Any violation of these terms nmiy be subject to fines, imprisonment or civil action; or may cause the petunt to be null and void. 1) The permittee shall execute and cause to be recorded in the Carteret County Register of Deeds, Deed. Restrictions on the adjacent property to the East for the purpose of prohibiting development of additional docking facilities within 100' of the eight slip pier and platform authorized by this permit. The deed shall further state that the restrictions run with the land and shall be binding upon all parties and persons claiming under them and shall not be altered or rescinded without the express written consent of the State of North Carolina Division of Coastal Management. These deed restrictions shall be recorded with the Carteret County Register of Deeds, and copies of the recorded deeds provided to the Division of Coastal Management, prior to the initiation of construction of the docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. E 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable ?f waters at or adjacent to the authorized work. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit.
