be subject to fines, imprisonment or civil action; or may cause the petunt to be null and void.
1) The permittee shall execute and cause to be recorded in the Carteret County Register of Deeds, Deed.
Restrictions on the adjacent property to the East for the purpose of prohibiting development of
additional docking facilities within 100' of the eight slip pier and platform authorized by this permit.
The deed shall further state that the restrictions run with the land and shall be binding upon all parties
and persons claiming under them and shall not be altered or rescinded without the express written
consent of the State of North Carolina Division of Coastal Management. These deed restrictions shall
be recorded with the Carteret County Register of Deeds, and copies of the recorded deeds provided to
the Division of Coastal Management, prior to the initiation of construction of the docking facility.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

any waters that are open to the taking of shellfish. Any such closure directly attributable to the docking
facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions
may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce

6) Should the waterfront property to the east be sold prior to the initiation of construction of the docking
facility, the permittee shall obtain a written agreement from the new owner(s) agreeing to allow the
construction of the permitted docking facility within the riparian corridor of that property, and a copy of
the new agreement shall be submitted to the Division of Coastal Management prior to initiating
construction of the docking facility.
7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
8) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
E 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
?f waters at or adjacent to the authorized work.
10) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
1.1) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.

12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum. permanent s:
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
13) This, permit authorizes a maximuiri of 8 formalized boat slips associated with the docking facility.

15) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
17) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

18) The Division of Watcr Quality approval of this project tinder storniwatcr m_anagemcnt rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SW8080917,
which was issued on 10/1/08. Any violation of the permit approved by the DWQ shall be considered a
violation of this CAMA permit..

x unreasonable obstruction to free navigation of the navigable waters, the permttee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
21) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
TOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
09-0286.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2009-00855 which was issued on 5/6/09.
