Note that if the site cannot be developed then preservation of the site may not acceptable (obviously). Potential areas of development that contain jurisdiction wetland could be acceptable. It - s a case by case decision. Can you send a google earth kmz file of the site? Have the 404 wetlands and coastal wetlands been delineated and verified? They will need to be, if accepted as preservation. The MHW line (from a surveyor and relative to a vertical datum) would also be helpful. A Conservation Easement (CE) is the preferred preservation mechanism in this case. The model language for a CE is on our website (see below). The model documents were developed by our legal counsel, please use the exact language. Otherwise, I will have to send it to them for review and approval. I will need a wetland conservation easement map (that will be eventually recorded) and the acreage of each type of wetlands (404, coastal, and possibly isolated) to be preserved (must be clearly labeled on map) for the special condition in our permit. CE recording must take place prior to construction in the wetlands on the site or sale of any lots. Here is a very rough draft special condition: The Permittee shall execute and cause to be recorded in the Carteret County Register of Deeds the Permanent Conservation Easement (see attached) for the purpose of maintaining approximately XXXX acres of (on-site riparian and non-riparian wetlands, coastal, isolated, etc) for XXXX (R. Collette - s property name), in their natural and mitigated state in perpetuity, prior to the sale or conveyance of any lots or other property within the subdivision. A final survey map of the development?, which clearly depicts the surveyed areas of preservation, must also be recorded with the Carteret County Register of Deeds at the same time the Conservation Easement is recorded. No person or entity shall fill, grade, excavate, or perform any other land disturbing activities; nor construct any structures, nor allow animal grazing or watering or any other agricultural use on such conservation areas. The permittee shall enforce the terms of the Conservation Easement and, prior to conveyance of the property, shall take no action on the property described in the Conservation Easement inconsistent with the terms thereof. The permittee shall provide a copy of the recorded Conservation Easement and recorded Survey to the Corps of Engineers within 15 days of recording. These provisions relating to wetlands cannot be amended or modified without the express written consent of the U.S. Army Corps of Engineers, Wilmington District. The onsite option may be acceptable if it can support S. Alterniflora and the DCM would agree. The DCM may have a problem with any disturbance to existing coastal wetlands at this site. The mitigation ratio for onsite restoration (i.e. not creation) can be reduced to 1:1 but a mitigation plan, including 5 years of monitoring, would be required. Please note that for the work to be considered "restoration" we would also need some data that the area to be restored is an area of former coastal wetlands, hence coastal wetland restoration. Creation of coastal wetlands is not acceptable due to unlikelihood of success. Compensating for coastal wetland impacts is never easy; due to the difficulties of successfully restoring coastal wetlands. Plus the value of this land can make this type of work prohibitive. Yes, we can consider a different mitigation bank that can provide coastal wetland restoration. Let me know the bank you are considering. Other options could include onsite or total avoidance of impacts, but I am not sure how possible these are given these wetlands are in the upper part of the existing basin. Are there any other restoration opportunities close to the site? You're looking at ten to twenty thousand dollars or more.
