Hi Will, and thanks for forwarding the as -built survey. Although the limits of the fill material placed in wetlands differ
slightly from the permitted plans, they are within a reasonable margin of error and within the allowable fill amount
authorized by our NWP 29 verification dated 11/19/2019.
Based on the above, as well as the removal of sediment from wetland areas as documented by our email dated
10/15/2020, the Corps will take no further action in this matter. Note that you must continue to comply with all terms
and conditions and special conditions of the NWP 29 verification for all phases of the Boone Meadows residential
development. As part of these responsibilities, please ensure that the rip rap "donut" currently installed in wetlands
above the inlet of the culvert is removed once the site is no longer under construction.
Please be cautioned that the Corps may consider any future unauthorized work of similar nature in waters of the U.S. a
willful and intentional violation of Federal law and may result in immediate referral of the matter to the U.S. Attorney or
the U.S. Environmental Protection Agency with recommendation for civil and/or criminal prosecution.
