The application is for a WQC 3402 (NWP 14) for the remaining portion of a road. The location of the proposed impacts are within a very wide wetland (old beaver impoundment). I have recently learned that I overlooked one very important aspect of the riparian buffer mitigation requirements [15A NCAC 026 .0242(3)(b)], that if riparian buffer mitigation is required for an impact (i.e. road crossing w/greater than 1/3 acre of buffer impacts) wetland impacts within the riparian buffers are subject to mitigation under 15A NCAC 2H .0506 and that wetland area is not included as part of the riparian buffer mitigation area, however the remaining riparian buffer area still requires mitigation at the appropriate ratios. This email is to get your confirmation on this and if you agree I would like to modify the PCN to reflect this amended amount of riparian buffer mitigation for this project. It just so happens that the subject project was placed on hold May 11th so I could submit the modified PCN with the additional information that needs to be sent back to the DWQ. Please let me know if you concur or if you need me to expand on my scenario further. Attached are the impact maps and as you can see it would make a significant difference in the riparian buffer mitigation amounts.
