The Site is currently managed under the Division of Waste Management, Inactive Hazardous Sites Branch, Registered Environmental Consultant (REC) Program. On June 25, 2015, GHD submitted a certified Remedial Action Plan - Groundwater (Groundwater RAP) for the site that proposed treatment of impacted groundwater using chemical injection. There are two areas of impacted groundwater at the Site and are located on separate parcels with different owners. The first area is identified as the Dowtherm A Area and is located on the 1245 Atlantic Avenue parcel for which a separate Notification has been provided. The second area is identified as the Former Landfill Area and is located on the 1301 Atlantic Avenue parcel for which this Notification is being submitted. Groundwater in the Former Landfill Area is impacted with chlorinated volatile organic compounds, diphenyl ether, and/or 1,1-biphenyl. The areas demonstrating the greatest concentrations of these compounds will be addressed through the injection of an injectable liquid activated carbon (PlumeStop by Regenesis) to adsorb contaminants and the injection of oxygen (ORC-Advanced by Regenesis) that will be released over time to stimulate aerobic biodegradation. Both injectants have been approved by the North Carolina Department Human and Health Services for injection into groundwater; however, PlumeStop was approved with stipulations. As required by the stipulations, a potable well survey has been included as Attachment D of this submittal which indicates there are no public or private water wells within 2,000 feet downgradient of the application area. Additionally, there are no designated surface water supplies within 1,500 feet downgradient of the application area and Figure 1 included in Attachment C provides the location of the monitoring well network present at the Site. The enclosed notification is for a small-scale injection operation for an area less than or equal to10,000 square feet. The injection will be performed in accordance with the rules specified in 15A NCAC 02C .0225. IN SITU REMEDIATION (15A NCAC 02C .02251 or TRACER WELLS (15A NCAC 02C .0229): 1) Passive Injection Systems - In -well delivery systems to diffuse injectants into the subsurface. Examples include ORC socks, iSOC systems, and other gas infusion methods (Note: Injection Event Records (IER) do not need to be submitted for replacement of each sock used in ORC systems). 2) Small -Scale Injection Operations — Injection wells located within a land surface area not to exceed 10,000 square feet for the purpose of soil or groundwater remediation or tracer tests. An individual permit shall be required for test or treatment areas exceeding 10,000 square feet. 3) Pilot Tests - Preliminary studies conducted for the purpose of evaluating the technical feasibility of a remediation strategy in order to develop a full scale remediation plan for future implementation, and where the surface area of the injection zone wells is located within an area that does not exceed five percent of the land surface above the known extent of groundwater contamination. An individual permit shall be required to conduct more than one pilot test on any separate groundwater contaminant plume. 4) Air Injection Wells - Used to inject ambient air to enhance in -situ treatment of soil or groundwater. 5) In -Situ Thermal Wells (IST) — Used to `heat' contaminated groundwater to enhance remediation. DESCRIPTION OF PROPOSED INJECTION ACTIVITIES AT THE SITE — Provide a brief narrative regarding the cause of the contamination, and purpose, scope, goals of the proposed injection activity: The purpose of the proposed injection is to treat localized areas of groundwater contaminated with 1,1-biphen 1, and/or diphenyl ether and chlorinated VOCs. The proposed injection of ORC-Advanced and P1umeStop is expected to stimulate aerobic biodegradation of the contaminants to concentrations below the 2L Standards. Thirty-nine (39) Gallons of a 30% ORC Advanced® solution will be injected into the subsurface (8 to 20 feet below grade) into each of 6 DPT boreholes and approximatelypounds of P1umeStop (552 gallons of solution) will be injected into each of 14 DPT boreholes in the vicinity of well LF-20. The injection area near LF-20 is 30 feet x 20 feet. The iniectants will be delivered at low pressure (less than 20 psi) and at less than 10 gpm in a single application. Quarterly post -injection groundwater monitoring will be performed on LF-20 to assess performance. J. Duckworth ("Grantor"), and ConocoPhillips Company ("Grantee"); Grantor and Grantee, collectively, shall sometimes hereinafter be referred to as the "Parties". RECITALS WHEREAS, Charles J. Duckworth is the owner(s) in fee simple of that certain parcel(s) of land located in 1301 Atlantic Avenue, Rocky Mount, Edgecombe County, North Carolina, pursuant to a deed recorded with the Edgecombe County Registry of Deeds in Book 1467, Page 98; WHEREAS, the Property may be comprised of a disposal site as the result of a release of oil and/or hazardous material; and WHEREAS, Grantee, in cooperation with the North Carolina Department of Environment and Natural Resources ("NCDENR" ), now desires to enter the Property to conduct various environmental investigation and/or remediation activities, including, but not limited to maintenance of remediation systems, including digging and trenching; drill soil borings; installation of monitoring wells; and periodic sampling of wells on the property (the "Work"); WHEREAS, By entering into this Agreement, neither party intends for this Agreement to be interpreted or construed as an admission of any liability; WHEREAS, The Parties desire to enter into this Access Agreement so that the soil and/or groundwater can be assessed pursuant to environmental laws and regulations; NOW THEREFORE, in consideration of the granting of the foregoing, the mutual premises, covenants, conditions and agreements hereinafter set forth, and other good and valuable con- sideration, the receipt and adequacy of which are acknowledged, the Parties agree as follows: 1. Grant of Access - Grantor hereby grants to Grantee, and its employees, representatives and contractors an irrevocable, non-exclusive access and right of entry (the "Access") to enter upon the Property from time to time to conduct the activities described in the above Recitals. Further, Grantor shall cause any tenants or lessees of the Property, not a party hereto, to provide RM&R Site#: 0020 Grantee, including its consultant(s), and/or contractor(s), same Access. This Access Agreement shall commence on May 1, 2008 (Effective Date), and shall run for a period of three (3) years, or until the Work is complete. If Grantee determines in its sole discretion that the Work is complete, it may terminate this Agreement by providing written notice to Grantor in the recordable form. If Grantee is required by a government agency to maintain a well or other equipment on the Property beyond the term of this Agreement, the Grantee shall, on notice of such requirement to Grantor, be extended until thirty (30) days after such requirement ceases. Prior to the expiration of the Agreement, Grantee shall, at its sole cost and expense, (a) cause any excavations to be returned to the original gradient, (b) remove all equipment placed on the Property, (c) fill and level all ditches, ruts and depressions, if any, caused by the closure of the Grantee's excavation operations on the Property and (d) remove all debris resulting therefrom. 2. Compliance with Laws - Grantee shall conduct all operations which are the subject of this Agreement in compliance with all federal, state, and municipal statutes and ordinances, and with all regulations, orders, and directives of appropriate governmental agencies, as such statutes, ordinances, regulations, orders and directives now exist or provide. 3. Permits — Grantee shall be responsible for obtaining any and all governmental permits and approvals which may be necessary for it to conduct any work or activities under this Access Agreement. Grantor shall coordinate and cooperate with Grantee in Grantee's activities to obtain all necessary government permits and permissions. 4. Liens and Claims - Grantor will not permit any mechanics', materialmen's, or similar liens or claims to stand against the Property for labor or material furnished in connection with any work performed by Grantee under this Agreement. Upon reasonable and timely notice of any such lien or claim delivered to Grantee by Grantor, Grantee may bond and contest the validity and the amount of such lien, but Grantee will immediately pay any judgment rendered, will pay all proper costs and charges, and will have the lien or claim released at its sole expense. 5. Cooperation - Grantee agrees to coordinate its activities with Grantor to minimize any impairment of access by customers or business invitees of Grantor to the Property and any inconvenience to or disruption of Grantor's business on the Property. 6. Provisions to Run with the Land. This Agreement establishes certain rights, liabilities, agreements and obligations for the Property, or any portion thereof, which shall run with the Property or any portion thereof, for the term of this Agreement. Grantor hereby covenants for himself and his executors, administrators, heirs, successors and assigns, to stand seized and hold title to the Property, or any portion thereof, subject to this Agreement. The rights granted to Grantee, its successors and assigns, do not provide, however, that a violation of this Agreement shall result in a forfeiture, termination or otherwise. 7. Indemni - Grantee agrees that it will indemnify and hold Licensor harmless from and against any claims, demands, actions, suits, judgments, losses, damages, costs, or expenses incurred as a result of personal injury, property damage, civil penalties, or fines proximately caused by the negligent acts or omissions of Grantee or its authorized contractors, employees and agents in conducting the Work. However, this indemnity and AWR Site#: 0020 hold harmless obligation shall not apply to any such claims, demands, actions, suits, judgments, losses, damages, costs, or expenses to the extent caused by the sole negligence, gross negligence, or willful misconduct of Licensor or any third party. This indemnity is expressly conditioned on the following: (a) In the event Grantor shall identify any matter to which this indemnity may apply or receive a notice or claim from any third party of such matter, it shall immediately, and in every case within thirty (30) days of said notice or claim, notify Grantee in writing of such matter. (b) Grantor shall cooperate with Grantee by allowing Grantee, its agents, representatives, contractors and consultants, prompt and ready access to the Property for the purpose of investigating any matter to which this indemnity may apply. Grantor shall provide Grantee with copies of all investigative reports, data or other information in any form which Grantor, its consultants, agents or attorneys may have pertaining to any such matter, on request of Grantee.
