, 1986 and expires in February, 1991. Recently (February 19, 1990), Technical Support received a wasteload allocation request for the renewal/modification of the permit. The facility has not received an Authorization to Construct (ATC) and we would like to have the permit rescinded based on the following informa- tion: 1) In June 1989, American Newland and Assoc. applied for an NPDES permit (at approximately the same location as Vinson Crown) for a 2.9 MGD dis- charge. The region was concerned about the sensitive wetland area near the mouth of Clarke Creek and asked John Dorney from our Planning Branch to visit the site. 2) On August 17, 1989, John Dorney visited Clarke Creek and confirmed the large existing wetland at the mouth of Clarke Creek (see attached memo) 3) The American Newland Permit request for discharge was denied at their proposed location on Clarke'Creek based on the existing wetland. 4) In addition, the Rocky River is experiencing oxygen depletion in the Mecklenburg/Cabarrus Counties due to over allocation of assimilative capacity. Vinson Crown's proposed location is approximately 0.8 mile from the mouth —of Clark Creek where it meets the Rocky River. 5) The previous Level B modeling analysis for the Vinson Crown discharge permit performed in August 1985, did not consider the wetlands, rather the receiving waters were modeled as a free flowing stream. Also, the modeling analysis did not consider the lower levels of DO predicted to occur in the Rocky River due to the interaction from upstream existing discharges. In summary, Technical Support cannot justify using results from the previous modeling analysis since more current information pertaining to the receiving stream were not previously considered. Furthermore, Technical Support has already denied a permit into this creek based on the wetland and we have not allowed any further discharge or expansion into this segment of the Rocky River until more data is gathered on the Rocky River and an intensive modeling analy- sis has been completed to evaluate the River's assimilative capacity. Please let me know your final decision concerning this matter, or let me know if I can provide further clarification. Dorney SUBJECT: Wetland Site Visit to Proposed American Newland Associates Project in Cabarrus County (NC 0077259) On August 17, 1989, I visited the above site with Mike Parker and Allen Hardy (Mooresville Regional Office). The purpose of the visit was to examine wetlands along Clarke Creek in order to determine whether the proposed 2.9 MGD discharge of treated domestic wastewater 'Would adversely impact the wetland. The wetland in question is a large, (about 200 acres) beaver meadow with scattered trees along the floodplain of Clarke Creek. The area has a very high diversity of plant species (about 35 species identified). Dominant species which we observed were Betula nigra, Salix nigra, Ulmus anmericana, Cornus amomum, Leersia oryzoides, Sium suave, Mikania scandens, Sagittaria sp., Hibiscus moscheutos, Potamogeton foliosus and Sarurus cernus. In addition, a very large Populus deltoides was seen which may be a state size record for this species (detailed measurement would be needed to confirm). The area also has a high diversity of aquatic life - beaver, wood duck, raccoon, deer, minnows, and amphibians. In addition, it is apparent that the wetland retains sustantial amounts of water and sediment during rainstorms. The flow pattern in the wetland is one of an extremely braided stream with numerous, small, shallow channels amongst grassy beds. In summary, the wetland would be an exceptional to high -normal value wetland for its aquatic life, water quality and water quantity benefits. I believe that the proposed discharge would have a severe adverse effect on the wetland. It is likely that the 2.9 MGD discharge into the numerous, small, braided channels in this area would result in severe scouring and subsegL,,- _-__.�_ -'-,:pening. This would probably result in destruction of wetlands adjacent to the scoured channel and dewatering of presently wet areas along the wetland edge. For these reasons, I believe that the proposed discharge permit should be denied since its approval would result in degradation of this wetland and loss of its uses both onsite and downstream. Column 1.—Enter the daily average value of the intake water at the point it enters the facility. If intake water is from more than one source, and enters the facility at separate entry points, the value given in column 1 should be weighted proportional to the quantity of flow contributed from each source. If water is treated before use, completion of this column is not required (see instructions for column 2). Values of intake are not required for mining activities. Column 2.—if all or part of intake water is treated before use, provide values for total intake here instead of in Column 1. Also describe briefly in item 26 "additional information," the type of treatment performed on intake water' (e.g., rapid sand filtration, coagulation, flocculation, ion exchange, etc.) and the percent of intake water contributing to this discharge that has been treated. Column 3.—Supply daily average value for the days when discharge is actually operating or is expected to be operat- ing (a new discharge). Daily average values are to be com- puted by weighting the daily value in proportion to the daily flow. If a discharge occurs irregularly, the value supplied in the column marked "Daily Average" should represent an average for the average for the days the discharge actually occurs. Average values are not to be supplied for pH, specific conductance, and bacteriological parameters (e.g., coliform bacteria). Columns 4 and S.—Supply minimum and maximum value observed (or expected for new discharge) over any one day when the discharge is operating. Column 6. —Specify the average frequency of analysis for each parameter as number analyses per number of days (e.g., "3/7" is equivalent to three analyses performed every 7 days). If continuous, enter "CONT." When analyses are conducted on more than one individual grab sample col- lected during the same day, the analysis frequency should reflect .one analysis whose value is the average of the individual grab sample measurements. Average frequency should be based on an operating month. Column 7.—Specify the number of analyses performed at the average frequency specified in column 6, up to 365. Column 8. —Specify sample type as follows: G For grab sample (individual sample collected in less than 15 minutes). #C For composite sample "#" is to be replaced by the average number of hours over which the composite sample was collected. Composite samples are com- binations of individual samples obtained at intervals over a time period. Either the volume of each in- dividual sample is directly proportional to discharge flow rates or the sampling interval (for constant - volume samples) is inversely proportional to the flow rates over the time period used to produce the composite. The parameter values can be determined either by use of one of the standard analytical methods as described in table A or by methods previously approved by the EPA Regional Administrator or Director of a federally approved State program (or their authorized representatives) which has jurisdiction over the State in which the discharge occurs. If the test used is not one shown in table A, the test procedure should be referenced in "Remarks" or on a separate sheet. If values are determined to be less than the detectable limit (as determined by referenced standard analytical techniques and/or instrument manufacturer's literature), specify "LT (value of detectable limit)" in the appropriate space. For example, if the detectable limit is .005 mg/I and quantities of less than this are determined, specify "LT .005." Do not enter descriptors such as "NIL," "TRACE," "NEG," etc., for this purpose. If it is your reasoned judgement that one or more of the required parameterf is not present in the initial untreated or treated process miter andl%r the discharge, enter an "A" (meaning "absent") in -the appropriate space. In order for values reported to be representative, it is recommended that they be based on from at least five to seven analyses of composite samples (if applicable).
