The stream originates at the existing storm drainage pipe proposed to be replaced, and all upstream drainage is captured in the storm drainage collection system. The overall project consists of replacement of the storm drainage pipe system within S. Walker Street by removing the existing 24” RCP pipes and installing a 36” RCP pipes, including the existing outfall pipe within the project area specified in this application. The removal of the existing 24” RCP outfall and replacement of the existing 36” RCP will occur within the existing footprint. Currently, there is no riprap within the intermittent stream (Stream 1) below the existing outfall, and erosion and sedimentation of the stream channel has taken occurred. The proposed design would line 22 lf of stream channel with riprap to stabilize the stream bed and banks to prevent erosion. It should be noted that Stream 1 originates at the existing storm drain outfall. All upstream areas are developed, and flow is captured in the stormwater drainage system. The replacement of the storm drainage system will occur in phases, with the replacement of the existing outfall pipe being the final phase. This will allow replacement of the outfall and installation of the riprap bank stabilization to be conducted “in the dry”. The replacement of the outfall pipe and installation of bank stabilization will be scheduled during a period of no forecasted rainfall for three days. In the event it does rain during construction, or there continues to be flow within the storm drainage system, the storm drainage system will be blocked immediately upstream of the outfall, and flow will be pumped around and back into the stream downstream of the construction area. Additionally, a temporary check dam will be constructed below the construction area to prevent sediment from escaping into downstream waters and causing turbidity issues within Walnut Creek. Impact Justification and Mitigation Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and “waters” could be minimized. Due to the nature of the project, impacts could not be avoided. Permanent impacts have been minimized to only those necessary for the installation of the riprap bank stabilization along 22 lf of Stream 1 to prevent erosion and sedimentation of downstream waters. Upon completion of construction, the 22 lf of temporarily impacted stream channel will be restored to pre-construction contours and elevations. The proposed temporary riparian buffer impact areas resulting from construction access will be restored to pre-construction contours and seeded with a grass seed mix, which will restore the same vegetation within the buffers as is the existing condition. Access during construction will occur from uplands. Silt fencing will be installed around all disturbed areas to prevent loss of sediment into adjacent waters. 34‐(1).  The cataloging unit for the site is 03020201.  Proposed Project  The purpose of the proposed project is to replace the existing undersized storm drainage pipes to  alleviate flooding within the nearby roads during heavy rainfall.  The overall project consists of replacement of the storm drainage pipe system within S. Walker  Street by removing the existing 24” RCP pipes and installing a 36” RCP pipes, including the existing  outfall pipe within the project area specified in this application.    S. Walker Street Storm Drainage Replacement – Cary, Wake Co.  Page 2 of 3    The removal of the existing 24” RCP outfall and replacement of the existing 36” RCP will occur  within the existing footprint.  Currently, there is no riprap within the intermittent stream (Stream  1) below the existing outfall, and erosion and sedimentation of the stream channel has taken  occurred.  The proposed design would line 22 lf of stream channel with riprap to stabilize the  stream bed and banks to prevent erosion.  It should be noted that Stream 1 originates at the  existing storm drain outfall.  All upstream areas are developed, and flow is captured in the  stormwater drainage system.    The replacement of the storm drainage system will occur in phases, with the replacement of the  existing outfall pipe being the final phase.  This will allow replacement of the outfall and installation  of the riprap bank stabilization to be conducted “in the dry”.  The replacement of the outfall pipe  and installation of bank stabilization will be scheduled during a period of no forecasted rainfall for  three days.  In the event it does rain during construction, or there continues to be flow within the  storm drainage system, the storm drainage system will be blocked immediately upstream of the  outfall, and flow will be pumped around and back into the stream downstream of the construction  area.  Additionally, a temporary check dam will be constructed below the construction area to  prevent sediment from escaping into downstream waters and causing turbidity issues within  Walnut Creek.  The project will be constructed using traditional commercial construction equipment and  techniques.   Project History  WithersRavenel completed a delineation of the project area in September 2019.  There are no  wetlands within the project area.  The only jurisdictional feature within the project area is an  intermittent stream (Stream 1) as depicted in the attached Preliminary JD Exhibit.  Please note that  we are not requesting issuance of a JD as part of this application.  Stream 1 is depicted on the Wake Co. Soil Survey and therefore subjectivity to Neuse River Basin  Riparian Buffers was conceded, and a formal NCDWR Buffer Determination was not requested.  Proposed Impacts  NWP 3 Impacts:   22 lf of temporary stream impacts (Impact 1B) for construction of temporary coffer dam  and flow pump around during replacement of existing storm drainage pipe outfall.  NWP 13 Impacts:   22 lf of permanent stream impacts (Impact 1A) for stabilization of the bed and banks of  Stream 1 with riprap.  Riparian Buffer Impacts:    31 sf of permanent Zone 1 impacts for bank stabilization (Impact 1C) – Allowable with  Authorization   567 sf of temporary zone 2 impacts for access during construction – Deemed Allowable Please note that the project area is located along the rear property lines of four residential lots.   The riparian buffers were historically cleared of understory vegetation and maintained as mowed  lawns.  Avoidance and Minimization  Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted  so that impacts to wetlands and “waters” could be minimized.    Due to the nature of the project, impacts could not be avoided.  Permanent impacts have been  minimized to only those necessary for the installation of the riprap bank stabilization along 22 lf  of Stream 1 to prevent erosion and sedimentation of downstream waters.  Upon completion of construction, the 22 lf of temporarily impacted stream channel will be  restored to pre‐construction contours and elevations.   The proposed temporary riparian buffer impact areas resulting from construction access will be  restored to pre‐construction contours and seeded with a grass seed mix, which will restore the  same vegetation within the buffers as is the existing condition.   Access during construction will occur from uplands. Silt fencing will be installed around all  disturbed areas to prevent loss of sediment into adjacent waters.  Mitigation  The proposed permanent stream impacts are less than 150 lf and proposed buffer impacts are  classified as “Allowable”.  Therefore, mitigation is not proposed.  The current request is for 22 lf of permanent stream impacts, 22 lf of temporary stream impacts,  31 sf of permanent riparian buffer impacts and 867 sf of temporary riparian buffer impacts (see Consultation under Section 7(a)(2) of the ESA is not required for Candidate or Proposed species; although a Conference, as described under Section 7(a)(4) of the ESA is recommended for actions affecting species proposed for listing. T(S/A) = threatened due to similarity of appearance. A taxon that is threatened due to similarity of appearance with another listed species and is listed for its protection. Taxa listed as T(S/A) are not biologically endangered or threatened and are not subject to Section 7 consultation. See below. EXP = experimental population. A taxon listed as experimental (either essential or nonessential). Experimental, nonessential populations of endangered species (e.g., red wolf) are treated as threatened species on public land, for consultation purposes, and as species proposed for listing on private land. P = proposed. Taxa proposed for official listing as endangered or threatened will be noted as "PE" or "PT", respectively. Bald and Golden Eagle Protection Act (BGPA)_ In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de- listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. For mor information, visit !Ltip://www.fws-gQy6nigratoryi2irds/baldeagle.htm Threatened due to similarity of appearance(T(S/A))_ In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss. Definitions of Record Status: Current - Based on NC Natural Heritage Program information, this taxon is considered to be extant in the county. Historical - Based on NC Natural Heritage Program information, this taxon is considered to be historical in the county, meaning that all recorded occurrences are either extirpated, have not been found in recent surveys, or have not been surveyed recently enough to be confident they are still present. Obscure - the date and/or location of observation is uncertain. Incidental/migrant - the species was observed outside of its normal range or habitat. Probable/potential - the species is considered likely to occur in this county based on the proximity of known records (in adjacent counties), the presence of potentially suitable habitat, or both.
