I had called you on the morning of July 23, 2008 and notified you of an accident at
our 7414 Millbrook Road, Harrisburg facility. Our permit number is NCG140290.
The accident occurred because a driver had not set his park brake and his truck
rolled into the office trailer and demolished it. There was a spill of hydraulic fluid
when an oil line was "clipped" by the handicap ramp. The spill was contained to a
small site with most being on the concrete. The Harrisburg Fire Marshal and Fire
Department responded as well as EMS, Building Inspections, Sherriff s
Department, Police Department and many others. The Fire Marshall was notified
that we were going to use DeBruhl Environmental Excavating, Inc. to do the
cleanup and he approved.
During our phone conversation, I promised to get you a copy of the report from
DeBruhl when it was finished. I have attached a copy of same for your review.

To Whom It May Concern:
On July 23, 2008, DeBruhl Environmental Excavating, Inc. (DEE) was contacted by Mr.
Michael Houser of MacLeod Construction Inc., to respond to a hydraulic oil spill at 7414
Millbrook Road, Harrisburg, NC.
Upon arriving on the scene, DEE noted that a dump truck accident had resulted in a
hydraulic oil release of approximately 15 gallons. The majority of the oil had spilled
onto a concrete drive, while approximately one-third of the oil had impacted the soil and
gravel beside the drive.
Harrisburg Fire Department was the first responder and used absorbent material to wick
the oil off of the concrete drive. DEE then excavated 6.9 tons of petroleum impacted soil
and stockpiled according to NCDENR guidelines. A soil sample was collected from the
stockpile by DEE and delivered to Prism Laboratories for analysis. In accordance with
NCDENR Permit guidelines for the remediation of petroleum impacted soil, Prism was
instructed to analyze the impacted soil using EPA methods 9071 and TCLP metals to
verify that the contaminated soil was non -hazardous. The results of this analysis are
enclosed as Attachment I.
After receiving the analytical data from Prism Laboratories and verifying that these soils
could be treated as non -hazardous, the impacted soil was then weighed on certified scales
and taken to Soil Solutions, Inc. on August 15, 2008, for disposal according to NCDENR
guidelines. The soil profile, weight ticket and non -hazardous waste manifest are enclosed
as Attachment II.

In accordance with your application for a discharge permit received on January 3, 2005,
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state —NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
The NCG140000 general permit covers discharge of stormwater and process wastewater.
During the application process, you demonstrated that the recycle system at this plant will
recycle all process wastewater associated with activities at the facility, even in the event of a 25-
year, 24-hr storm, and that the facility does not intend to discharge any process wastewater. In
the event that process wastewater discharge does occur, the discharge must meet all applicable
effluent limitations in the permit.
We understand that the system has already been built; therefore, an authorization to
construct was not issued concurrently with this COC. Please ensure the attached Engineer's
Certification is completed and returned to verify that facilities have been constructed in
accordance with the design criteria noted above.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, Coastal Area Management Act or any other
federal or local governmental permit that may be required.

In response to the Division of Water Quality (DWQ) letter dated April 19, 2005 requesting
additional information for the above referenced facility, as well as phone conversations between
DWQ and Macleod Construction, Inc. (Macleod), the attached information has been prepared as
relates to pending stormwater permit for the MacLeod Harrisburg plant.
The following information is included in the attached documentation:
a) Drainage area and associated 10-year 24-hour rainfall event stormwater runoff volume from
the MacLeod facility as calculated and sealed by Mansour Edlin, PE with Mansour Edlin
Consulting.
b) Calculation spreadsheet including:
i. Total throughput of water at the facility, including water used in concrete mixing and
the above referenced 10-year 24-hour rainfall event. All infonnation used in these calculations
was based on real operating numbers and information included in "i" above.
ii. A comparison of the total potential water usage at the facility and the capacity of the
recycle system at the facility. The calculations illustrate the ability of the facility's water recycle
system to handle the potential water throughput.
c) Calculation spreadsheet identical to "b" above, however, runoff volume was calculated using a
25-year, 24-hour rainfall event (all facility -specific information for the 25-year 24-hour
calculation is the same as included on the 10-year 24-hour runoff document referenced in "a"
above. The inches of rainfall from a 25-year 24-hour event was determined using the North
Carolina Erosion and Sediment Control Planning and Design Manual, September 1988).
d) In the extreme case of an overflow of water from the recycle system into the stormwater
detention pond, MacLeod has a contingency plan in place to monitor and adjust the pH of the
stormwater detention pond. The plan is based on current protocol at another MacLeod facility.
MacLeod construction wishes to do everything possible to reach a resolution regarding
stormwater permitting for their new Harrisburg facility. The facility wishes to operate later this
month, so anything that can be'done to expedite the permitting process would be greatly

Dear Mr. Houser:
The Division of Water Quality (DWQ) Stormwater Permitting Unit has reviewed your NPDES
Permit Application for General Permit NCG140000, received January 3, 2005, and additional
information submitted through Mr. Mansour Edlin, received March 24, 2005 and April 7, 2005.
We feel more detail about the recycle system design and proposed method of pH control is
necessary before a permit can be issued. This request is not meant to unduly delay your permit;
however, the permit applicant must provide sufficient evidence to reasonably assure DWQ that
the proposed system will comply with applicable water quality standards and requirements (per
15A NCAC 0.2H .0112). Unlike most other stormwater general permits, this NPDES permit is a
combined wastewater and stormwater permit, and therefore our review must also consider
process wastewater discharge and treatment —not just stormwater controls.
Our previous requests for design basis information have yielded some details about the recycle
system but have not demonstrated the design storm capacity, or whether pH will be controlled
sufficiently in the event of overflow. Please provide more comprehensive design details and
calculations as outlined below.
Recycle System Design
Please explain assumptions regarding:
• The drainage area to the recycle system. Earlier responses noted that the drainage area is
"limited to a small area on the north side of the recycling system." Please quantify the
area incorporated into the design, and describe the drainage divides that define the
contributing area.
Assumed daily throughput flow and basis (e.g., assumed number of mix drum washouts
and amounts, estimated vehicle splatter wash down flows, etc.). Please quantify the
design basis for all types of process wastewater and stormwater flows that the recycle
system will handle.

Settling and residence time assumptions. What settling volume is provided in the settling
tank cells, and what settling velocities were used for the design? Please provide
calculations demonstrating that the system will remove total suspended solids (TSS)
down to the permit limit of 30 mg/1 in the event of an overflow. If meeting permit limits
relies on additional treatment in the stormwater detention pond, please demonstrate how
the detention pond design incorporates recycle system overflows (flow and any additional
solids loading) and will ensure discharge meets the 30 mg/l TSS limit and 5 ml/l
settleable solids limits.
• The amount of freeboard that will be maintained in the clean water tank under normal
operating conditions.
pH Control
• How will the pH be monitored?
• How will operators ensure sufficient dosage and mixing time prior to discharge? Please
explain the protocol that will be used to measure and adjust the pH. Will chemical
adjustment occur in the clean water tank or in the detention pond? If the recycle system
is designed to contain the 10-year storm —the same as the pond —process wastewater and
stormwater will commingle in rainfall events of that magnitude (and discharge from the
outfall will be considered wastewater). How will pH be adjusted and controlled prior to
discharge?
• How was the amount of muriatic acid to be stored on site estimated? Please provide
calculations used to estimate the dosage necessary to reduce the pH from 12 to 8 under
design conditions loading.
