Aqua North Carolina, Inc. (Aqua) offers the following response to the above -
referenced Notice of Violation and Intent to Assess Civil Penalty which was issued
for flow monthly average exceedance in August 2020.
Aqua's Response:
In August 2020, rainfall from three named storms (Hurricane Isaias, Tropical Storm
Kyle, & Hurricane Marco) contributed to the additional flow at the Cape WWTF. The
chart below compares rainfall data from the NOAA rain gauge at Carolina Beach, NC
against daily flows at the Cape WWTF in August. There is a direct correlation
between extreme rainfall from the three named storms and the increased flows
experienced 24-48 hours after the rainfall event.

In addition, AQUA has submitted application and received Authorization to
Construct (ATC) to expand the Cape WWTF from 260,000 gpd to 400,000 gpd. The
expansion project is scheduled to be complete by third quarter 2021. The 2020
average annual flow is approximately 0.232 MGD which is less than 90% of the
permitted capacity. Aqua has satisfied 15A NCAC 02T.0118.
Additional actions taken by Aqua:
AQUA has been in communication with the Cape Homeowners Association regarding
the lack of maintenance at the Cape Golf course facility (closed since 09/2018) that is
impacting groundwater levels around the Cape WWTF. Maintenance was performed in
early September and as of today's date it has improved drainage around the facility.
- AQUA verified the flow meter calibration on October 161, and it was within tolerance
(see attached).
The Cape WWTF was compliant for all other plant sample parameters during these
higher flow events and any impact from the increased flow from the Cape WWTF
would be de minimus in scale as compared to the concurrent increases in Cape Fear
River flow from the storm events.
