Dear Sir: Reference: Application for Section 404 Nationwide Permit 23, Section 401 Water Quality Certification, Buffer Authorization, and CAMA Major Development Permit dated December 11, 2009. NCDWQ Hold Letter, dated February 25, 2010, received March 1, 2010 (attached). Please see the enclosed revised buffer drawings (four copies) for the above referenced project. These revisions were coordinated with Garcy Ward, NCDWQ, prior to March 22, 2010. • Buffer zones determined incorrectly. It was noted buffer zones were improperly placed due to the presence of CAMA jurisdictional wetlands. As a result, allowable buff; icr;::cls increased from 2,464 ft' to 2,472 fie. • Buffer mitigation. The revised EEP acceptance letter, dated February 23, 2010, is attached. • Bridge Stormwater. A riprap pad for the drainage system outlet on the northwest side of the project was extended north to avoid the buffer zone. Thank You for your assistance with INS project. Dear Dr. Thorpe: The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification and Tar-Pamlico Buffer Authorization for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: Buffer zones determined incorrectly. Jack Creek is bordered by coastal marsh on the northwest, northeast and southwest areas of the bridge crossing. According to the Tar- Pamlico Buffer Rules (I SA NCAC 2B .0259(4)(a)(iii)), Zone I shall begin at the most landward limit of coastal wetlands as defined by the Division of Coastal Management. Please redefine the buffer lines in accordance with this rule and recalculate the buffer impacts appropriately. Buffer mitigation. Buffer mitigation acceptance letters from EEP were included in the application. Buffer mitigation is not required for this project. Please clarify. Bridge Stormwater. When the correct buffer lines are determined, it is possible that the bridge stormwater discharge point on the north side will be in Zone I of the buffer. This is not an activity that is allowed under the buffer rules. "rhe discharge point can, however, be permitted in Zone 2 under a minor variance. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your,application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold. Based on the information supplied by the NCDOT on February 23, 2010, the impacts are located in CU 03020104 of the Tar- Pamlico River Basin in the Northern Outer Coastal Plain (NOCP) Eco-Region, and the anticipated mitigation credits needed to offset the impacts are as follows: Tar-Pamlico Stream Wetlands Buffer(Sq. Ft.) 03020104 Non- - Coastal zone NOCP Cold Cool Warm Riparian Zone 1 Riparian Marsh 2 Impacts (feet/acres) 0 0 0 0 0 0.02 0 0 Mitigation Units 0 0 0 0 0 0 04 0 0 (Credits-up to 2:1) . J This mitigation acceptance letter replaces the mitigation acceptance letter issued on August 7, 2009. Buffer mitigation is no longer required. Mitigation associated with this project will be provided in accordance with Section X of Amendment No. 2 to the Memorandum of Agreement between the N. C. Department of Environment and Natural Resources, the N. C. Department of Transportation, and the U. S. Army Corps of Engineers fully executed on March 8, 2007 (Tri-Party MCA). EEP commits to implement sufficient coastal marsh mitigation in the appropriate cataloging unit in the amount listed in the above table to offset the impacts associated with this project by the end of the MOA year in which this project is permitted. If the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from EEP. 1929.
