Per our telephone conversation yesterday and the faxed memorandum we received from you
late that afternoon, we would like to respond to the objection to the CAMA permit, for the
Stanwick Shores site, by the Division of Marine Fisheries (DMF).
Foremost, this is a highly unusual memorandum at such a late date in the permit process and
coincidentally received by Walton Engineering only one full business day prior to the
deadline (December 16, 2004) of the Division of Water Quality's (DWQ) response to the
latest submittal. Please refer to our letter and submittal to you, dated July 26, 2004. The
DMF originally objected to the original CAMA permit (plan date 5/13/04) in a memorandum
to you dated June 28, 2004. After meeting on site with the DMF the Division issued the
memorandum to Paul Magnabosco dated July 20, 2004 stating the Division would withdraw
its objection to the project if certain conditions were met. Walton Engineering then submitted
the July 26, 2004 revised plan. The DMF did not object to this submittal.
The conditions of the memorandum dated July 20, 2004 have been met. In addition and
irrelevant to the DMF conditions, due to the DWQ objections to the July 26, 2004 submittal,
further revisions to the plan have been made to address the concerns raised, beyond those
conditions the DMF originally required for the DMF to withdraw its objection.
Given the timing of the latest DMF memorandum we respectfully request the Division of
Water Quality base it's review of the latest submittal solely on Division of Water Quality
Rules, and not on the objection of other Divisions. We also request that the Division of
Marine Fisheries would withdraw its objection to the project and adhere to its original
standing since the conditions of the memorandum dated July 20, 2004 have been met.
