Skvarla, III Governor Director Secretary August 2, 2013 RadioShack Corporation C/O Mr. Jaime Caballero 300 RadioShack Circle MW-CF 4-324 Fort Worth, TX 76102 Re: Variance Request to Rule 15A NCAC2C .0108 WV0100055 111 Old Bee Tree Road Swannanoa,NC PIN# 9689-07-1871 Dear Mr. Caballero, On July 31, 2013, the Asheville Regional Office of the Division of Water Quality (DWQ) received your request for a variance to the North Carolina Well Construction Standards, specifically Rule 15A NCAC 2C .0108(h) and (i). The variance request is for the construction of eighteen (18) soil vapor extraction wells to be constructed at 111 Old Bee Tree Road, in Swannanoa, Buncombe County,North Carolina. Based upon the information provided by your agent, Susan E. Kelly, it is my finding that the factors specified are sufficient to satisfy the conditions for approval of a variance as defined in 15A NCAC 2C .0118. This variance will be effective for a period of six (6) months beginning from the date of issuance. Please note the variance conditions, listed below, regarding construction of these soil vapor extraction wells. This variance shall be subject to the following specified conditions as follows: 1. Up to fourteen wells will be constructed outdoors. The outdoor wells will be constructed with a minimum of 6 inches of packing material extending above the top of the well screen. A bentonite seal, extending a minimum of 24 inches, will be installed above the packing material. A watertight subgrade vault will be installed around the outdoor wells and will extend a minimum of 24 inches below the ground surface and will be surrounded by concrete. The concrete will be sloped to direct precipitation away from the vaults. 2. Up to three wells will be constructed indoors. The indoor wells will be constructed with a minimum of 6 inches of packing material extending above the top of the well screen. Concrete will be installed above the bentonite seal to, at a minimum, match the existing thickness of the building slab foundation. 3. A watertight subgrade vault will be installed on existing well SVE-1. The grout around the existing well will be removed to a maximum depth of 24 inches. The subgrade vault will be surrounded by concrete and the concrete will be sloped to direct precipitation away from the vault. 4. Attach a copy of this variance to each GW-1 form submitted. The granting of this variance is for the packing material, bentonite seal, and grout portions of the well only and in no way relieves the owner or agent from other requirements of the applicable North Carolina Well Construction Standards (NCAC 2C .0108), or any applicable law, rule, or regulation that may be regulated by other agencies. If you are dissatisfied with this decision, you may commence a contested case by filing a petition under G.S. 150-23 within sixty (60) days after receipt of the decision.
