project proposes to rehabilitate the Atrium CIVIC Main Campus, which
includes the construction of two (2) hospital buildings totaling 1.14 million
square feet with associated parking facilities. The proposed project also
includes onsite and offsite infrastructure improvements, healing pond and
gardens, and improvements to the existing LSC Greenway.

On behalf of our client, Atrium Health, Kimley-Horn (KH) is submitting the enclosed Section 404/401
Pre-construction Notification for the above-referenced project for your review pursuant to a Nationwide
Permit #14. This application is to request authorization for the proposed improvements to the Little
Sugar Creek (LSC) Greenway in association with the rehabilitation of the Carolina’s Medical Center
(CMC) Main Campus. One potential non-wetland water of the US (S1) was identified. The center of the
project area is located at 35.200174°N, -80.837652°W. The following information is included as part of

PROJECT BACKGROUND
The proposed LSC Greenway Improvements Site is located between East Boulevard and East
Morehead Street in Charlotte, Mecklenburg County, NC. The site is the existing Little Sugar Creek
Greenway.

The overall project proposes to rehabilitate the Atrium CMC Main Campus, which includes the
construction of two (2) hospital buildings totaling 1.14 million square feet with associated parking
facilities. The proposed project also includes onsite and offsite infrastructure improvements, healing
pond and gardens, and the aforementioned improvements to the existing LSC Greenway.
The project seeking authorization under the NWP 14 includes the removal of the existing 8-foot wide,
0.6-mile long greenway trail and the replacement with a 12-foot wide multiuse trail. The proposed trail
connections will be 8-feet wide. Additionally, retaining walls are proposed along the entirety of the
stream to provide long-term sustainability of the infrastructure.
The existing 8-foot greenway trail was originally constructed on gabion baskets. Over time, these
baskets have been degrading and the stone has been washing away causing the trail to be undermined
and/or compromised in areas, resulting in a high priority public safety concern. City/County staff have
reinforced some of these degraded sections with shotcrete to provide a temporary solution; however,
additional areas continue to be compromised. The trail replacement will be constructed to current
City/County standards and proposed to remove the existing degraded/antiquated gabion wall system
and replace with an engineered wall solution.
Additionally, construction of the proposed multi-use trail requires the replacement/realignment of three
existing 90-degree spanned crossings over LSC with 45-degree spanned crossings necessary for
continuous movement of bicycle and pedestrian traffic and overall bicycle/pedestrian safety.
AGENCY CORRESPONDENCE
Cultural Resources
Kimley-Horn consulted the North Carolina State Historic Preservation Office (SHPO) HPOWEB GIS
service on May 13, 2020. No documented architectural, historic, or archaeological sites of significance
within the project boundary were identified. The Myers Park Historic District is located adjacent to the
project area on East Boulevard. However, no impacts to this Historic District are anticipated.
Protected Species
A review of the North Carolina Natural Heritage Program (NCNHP) database on May 13, 2020, did not
indicate known occurrences of threatened or endangered species within the project boundary.
Additionally, pedestrian surveys conducted by Kimley-Horn on October 1, 2019, did not identify any
occurrences of protected species within the property boundary. A concurrence request letter was
submitted to the USFWS on May 29, 2020. A response was received on August 13, 2020 and the
project will have no effect on listed species (See attached NCNHP Letter and USFWS Concurrence
Request).
PROPOSED IMPACTS TO JURISDICTIONAL WATERS
Authorization is requested under NWP 14 to remove the existing 8-foot greenway trail and gabion walls
along LSC and replace with segmented block retaining walls and new 12-foot multi-use trail. The project
proposes temporary impacts to 3,340 linear feet of LSC within stream-side areas necessary for
construction. The project does not propose any losses of waters of the US.
AVOIDANCE AND MINIMIZATION
Temporary coffer dams will be installed within LSC, parallel to the construction areas, to allow
construction to be conducted in dry conditions and for erosion control purposes.

COMPENSATORY MITIGATION
Compensatory mitigation is not proposed as part of this project since associated impacts are temporary
and will be occurring within historically impacted stream-side areas.
