REQUEST FOR MORE INFORMATION
Dear Mr.Ammons:
On October 15, 2009,the Division of Water Quality(DWQ)received your application dated October 15,
2009,to fill or otherwise impact 132 linear feet of perennial stream and 400 linear feet of intermittent
stream, 3,748 square feet of Zone 1 Neuse River protected riparian buffers, and 3,447 square feet of Zone 2
Neuse River protected riparian buffers to construct the proposed mixed use development at the site. On
December 22,2009,and February 26, 2010,the DWQ received additional information from you, however,
the DWQ has determined that your application remains incomplete and/or provided inaccurate information
as discussed below. The DWQ will require additional information in order to process your application to
impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies
of the additional information requested below,we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. The DWQ does not accept the submitted SMP received on February 26, 2010 as meeting the
requirements of the 401 Stormwater Program for the following reasons:
a. Proof of the Town of Wake Forest's approval has not been provided.
b. The overall Stormwater Plan shown on sheets C-300,C-301 and C-302 does not depict
any stormwater BMPs other than one level spreader shown on sheet C-302. The
locations of the proposed wet detention pond and the bioretention areas are not apparent
on these sheets.
c. The plans submitted are not stamped by an appropriate design professional.
d. It appears that some of the stormwater from this site is being discharged directly to one or
more level spreaders without first passing through a BMP that provides 85%TSS
removal. Under the Town's Phase 11 stormwater program,this project should clearly be
designated as high density and therefore appropriate stormwater treatment should be
provided.
e. The wet detention pond appears to be undersized.
