Krause Well Construction/Abandonment Permit No. WV0100033 Variance Request to Rule 15A NCAC 2C. .0113(b)(1)(A) Property located at 611 Brevard Road,Asheville, NC Buncombe County, NC Dear Mr. Krause: On July 9, 2009, the Asheville Regional Office of the Division of Water Quality (DWQ) received your request for a variance to the well construction rules, specifically, a variance request to Rule 15A NCAC 2C. .0113(b)(1)(A). This rule requires a well's casing to be removed entirely prior to abandonment or properly grouted in accordance with 15A NCAC 2C .0107(e) (i.e., 20 ft below land surface).On July 1, 2009 DWQ issued you a variance denial letter and instructed you to abandon the subject supply well due to insufficient grout and the location of the well. Due to the inherent difficulty in removing well casing from consolidated rock formations, we are granting your variance request that the well not have to be grouted to standards prior to permanent abandonment. However, you should"make an effort to remove the casing entirely if possible thereby negating this permit and its conditions entirely. Specific permit conditions are attached and should aid in mitigating any potential problems that could adversely affect groundwater in the vicinity of the well. Permit conditions are enforceable under North Carolina law. The granting of this permit, which includes a variance, is for the abandonment of the well only, and in no way relieves the owner or agent from other,requirements of the North Carolina Well Construction Standards, or any other applicable law, rule or regulation that may be regulated by other agencies. If you are dissatisfied with this decision, you may commence a contested case by filing a petition under G.S. 150-23 within sixty (60) days after receipt of the decision. A copy of this permit, which includes a variance, should be attached to the required Well Construction Abandonment Record (GW-30). The well site location is on property owned by 0090 Properties LLC located at 611 Brevard Road in Buncombe County, North Carolina, in accordance with the application dated July 9, 2009, and in conformity with the specifications and supporting data, all of which are filed with the Department of Environment and Natural Resources and are considered a part of this permit. This Permit is for well abandonment only, and does not waive any provisions or requirements of the Water Use Act of 1967, or any other applicable laws or regulations. Abandonment of a well under this Permit shall be in compliance with the North Carolina Well Construction Regulations and Standards, and any other laws and regulations pertaining to well construction. This Permit will be effective from the date of its issuance until October 6, 2009, and shall be subject to other specified conditions, limitations, or exceptions as follows: 1. The depth of the well, depth of casing and depth to water shall be determined and the information recorded prior to abandonment. To abandon the well in accordance with the standards (refer to attached pamphlet) you will need to determine the depth of casing. If you are unable to determine the depth of casing, you are required fill the well entirely with grout. Any remaining casing shall be terminated at least 6 inches below grade; 2. The well contractor shall be certified by the North Carolina Well Contractor Certification Commission as required by General Statutes 87-98.4,Title 15A NCAC 2C.0101 and .0110; 3. Notification shall be given to Landon Davidson at the letterhead address or by telephone at (828) 296-4500, at least 24 hours prior to the start of well construction; 4. Please note on the GW-30 form for this well abandonment that a variance was issued; and, 5. You must notify the County Health Department of your intentions to abandon this well.
