Narrative Description: The property is located at 3018 Sloop Drive (NCSR 1308) in the Sail Loft subdivision, off of NC Hwy 55 near Oriental, Pamlico County. The lot is a 20,445 square-foot tract adjacent to Hog Pen Creek, a tributary of Greens Creek. This site is developed with a private single family dwelling, a dock, and a driveway. Both of the adjacent waterfront lots are developed with similar private residences. The elevation of the high ground of the parcel is about +4.5' above the normal water level. Vegetation on this lot consists of lawn grasses, trees, and Coastal Wetlands. The Coastal Wetlands vegetation mainly consists of Salt reed (Spartina cynosuroides). There are no known historically significant archaeological sites in the project area. The residential structure impacts Zone 1 and Zone 2 of the Neuse River Riparian Buffer. This tract has approximately 123' of continuous shoreline along Hog Pen Creek. This waterbody i< about 300 feet across at this location. These waters are classified as a Primary Nursery Area. This area is closed to shellfish harvest and is classified as SC; High Quality, Nutrient Sensitive Waters. There is not a defined Federal Channel in the nearby vicinity. 10. Proposed Development: The applicant wishes to construct an addition onto an existing single-family residence adjacent to Hog Pen Creek, near Oriental. The proposed development will take place at 3018 Sloop Drive in the Sail Loft subdivision. The proposed development is entirely on high ground, but the majority of the project will impact Zone 2 of the Neuse River Riparian Buffer. This project consists of the construction of an attached garage with an upstairs master bed & bath. Traditional home construction methods will be utilized in this endeavor. This new addition will connect to the southwest corner of the home. This new habitable floor space will incorporate 750 additional square feet. This addition will be constructed 36' landward of the NWL, and 31' from the landward edge of the Coastal Wetlands AEC. This new built-upon area will impact another 435 square feet within Zone 2 of the Neuse River Riparian Buffer. 11. Anticipated Impacts: The new addition will fill approximately 750 square feet of high ground. This will result in a total of 15 % impervious coverage within the Estuarine Shoreline AEC. I am Richard Brashear, the designer of the proposed addition to be considered in this variance application The owners of this property, Raymond and Kathryn Ruppert, purchased this property a number of years ago with the intent to improve the design of the house to make it compatible with their retirement future as a primary residence. The contemplated changes included adding a master bedroom/bathroom onto the first floor along with a garage area underneath (elevating the existing structure in the process). Three designs were created; the one submitted is the third. The other two designs were not used because they occupied more of the NCDWQ restricted areas than the submitted design. This third design moves the addition away from the zone 1 and used less of the zone 2 while providing a water view and a floor plan that works well and is in harmony with the existing structure. At the beginning of this design effort (June 2009) regulations then in force mandated that an encroachment into any of the buffer zones was to be avoided but when sensible purpose dictated an encroachment, variances were granted as a minor variance if the encroachment was only into zone 2 and in as minimal an area as possible, relative to the design. I ask that favorable consideration be given to granting this variance. The design work was based on accepted variance application practice and allowances in effect at the time the work began. A considerable amount of time, emotion and money was spent in a good faith effort to comply with those regulations. I also ask that in reviewing my request for granting this variance some appreciation be given to the fact the owners anticipated retiring to this property based on the expectation they could do so with reasonable modifications to the existing structure under guidelines in effect at the time of purchase.
