1. Reference is made to your NPDES permit application received on October 10, 1992. The
Division of Environmental Management (DEM) has previously requested additional information
by letter dated January 4, 1993 (copy attached). This additional information was needed in
order for the Water Quality Section to complete its permit review.
Because a response to our request has not been received, the Division of Environmental
Management is returning your application. A copy of your application has been submitted to our
Central Files for future reference.
Should you desire to reactivate your permit request, please .advise the Division of
Environmental Management in writing and resubmit a new complete application with the
appropriate application fees. Construction of wastewater discharge facilities without a permit
may be considered a violation of DEM Regulation 15 NCAC 2H .0101 and the North Carolina
General Statutes (GS 143-215.1).

Dear Mr. Billings:
On October 15, 1992, the Division of Environmental Management(DEM) received an
application from S2 Concepts requesting a NPDES permit numbered NC0082899. Due to concerns
with the impact of the discharge to Clarke Creek which is a wetlands area, DEM requests that S2
Concepts submit a more detailed analysis of the spray irrigation option for the groundwater for
our review. This analysis should include the amount of land needed for treatment, application
rates onto the required amount of land and a cost comparison with the discharge alternative. DEM
feels there are several possibilities for spray irrigation. They would be construction of spray
facilities of property that will not be used in the next 5 to 10 years. There is a possibility 2
municipal sewer collection system will be, available in 5 to 10 years and a connoctfon could be
made then. Second , additional property could be purchased for the spray irrigation system and in.
the 5 to 10 years when the sewer connection can be made the additional land could be sold or used
for expansion. Also consideration should be given to using the effluent for irrigation of the soccer
fields. For discussion of this possibility Kim Colson of the Mooresville Regional Office should be
contacted.

A similar form for this project was given to the City of
Concord Manager on November 25, 1992, the same date the
enclosed 'form was given to the Cabarrus County Manager. The
City of Concord is the closest municipality to this property,
but this site is not within the planning jurisdiction of.the
City of Concord, and they have no control over the use of
this land. We have not yet received a completed form from
the City of.Concord Manager, and it does not appear at this
time, as if they will be sending the completed form to me.

Review for this project be added to the remaining'item.s of
the application package for this project, and that the
Division of Environmental Management continue with the review
and approval process for this application.

Nonmunicipal Domestic Wastewater DiscO11 ,°l,rmits
General Statute Overview YA
On October 1, 1989, an amendment to North Carolina General Statute 143-215.1, denoted as 143-215.1
(c)16), became effective. The amendment allows input from local governments in the issuance of NPDES
Permits for nonmunicipal domestic wastewater treatment facilities. The new language requires that the
Commission (Environmental Management Commission) shall not act on an application for a new
nonmunicipal domestic wastewater discharge facility until it has received a written statement from each
city and county government having jurisdiction over any part of the lands on which the proposed facility
and its appurtenances are to be located. The written statement shall state whether the city or county has
In effect a zoning or subdivision ordinance and, if such an ordinance is in effect. whether the proposed
facility is consistent with the ordinance. The Commision shall not approve a permit application for any
facility which a city or county has determined to be inconsistent with its zoning or subdivision ordinance
unless it determines that the approval of such application has statewide significance and is in the best
interest of the State.
Instructions to the Anolican
Prior to submitting an application for a NPDES Permit fors proposed project, the applicant shall request
that both the nearby city and county government complete this form. The applicant must submit a copy
of the draft permit application and shall make a written request for this form to be completed to the clerk
of the city and county by certified mail, return receipt requested. If a (or both) local government(s) fail(s)
to mail the completed form, as evidenced by the postmark on the certified mail card(s), within 115 days
after receiving and signing for the certified mail, the applicant may submit the application for a discharge
permit. As evidence to the Commission that the local government(s) failed to respond within 15 days, the
pplicant shall submit a copy of the certified mail card along with a notarized letter stating that the local
oovernment(s) failed to respond within the 15 day period.
Instructions to the Local Governmen
The nearby city or county government which may have or has jurisdiction over any part of the lands on
which the proposed facility or its appurtenances are to be located is required to complete and return this
form to the applicant within 15 days of receipt. The form must be signed and notarized.

Spray Irrigation:
Spray irrigation may be an alternative to discharging.
Several possibilities exists for spray irrigation.
The first is to construct spray facilities on property
that will not be used in the near future. There is a
possibility that within 5 - 10 years that municipal sewer
service will be available.
Additional property could also be purchased for spray
irrigation. Once municipal sewer service is available, the
property could be sold or used for expansion.
Consideration should also be given -to the possibility -of
using the soccer fields for spray irrigation. This option
would increase operational expenses since a higher level of
treatment would be required, however, the facility would
benefit since a separate irrigation system would not be
needed. The use of cut and fill areas for spray irrigation
would need to be addressed before this option is selected.
The native soil is mapped as Coronaca, which has a subsoil
that typically extends to a depth of 96 inches.
Connection to Regional Sewer System: Connection to a regional
sewer system does appear to be reasonable within the next 5 -
10 years.
Subsurface: Subsurface disposal.is not a'viable alternative.
Other disposal options: N/A

5. Air Quality and/or Groundwater concerns or hazardous materials
utilized at this facility that may impact water quality, air
quality, or groundwater: Groundwater comments should be
obtained if the spray irrigation option is utilized. There
are no known Air Quality or.hazardous materials concerns.

_PART IV EVALUATION AND RECOMMENDATIONS
The applicant, S2 Concepts, has applied for an NPDES permit -to
serve a proposed sports complex facility. The wastewater will
include both domestic and restaurant.
The applicant may have an economical alternative to
discharging by utilizing spray irrigation. This alternative was
not completely addressed in the application.
It is recommended that the applicant be required to further_
investigate spray irrigation as an alternative. An NPDES permit
should only be issued provided the spray irrigation option is not
feasible.

OPTIONS FOR WASTEWATER TREATMENT AND DISPOSAL
S CONCEPTS, LTD.

EXISTING CONDITIONS:
-------------------
S2 Concepts, Ltd. has access to a 75 acre tract located
along the southwestern margin of Poplar Tent Road (S.R.
#1394) situated approximately 450 feet southeast of its
intersection with Harris Road (S.R. #1449). This tract
consists of approximately 1,040 feet of road frontage along
Poplar Tent Road and extends in a southwesterly direction,
crossing Clarke Creek, and includes approximately 2/3 of the
tract or approximately 50 acres located in open fields
between Poplar Tent Road and Clarke Creek, while
approximately 25 acres in established woodland are located on
the southwestern margin of Clarke Creek.
PROPOSED FACILITIES:

The proposed indoor and outdoor sports facility proposed
for this site include 5 outdoor soccer fields, an outdoor
baseball/softball field, 4 outdoor tennis courts, outdoor.
pool, and a 77,640 square feet building which will include an
indoor soccer field, an indoor pool, 5 indoor raquetball
courts, pro shop, classrooms, restaurant, fitness center,
gymnasium, locker rooms with showers, office space, and
related facilities. Projected wasteflows from this building
are estimated to be 30,000 gallons per day, when fully
developed. Except for potentially grease -bearing flows from
the restaurant portion of the building, all other wasteflows
should be consistent with domestic sewage characteristics.
This facility will be supplied water from an on -site
well to be drilled on this site as needed to meet water
demands at this complex.
LISTING OF OPTIONS FOR WASTEWATER DISPOSAL_

The following options are identified:
OPTION #1: Extension of gravity sewer line from this property
downslope to the nearest available community sewerage system,
requiring the willingness of the system owner to accept the
proposed wasteflow, the acquiring of right -of way easements
across all intermediate properties between this tract and the
location of the community sewerage system, and the issuance
of a permit and authorization to construct from the Division
of Environmental Management after review of detailed
engineering plans and specifications of the proposed gravity
sewer extension. Ongoing costs will include the system
owner's regular monthly charges for accepting and treating

the wasteflows generated at this site, along with any costs
associated with the pretreatment of the wasteflows when
required by the system owner.
OP_T_ION #2: Construction of a pumping station and extension of
force main piping system across varying terrain to the
location of an existing community sewerage system, requiring
the willingness of the system owner to accept the proposed
wasteflow, the acquiring of right -of way easements across all
intermediate properties between this tract and the location
of the community sewerage system, and the issuance of a
permit and authorization to construct from the Division of
Environmental Management after review of detailed engineering
plans and specifications of the proposed pump station and
force main sewer extension. Ongoing costs will include the
power costs for running the pump station, chemical costs
associated with the pumping process when required by the
system owner, maintenance costs as may be associated with the
long-term operation of the pump station and force main piping
system, costs associated with the employment of a certified
operator when required by the conditions of the permit, the
system owner's regular monthly charges for accepting and
treating the wasteflows generated at this site, and costs
associated with the renewal of the permit when required by
the Division of Environmental Management.
OPTION #3: Construction of a ground absorption wastewater
disposal system, disposing of wasteflows by injection it into
the ground after adequate treatment, requiring suitably
permeable soil on the site as described by a detailed soil
evaluation, and requiring a permit from the local health
department after review of detailed engineering plans and
specifications by the Raleigh Office of the Division of
Health Services, and requiring the employment of an approved
management entity to visit the plant and perform system
monitoring and maintenance as required by the permit. Ongoing
costs will include the power costs for running the plant,
chemical costs associated with the treatment process, costs
for laboratory analysis of effluent when required by the
permit, maintenance costs as may be associated with the long-
term operation of the wastewater treatment plant, costs
associated with the employment of an approved management
entity for plant operation and maintenance as required by the
permit, and costs associated with the renewal of the permit
every five years and the costs associated with making
improvements to the plant as may be required from time to
time in order to comply with changing permit requirements
when the permit is renewed.
OPTION #4: Construction of a spray irrigation, land
application wastewater disposal system, disposing of the
wasteflows by applying it onto the surface of the ground

after adequate treatment, requiring suitably permeable soil
surface and subsurface on the site as described by a detailed
soil evaluation, while meeting all buffer requirements, and
requiring a permit and authorization to construct from the
Division of Environmental Management. Ongoing costs will
include the power costs for running the plant, chemical costs
associated with the treatment process, costs for laboratory
analysis of effluent when required by the permit, maintenance
costs as may be associated with the long—term operation of
the wastewater treatment plant, costs associated with the
employment of a certified wastewater treatment plant
operator, and costs associated with the renewal of the permit
every five years and the costs associated with making
improvements to the plant as may be required from time to
time in order to comply with changing permit requirements
when the permit is renewed.
OPTION #5: Construction of a wastewater disposal system with
discharge to an adequately sized flowing stream, requiring a
permit to discharge and an authorization to construct from
the Division of Environmental Management, and requiring a
certified wastewater treatment plant operator to visit the
plant on a timetable defined by the permit, as well as the
performance of laboratory analysis of the effluent on a
timetable defined by the permit. Ongoing costs will include
the power costs for running the plant, chemical costs
associated with the treatment process, costs for laboratory
analysis of effluent, maintenance costs as may be associated
with the long—term operation of the wastewater treatment
plant, costs associated with the employment of a certified
wastewater treatment plant operator, and costs associated
with the renewal of the permit every five years and the costs
associated with making improvements to the plant as may be
required from time to time in order to comply with changing
permit requirements when the permit is renewed.
ENGINEERING EVALUATION OF EACH OPTION
FOR
WASTEWATER TREATMENT AND DISPOSAL:
O_P_T_ION #1: The nearest available community sewerage system,
located downstream from this property, is currently under
construction and should be completed, ready to accept
wasteflows, about July 1, 1993. This is a gravity sewer
extension, belonging to the Cabarrus County Utility
Authority, and will be located along Rocky River at an
unnamed tributary located west of Interstate 85 an east of
Derita Road (S.R. #1445). The distance from the S Concepts,
Ltd. property at Poplar Tent Road, following Clarke Creek and
Rocky River to the location of the nearest available gravity
sewerage system, is approximately 3.5 miles. The following
cost estimates project likely expenses associated with Option
#1:

Costs for Acquiring Easements $40,000 min. to $185,000+
Costs for Engineering Services $40,000 min. to $ 60,000
Costs for Construction $700,000 min. to $800,000
Total Costs for Option #1 $780,000 min. to $1,045,000+
OPTION #2: The nearest community sewerage system available
by means of pump station and force main piping system from
the property of "First Division Sports Club" is the same
community sewerage system described in Option #1-, but would
include a gravity sewer outfall extending up the unnamed
tributary at Rocky River in the direction of Poplar Tent
Road. Required for this option is a pump station,
approximately 2 miles of force main along Poplar Tent Road to
the intersection with Harris Road, and approximately 1 mile
of gravity sewer from the intersection to the point of
nearest available sewerage system. The following cost
estimates project likely expenses associated with Option #2:
Costs for Acquiring Easements $40,000 min. to $160,000+
Costs for Engineering Services $60,000 min. to $100,000
Costs for Construction $450,000 min. to $600,000
Total Costs for Option #2 $550,000 min. to $860,000+
OPTION #3: Installation of a ground absorption wastewater
disposal system, at the site of the "First Division Sports
Club" property, will require the availability of suitable or
provisionally suitable soil in an area large enough to
accommodate the initial ground absorption wastewater disposal
system, as well as sufficient area to accommodate a 100%
future repair area. The soil surfaces at the location of the
proposed ground absorption wastewater disposal system, should
not be graded or otherwise disturbed prior to placement of
the disposal system.
"Soil Survey of Cabarrus County" reveals soils mapped as
"Coronaca" soils located in the area between Clarke Creek and
Poplar Tent Road. This soil series is identified as being
"moderate" for use with septic tank absorption fields, and
appears useable for ground absorption wastewater disposal
trenches. However, the Owner's site development plans show
construction of 5 soccer fields in this area, and the
required grading for these soccer fields will destroy the
useable character of the soil in this area, thereby making it
not suitable for use with ground absorption wastewater
disposal systems.
"Soil Survey of Cabarrus County" reveals soils mapped as
"Enon" and "Poindexter" series, located southwest of Clarke
Creek at this property, both of which are rated as having
"severe" limitations for use with septic tank absorption
fields.
Based upon these soil mapping evaluations and based upon

the need for grading the area between Clarke Creek and Poplar
Tent Road to accommodate the soccer fields and building
complex, it appears that the disposal of wastewater by means
of an on site, ground absorption wastewater disposal system
on this property is not an option available to the Owner.
Adjoining property along Poplar Tent Road, as well as
property across the road from this location are shown to be
"Coronaca" series and "Cecil" series soils by the "Soils
Survey of Cabarrus County", both of which are identified as
being "moderate" for use with septic tank absorption fields.
The Owner may acquire additional property at these locations
for the purpose of accommodating the "initial" and "future
repair wastewater disposal system at this location. It
appears that approximately 22 acres are needed to accommodate
the "initial" disposal system, and that another 22 acres
would be required for the "future repair" wastewater system.
Should adjoining property be available for use by "First
Division Sports Club" for ground absorption wastewater
disposal systems, the following cost estimates are projected
for Option #3:
Costs for Purchasing Land $ 50,000 to $180,000
Costs for Engineering Services 35,000 to 55,000
Costs for Construction 325,000 to 450,000
Total Costs for Option #3 $410,000 to $685,000
OP_T_ION #4: The property located to the southwestern margin
of Clarke Creek could be utilized for spray irrigation - land
application of wastewater generated from the "First Division
Sports Club". Soils at this location are shown to be of the
Enon and Mecklenberg series by "Soil Survey of Cabarrus
County". All required buffer zones must be met, such as
distances from property lines, existing streams, and existing
structures used as residences or for public assembly. A
pretreatment system must be utilized, followed by a treatment
lagoon and holding pond, with effluent spray irrigated onto
the surface of the ground currently containing a healthy crop
of mixed hardwoods. The lagoon should provide a minimum of
7-days storage and would require a suitable liner. The
holding pond should provide up to 30-days storage for
enduring periods of inclement weather, and would require a
suitable liner. Effluent should be disinfected prior to its
spray irrigation onto the surface of the ground in the
designated area.
Preliminary computations show the need for a 210,000
gallon capacity lagoon, approximately 81' x 81' at its base,
96' x 96' at its top, designed for approximately 3.75' liquid
depth. The holding pond needed should have capacity for
900,000 gallons, approximately 140' x 140' at its base, 160'
x 160' at its top, designed for approximately 5.50' maximum
liquid depth.

If effluent is spray irrigated upon the surface of the
ground at the rate of 1/2" depth per week, the wetted area
required for spray irrigation is approximately 18 acres. It
appears that the rear portion of this tract may provide 18
useable acres after meeting all required buffers. This does
not allow room for expansion unless adjoining land owners are
willing to offer the use of their land for spray irrigation
purposes. Also, the Owner intends to use this area for
additional sports facilities as this site develops, and there
may not therefore be available property on this site for
spray irrigation system of wastewater disposal. The Owner
would therefore need to acquire additional land for the spray
irrigation system.

OPTION #5: The extent of wastewater treatment that will be
required, in order to discharge effluent from the "First
Division Sports Club" into Clarke Creek at a location
approximately 1/2 mile south of the intersection of Poplar
Tent Road and Harris Road, is not known at this time and will
not be known until after an application for a permit to
discharge has been filed with the Division of Environmental
Management and they have performed a stream analysis relative
to the proposed discharge location. Therefore, it is
extremely difficult to fully evaluate the costs associated
with this treatment and disposal option. However, the
following "ball park" estimates are provided in an attempt to
provide the Owner with some awareness of costs likely to be
associated with this option:
