PROJECT SUMMARY: The applicant is proposing to construct a 10-slip docking facility, access drive, parking lot, and sidewalk. Field Investigation Report: Burton Farm Development Company, LLC Page 2 of 3 --------------------------- 9. Narrative Description: This proposal is a modification to State Permit #28-08. It was issued on April 4, 2008 for the construction of 1, 825' of shoreline stabilization. State Permit #28-08 is set to expire on December 31, 2011. As a part of this proposal, the applicant will remove all plans to construct the "Sawgrass Court walkway and day dock" that were permitted by the Major Modification to State Permit #28-08 on August 31, 2009. The property is a 362-acre parcel located off of Burton Farm Road near Minnesott Beach, Pamlico County. Burton Farm Development Company, LLC, wishes to construct a 10-slip docking facility, a parking lot, and driveway on adjoining Lots 286 & 287, within the Mill Creek subdivision (Phase II). The two lots are off of Needle Rush Court and are adjacent to the Mill Creek tributary. Mill Creek is a part of the Neuse River Basin. These two lots are land-locked, with no shoreline frontage adjacent to Mill Creek. The entire shoreline along Mill Creek out to the mouth and on along the Neuse River is the subdivision's common area property. The waterfront shoreline will be common area for the subdivision, to be owned by the future home owners association. There is 4,625' of shoreline on this common area property. The Mill Creek waterbody is approximately 60' across at the most constrictive point that is adjacent to Lot 287. The current vegetation on the tract mainly consists of upland grasses, pine trees, and Coastal Wetlands. The Coastal Wetland vegetation is dominated by Saw Grass (Cladium jamaicense), with some fringe Black Needle Rush (Juncus roemerianus). These Coastal Wetlands adjacent to Lots 286-287 make up an area of approximately 15,000 square feet. The presence of submerged aquatic vegetation (SAV) has been observed just outside of the project area. The elevation of the tract is + 16' nwl. These two lots are currently undeveloped. The Pamlico County Land Use Plan classifies the project area as Rural with Services, with CAMA AEC's classified as Conservation. These waters Mill Creek are not designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SC; Sw, NSW. The bottom substrate is soft without shell. Water depths in this area go down to -5' nwl. 10. Proposed Development: The request is for the new construction of a 10-slip docking facility, a parking lot, and driveway on Lots 286 & 287 in the Mill Creek subdivision. The main gravel access driveway will connect to West Burton Farm Drive at Lot 287. This driveway will be 167' long and 23' wide. There will be a 10-space gravel parking lot connected to the driveway. This parking lot will be 90' long and 17' w'& e, At the Brad Connell March 31, 2010 Morehead City Field Investigation Report: Burton Farm Development Company, LLC Page 3 of 3 northwest end of the parking lot, there will be 6' by 45' gravel sidewalk that will connect to the 10-slip docking facility. This 10-slip docking facility will serve the residents of the Mill Creek subdivision. The fixed wooden pier access will be 6' wide and 132' long to connect the "L" platform on the Mill Creek tributary. The access pier will follow the lots' shared property line and traverse across the wetland common area. The access pier will be elevated at least 3' above the Coastal Wetland substrate. The connecting "L" platform will be 6' wide and 126' long. This platform will support five finger piers and six tie pilings. The finger piers will be 3' wide. Three of the finger piers will be 12' long and two finger piers will be 15' long. These boat slips will have the capability of supporting vessels of up to 24' in length. The water depth is -4.0' nwl at this location. 11. Anticipated Impacts: The pier will shade 468 ft' of Coastal Wetlands and 90 ft' of Section 404 Wetlands. It will result in the usurpation of 4,410 fe of Public Trust Waters. The gravel walkway, driveway and parking lot will fill 5,580 fe of high ground. There will be 954 fe of platform area along 4,625' of shoreline adjacent to Mill Creek. This docking facility will extend 23' waterward into the Mill Creek tributary, which averages 160' wide at this location. The most constrictive point is 60' across and the widest point is 325' across. This docking facility will be constructed landward of the navigable slough of the tributary and should not pose a hazard to navigation. These waters Mill Creek are not designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SC; Sw, NSW. The bottom substrate is soft without shell. Water depths in the slips are -4' nwl. The presence of SAV has been observed in a cove across from the project area. Brad Connell March 31, 2010 Morehead City rIg Burton Farm Development Company, LLC Mill Creek Phase I and Phase II CAMA Major Modification Permit Application February 12, 2010 Revisions March 3, 2010 per DCM review March 30, 2010 per DCM review PROJECT DESCRIPTION Site Location The site is an approximately 362.24 acre parcel located along the Neuse River accessed via Burton Farm Road (NCSR 1120) and roughly centered around latitude 34.9881863°N and longitude 76.8467657°W. The site is part of the larger Burton Farm Development, LLC (Burton Farm) property which has been subdivided into two separate projects; Mill Creek Phases I and II and Arlington Place. Existing Development Mill Creek Phases I and II are an existing 408 lot subdivision owned by Burton Farm. The development is a low density subdivision (issued low density stormwater permits #SW7070602 and SW70702 I OMOD-enclosed) with on site waste water serving each lot and potable water provided by Pamlico County. In addition to the existing lots and utilities, the subdivision has an Outfitters Center, Clubhouse and Guardhouse. The enclosed site plans show the existing subdivision, permitted and proposed development. Issued Permits and Permitting History Permits required and secured for the current subdivision include site specific NC DWQ Low Density Stormwater Permits (SW7070602-Phase II and SW7070210MOD-Phase I), Soil Erosion and Sedimentation Control Permits (Pamli-2007-002 Mill Creek Phase I and Pamli-2007-022 Mill Creek Phase II), wastewater evaluations and approvals (on file at the Pamlico County Health Department) and a CAMA Major Permit #28-08 issued on April 4, 2008 for the construction of 1,825 linear feet of bulkhead and CAMA Major Modification 28-08 issued on August 31, 2009 for the construction of walking trails, kayak and canoe launch and day dock. Please note, the day dock and associated Sawgrass Court Walkway are formally being removed from the development plan. In 2006, the initial project scope (Arlington Shores) included the present Mill Creek Phase I, Mill Creek Phase II and proposed Arlington Place subdivisions. A North Carolina State Environmental Policy Act Environmental Assessment (NC SEPA EA) was prepared at that time for all three phases of the project. Representatives of Burton Farm and the Division of Coastal Management agreed to separate the project into two parts; Mill Creek (Phases I and II) and Arlington Place. This project separation allowed the Arlington Place development to continue in the NC SEPA EA process concurrent with the development of Mill Creek. An NC SEPA FONSI for the proposed Arlington Place Development has been issued. The proposed development depicted within this permit application was not a part of the overall development plan in 2006 when the original SEPA EA was submitted. Archaeological Findings and Requirements In an archaeological report prepared by Environmental Services, Inc (ESI) and dated April 2006, nine archaeological sites were identified on the Mill Creek and Arlington Place properties. The 2006 archaeological study reported a total of seven recorded sites (31PM51/51** through 31PM54/54 and 31PM56-31PM58) and two previously. recorded sites (31 PM 13 and 31 PM 15/15). The general locations of the sites are shown on the attached site plan. Please note, only one site (31PM 52/52**) was recommended for additional testing by Environmental Services Inc. A condition of CAMA Permit #28-08 (Issued to Burton Farm Development for shoreline stabilization along the Neuse River) was the testing of site 31 PM52/52** to determine eligibility for inclusion on the National Register of Historic Places (NHRP). This condition was requested by the North Carolina Department of Cultural Resources State Historic Preservation Office (SHPO) in a Memorandum to Mr. Doug Huggett on January 25, 2008. A CAMA Major Permit was issued on April 4, 2008 with a condition that... "prior to initiation of any ground disturbing activities within the project area, the permittee shall arrange for an archaeological assessment of site 31PM52/52**** in terms of the NHRP". Burton Farm contracted the services of ESI and the assessment wad, completed in April of 2008. The assessment concluded that site 31PM52/52** be listed as eligible for inclusion'irT Is the NHRP. Copies of the April 2006 and April 2008 Archaeological Assessments conducted by Environmental Services Inc. (ESI) were included in the September 2008 CAMA Major Permit Modification application. In response to a review of ESI's April 2008 Report entitled Archaeological Testing of Site 31PM52152**** SHPO issued a letter correspondence (dated April 28, 2008) recommending Site 3 1 PM52/52**** for inclusion on the NHRP. The letter correspondence further requests that Burton Farm implement a mitigation plan for site 31PM52/52**** prior to construction of the conditionally permitted bulkhead along the Neuse River. A mitigation plan was presented to SHPO by ESI on behalf of Burton Farm. The mitigation plan was reviewed and approved by the Assistant State Archaeologist, Mr. Lea Abbott. Burton Farm has verbally agreed to perform the mitigation of site 31PM52/52**** and has ceased all development activities within an area of 31PM52/52**** agreed to by Lea Abbott in a meeting on April 21, 2008. The location of 3 1 PM52/52**** is shown on the attached overall site plans. Remaining development activities within site 31PM52/52**** include the installation of underground electric lines and the construction of the conditionally permitted bulkhead shoreline stabilization. Proposed Work The applicants propose to construct a fixed pier and ten slips along with a gravel parking area with a gravel and wooden walkway connecting the parking area to the pier. The slips are a mix of sizes; three at 14 feet by 26 feet and seven at 12 feet by 20 feet (sizes based on boat size that can be supported with proposed structure size). A total of three 15 feet by three feet wide and three 12 feet by three feet wide finger piers are proposed. In addition, the slip arrangement will include six mooring (tie) pilings to create a total of ten wet slips. The platform is proposed to be a total 126 feet long by six feet wide and constructed of slotted wood. A 129 feet wooden pier (76 feet over coastal wetlands, 18.3 feet over non-coastal wetlands and an additional 36 feet over uplands) is proposed that will connect to a 46 linear feet gravel walkway which in turn lead to a 5304 square feet gravel parking lot. All of the proposed development is shown on the attached site plans. Please note, the permitted Sawgrass Court walkway and day dock is not going to be constructed and is formally requested to be removed from all development plans and permitting. None of the proposed work was discussed in the Arlington Shores SEPA document. The Mill Creek Project is a separate project from the Arlington Shores Development and this fact has been established, as evidenced by past and present permitting issuances and regimes. Submerged Aquatic Vegetation A submerged aquatic vegetation (SAV) survey was conducted by the Division of Water Quality in 2009. A copy of the survey was submitted to Mr. Sean McKenna with the Division Marine Fisheries (resource agency with authority in this matter) during the permit application process for the CAMA Major modification submitted in 2009. A copy of the SAV survey results memorandum and a USGS topographic quadrangle with locations of SAV occurrence shown on the map has been attached to this permit application. Based on the SAV survey conducted last year, there is an SAV resource in the waters of Mill Creek and in the general vicinity of the proposed ten slips. Ms. Jill Paxson, with the NC DENR DWQ reported that SAV density was greatest at the mouth of Mill Creek and more patchy toward the headwaters. Please note, Camp Seafarer has used the mouth of Mill Creek to moor large boats (motor and sail) and open runabout boats with typical outboard engines for many years and the SAV resource in the mouth of Mill Creek is reported to be most dense near the mouth. In addition, the SAV resource last year was reported to be limited to horned pond weed, which according to Ms. Jill Paxson, dehisces as the "water warms and winds increase". Therefore, as weather warms and boat activity increases (as is typical in the boating community), the horned pond weed will likely be at the end of its growing season. All of the proposed structures are sited in sufficient water depths (min. -3.0) to allow for the continued growth of the SAV resource while still allowing for use of the public trust. 2 Stormwater Management Division of Water Quality Stormwater Management Permits (SW7070602 and SWSW7070210M(D ) have be n issued for the infrastructure and all of the lots associated with the Mill Creek Subdivision development. A cop ?' the stormwater permit(s) has been included with previous permit applications. The stormwater permit specifically addresses all future development associated with the residential development. The proposed work will not require a modification of the existing permits or the submission of a permit application. A copy of the current and valid low density stormwater permit and subsequent modification have also been included with this permit application request. Soil Erosion and Sedimentation Control Division of Land Resources Erosion and Sedimentation Control Permits (Pamli-2007-002 and Pamli-2007-022) have been issued for the development of the entire site. The proposed construction of the gravel walkways and slotted wooden walkways will not require modification of the existing permits. Water and Sewer All lots associated with the development will be served by on site septic and potable water service will be provided by Pamlico County. The parking lot and walkway will be installed by a grading contactor. The walkway over DWG buffer, wetlands and the pier and slips will be constructed by a marine contractor using traditional construction methods. All necessary equipment will be stored on site. The docks and walkways will either be constructed using the top down method or by barge to limit temporary impacts to wetlands associated with construction. No equipment will be stored in wetlands nor will wetlands be crossed during construction. d. List all development activities you propose. The applicants propose to construct ten slips, 5,577 sf gravel parking and slotted wooden walkway (35 feet by six feet over uplands; 18.3 feet by six feet over Non-coastal 404 wetlands and 76 feet over coastal wetlands) access leading to a 126 feet by six feet wide pier/platform running parallel to the shoreline. The proposed ten slips are a mix of sizes; three at 14 feet by 26 feet and seven at 12 feet by 20 feet. The proposed development includes three 12 by three feet wide finger piers and three 15 by three feet figner piers. A total of six tie piings are proposed. The applicant also will remove all plans to construct the Sawgrass Court walkway and day dock as permitted in CAMA Major Modification 28-08 issued on August 31, 2009.
