Impact Justification and Mitigation 1.Avoidance and Minimization la.Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:* Prior to site plan design,the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and"waters"could be minimized. Vandalia Road. We are also requesting an NCDWR 401 WQC for the above referenced impacts, as well as a Buffer Authorization for 11,352 sf of permanent riparian buffer impacts and 2,331 sf of temporary riparian buffer impacts for construction of the proposed project. The proposed road improvements are located entirely within existing ROW and easements obtained by the City of Greensboro. The project is located within the Cape Fear (Jordan) Basin (HUC 03030002) and drains to South Buffalo Creek (Stream Index: 16-11-14-2; Water Quality Classification: WS-V;NSW). Proposed Project The purpose of the proposed project is widen East Vandalia Road to three lanes in order to create a center turning lane, as well as bike lanes and sidewalks on both sides of the road in order to improve safety for vehicles, pedestrians and bicyclists. Currently, East Vandalia Road is a two-lane road. There are numerous driveways along East Vandalia, creating significant traffic congestion during peak travel times due to vehicles turning across traffic to access the driveways. The addition of the center turning lane will provide storage for vehicles turning across traffic, allowing for free-flowing traffic in the travel lanes. The proposed project will consist of the widening of East Vandalia Road to accommodate a center turning lane, bicycle lanes and sidewalks,which requires extension of the existing 48-inch culverts within Streams 1 & 2. Additionally, existing utilities located within the current road shoulders will be relocated to the edge of the proposed road shoulders. Sheets from the Construction Drawings specific to the impact areas have been provided as an attachment to this application. The project will be constructed using traditional commercial construction equipment and techniques. Project History WithersRavenel conducted a wetland delineation for the proposed project areas on 7/10/2020. There are no wetlands within the project alignment. There are two perennial streams (Streams 1 & 2) within the project area. A Jurisdictional Determination Exhibit has been provided as an attachment depicting the findings of the delineation. Please note that we are not requesting issuance of a JD in conjunction with issuance of the NWP 14. All streams depicted on the USGS and Soil Survey within and adjacent to the project areas are present in the field. Therefore, buffer subjectivity is conceded and a formal buffer determination from NCDWR is not requested. Proposed Impacts The proposed impacts consist of: • 91 If of permanent stream impacts for extensions of the existing culverts • 41 If of temporary stream impacts for installation of culvert extensions • 11,352 sf of permanent riparian buffer impacts for road fill • 2,331 sf of temporary riparian buffer impacts temporary construction access There is a meander at the proposed extension of the culvert in Stream 2. As a result, the stream channel will need to be realigned to flow directly into the culverts to avoid undercutting and failure of the culverts. The entire section of Stream 2 that will be realigned has been assessed as a permanent impact (Impact 4). The realigned channel will be constructed to match the existing contours and elevations of the existing channel. Upon completion of construction, the 41 If of temporarily impacted stream channel (Impact 2)will be restored to pre-construction contours and elevations. The proposed temporary riparian buffer impact areas will be restored to pre-construction contours and seeded with a riparian seed mix to temporarily stabilize the area until natural recruitment can permanently stabilize the riparian buffers. Avoidance and Minimization Prior to site plan design,the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Due to East Vandalia Road being an existing road with two stream crossings, impacts could not be avoided. Proposed impacts have been minimized to those necessary to widen the existing road to accommodate the center turning lane, bike lanes and sidewalks. Access during construction will occur from uplands. Silt fencing will be installed around all disturbed areas to prevent loss of sediment into adjacent waters. Mitigation The proposed permanent stream impacts are less than 150 If, and therefore mitigation is not proposed. The current request is for 91 If of permanent stream impacts,41 If of temporary stream impacts, 1,352 sf of permanent riparian buffer impacts and 2,331 sf of temporary riparian buffer impacts (see the attached maps and PCN for details). The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina,part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss.
