In accordance with the provisions of Article 7, Chapter 87, North Carolina General Statutes, and other applicable
Laws, Rules and Regulations.
PERMISSION IS HEREBY GRANTED TO
Chaucer Investments, LLC (petitioner for DSCA #92-0048)
FOR THE CONSTRUCTION OF A MONITOR WELL SYSTEM (DSCA #92-0048 -Rollins Economy Cleaners)
consisting of one well owned by Chaucer Investments, LLC (petitioner for DSCA #92-0048) at mailing address 1646
MSC in Raleigh, NC. The well will be located on the property owned by the City of Raleigh located at 1027 N. West
Street in Raleigh, NC -Wake Co. This Permit is issued in accordance with the application received on October 7, 2020
and the additional requested information received on October 16, 2020 in conformity with specifications and
supporting data, all of which are filed with the Department of Environment and Natural Resources and are considered
integral parts of this Permit.
This Permit is for well construction only, and does not waive any provision or requirement of any other applicable
law or regulation. Construction of any well under this Permit shall be in strict compliance with the North Carolina
Well Construction Regulations and Standards (15A NCAC 02C .0100), and other State and Local Laws and
regulations pertaining to well construction.
If any requirements or limitations specified in this Permit are unacceptable, you have a right to an adjudicatory hearing
upon written request within 30 days of receipt of this Permit. The request must be in the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this Permit
is final and binding.
This Permit will be effective for one year from the date of its issuance and shall be subject to other specified conditions,
limitations, or exceptions as follows:
1. Issuance of this Permit does not obligate reimbursement from State trust funds, if these wells are
being installed as part of an investigation for contamination from an underground storage tank or
dry cleaner incident.
2. Issuance of this Permit does not supersede any other agreement, permit, or requirement issued by
another agency.
3. The well(s) shall be located and constructed as shown on the attachments submitted as part of the
Permit application.
4. Each well shall have a Well Contractor Identification Plate in accordance with 15A NCAC 02C
.0108(o).
5. Well construction records (GW-1) for each well shall be submitted to the Division of Water
Resource's Information Processing Unit within 30 days of the well completion.
6. When the well is discontinued or abandoned, it shall be abandoned in accordance with 15A NCAC
02C .0113 and a well abandonment record (GW-30) shall be submitted to the Division of Water
Resource's Information Processing Unit within 30 days of the well abandonment.
7. If the well penetrates any water -bearing zone that contains contaminated waters, the upper three feet
of the well shall be grouted within one day after the casing is set or the well abandoned.

ACCESS AND LICENSE AGREEMENT
bTHIS ACCES AND LICENSE AGREEMENT (the "Agreement") is made as of
�_�%��1 AM 2020 by and between Hart & Hickman, P.C., a North Carolina
professional corporation, ("Licensee") having an address of 2923 S. Tryon Street, Suite 100,
Charlotte, NC 28203 and the City of Raleigh, a North Carolina municipal corporation ("City").
WHEREAS, a former dry-cleaning facility is located at 407 West Peace Street, Raleigh,
North Carolina 27603 (the "Former Dry -Cleaning Facility") and owned by Chaucer Investments
LLC.; and
WHEREAS, the City owns property known as Parcel ID No. 1704528222 located at 1027
N. West Street, Raleigh, North Carolina, 27603 (the "Property") located within contiguous to
an area containing soil and groundwater contamination related to the Former Dry -Cleaning Facility
and has the authority to grant the access required hereunder; and
WHEREAS, Licensee desires to assess whether soil and groundwater contamination
related to the Former Dry -Cleaning Facility may be present on and in the vicinity of the Property;
and
WHEREAS, Licensee desires to install, inspect, and sample monitoring well(s) on the
Property pursuant to the terms of this Agreement.
NOW, THEREFORE, in consideration of the execution of this Agreement, and other
valuable and good consideration, the receipt and sufficiency of which is hereby acknowledged,
Licensee and City agree as follows:
L Work. The term "Work" shall be defined to include the installation, inspection, and
periodic sampling of a groundwater monitoring well as described in the attached Exhibit "A".
Licensee shall work with Billy Jackson (William.Jackson@raleighnc.gov, 919-996-2984) and Kris
Nikfar (Kris.Nikfar@raleighnc.gov, 919-996-4786) to determine the precise location of the
monitoring well. The Work will be performed by a North Carolina licensed well contractor at the
direction of a Licensee. As between Licensee and City, Licensee agrees to be solely responsible
for all costs and expenses incurred in performing the Work contemplated hereunder, and City shall
have no obligation or responsibility for such costs or expenses.
2. Grant of License. City hereby grants Licensee, its authorized agents, employees,
contractors, and sub -contractors (the "Performing Entities"), for the benefit of the Property, a non-
exclusive license ("License") for access to the Property to enter the Property for the express and
limited purpose of performing the Work pursuant to the terms of this Agreement. The City shall
in all other respects as owner of the Property be able to make all Iawful uses of the Property not
inconsistent with the terms of this Agreement.
3. Terms of License. The Performing Entities shall exercise their rights under the License
IN WITNESS THEROF, the parties have executed this Agreement on the dates set forth
on the first page of this Agreement.
