Kittrell Hill Bank Parcel Credit Release — Tasks 1,2 & 7
Dear Mr. Griffith:
On June 24, 2020, the Division of Water Resources (DWR) received an As -Built Report from Eco
Terra Partners, LLC (Eco Terra) for the Kittrell Hill site. According to the As -Built survey
submitted with the As -Built Report, there are slight adjustments in the total amounts of buffer
mitigation and nutrient offset credits as compared to the approved Bank Parcel Development
Package. The subject site has generated 363,817 ft2 of buffer restoration credits and 21,147.061 lbs-
Nitrogen nutrient offset credits. The credits being released reflect any changes to the creditable
acreage as proposed in the BPDP.
On August 20 2020, DWR submitted comments to Eco Terra regarding concerns observed during the
review of the As -Built Report. On September 15, 2020, Eco Terra submitted a satisfactory response
to the comments submitted by DWR. Additionally, DWR supports Eco Terra's proposal to provide
supplemental planting at the site. It is expected that Eco Terra will perform this supplemental
planting effort prior to the Year 2 Monitoring season in 2021.
On September 14, 2020, DWR received a performance bond (#54-229659) in the amount of
$100,000 issued to Eco Terra from United Fire & Casualty Company to cover monitoring and
maintenance at the subject site. The term of this bond applies from August 27, 2020 and ends with
the approval of the Year 1 Monitoring Report by DWR.
In accordance with the MBI, signed on March 26, 2020, the following Project Milestones have been
met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and 10% of your Nitrogen nutrient offset credits
(0.10 x 21,147.061 lb-N = 2,114.706 lb-N) and 10% of your Neuse buffer Restoration credits (0.10 x
363,817 ft2 = 36,381.70 ft2) are now available for sale.
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020203 of the Neuse River Basin pursuant to 15A NCAC 02B .0703, which became effective
on April 1, 2020. Additionally, the riparian buffer credits must be used for impacts in the
Neuse River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule,
15A NCAC 02B .0295, which became effective on November 1, 2015.
